90-29 . e e city of Chanhassen Carver and Hennepin Counties, Minnesota DATE: March 12. 1990 MOTION BY: Workman RESOLUTION NO: SECONDED BY: 90-29 Dimler A RESOLUTION AUTHORIZING A FEASIBILITY STUDY FOR THE HARVEY/O'BRIEN SANITARY SEWER EXTENSION PROJECT 90-5 WHEREAS, Al fred Harvey, 1420 Lake Lucy Road and Terrance O'Brien, 1430 Lake Lucy Road, have petitioned the city of Chanhassen for sanitary sewer service because Mr. Harvey is currently experiencing problems with his septic system and because the sewer service has to pass through the O'Brien property in order to reach the Harvey property. WHEREAS, both of these properties are outside the Metropolitan Urban Service Area (MUSA) limits where municipal sanitary sewer service is not allowed. WHEREAS, since the Harvey septic system is failing, it seems prudent to petition the Metropolitan Council for a Guide Plan Amendment which would allow the Harveys and O'Briens to connect to municipal sanitary sewer. NOW, THEREFORE, BE IT RESOLVED by the Chanhassen city Council that the firm of Engelhardt and Associates is hereby directed to prepare a feasibility study to evaluate the costs and practicality of extending sanitary sewer service to said properties. The property owners have agreed to waive their rights and pay the assessments to cover the City's expenses for the Guide Plan amendment and feasibility study. They Harveys and 0' Briens understand that if the Metropolitan Council refuses to allow the City to amend its MUSA line in this area that the extension will not be allowed and Mr. Harvey will then have to pursue on-site remedies to resolve his failing septic system problems. Passed and adopted by the Chanhassen City Council this 12th day of March, 1990.
