90-48 e CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA RESOLUTION Date: April 23, 1990 Resolution No. 90-48 Motion By: Dimler Seconded By: Workman RESOLUTION AUTHORIZING CONDEMNATION OF PROPERTY FOR PUBLIC ROADWAY AND UTILITY PURPOSES WHEREAS, that the City Council of the city of Chanhassen has determined that it is necessary and for a public use and purpose to acquire the property described in the attached Exhibit "A" for public roadway and utility purposes in connection with the proposed West 78th Street North Side Parking Lot Project. NOW, THEREFORE, BE IT RESOLVED, by the Chanhassen City tit Council: The City Attorney is hereby authorized and directed to acquire the property described in the attached Exhibit "A" by eminent domain proceedings under the "quick-take" provisions of Minnesota Statutes Chapter 117, unless acquired by negotiation or otherwise before the proceedings are complete. ADOPTED by the City Council of the City of Chanhassen this 23rd day of April, 1990. ATTEST: 42,Q~ Don Ashworth, erk/Manager e e e - EXHIBIT "A" A permanent easement for roadway and utility purposes over, under and across all that part of Lot 1, Block 4, HIGHLAND PARK, according to the recorded plat thereof, Carver County, Minnesota, which lies southerly of a line drawn westerly from a point on the easterly line of said Lot 1 distant 32.00 feet northerly from the southeast corner of said Lot 1, as measured along said easterly line, to the southwest corner of said Lot 1. Together with a temporary easement for construction purposes over, under and across all that part of said Lot 1 which lies southerly of the following described line: Commencing at the southeast corner of said Lot 1; thence northerly along the easterly line of said Lot 1 for 52.00 feet to the actual point of beginning of the line to be described; thence westerly to a point on the westerly line of said Lot 1 distant 22.00 feet northerly from the southwest corner of said Lot 1, as measured along said westerly line, and said line there terminating, AND which lies northerly of the permanent easement parcel described above.
