A RESOLUTION VACATING A PORTION OF OLD LAKE LUCY ROAD
BETWEEN WHITETAIL RIDGE AND WOOD DUCK LANE
WHEREAS, a petition was received from Paul Palmer requesting
vacation of a portion of Lake Lucy Road that is a part of Lot 6,
Whitetail Ridge; and
WHEREAS, a public hearing was held on said petition on July
23, 1990; and
WHEREAS, said public hearing was preceded by two weeks
published and posted notice as required by section 412.851 of
Minnesota Statutes; and
WHEREAS, there is no public interest to be. served by the
continued public ownership of that portion of the above described
right-of-way since Lake Lucy Road has been realigned to the south.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Chanhassen that any and all of the above described road right-
of-way as described in Exhibit 1 is hereby vacated contingent upon
the following:
1. A 20 ft. permanent utility and drainage easement over the
sanitary sewer on Lot 6, Whitetail Ridge shall be
retained/conveyed to the City (see Exhibit 2); and
2. The Park and Recreation Commission shall review the
application to determine if a trail easement should also
be dedicated. (Note: The Park and Recreation Commission
reviewed the application on August 21, 1990 and chose not
to require a trail easement.)
Passed and adopted by the Chanhassen City Council this 23rd
day of July, 1990.

That part of the north half of Lake Lucy Road lying adjacent to Lot
6, Block 1, WHITETAIL RIDGE, according to the recorded plat
thereof, Carver County, Minnesota described as follows:
commencing at the northeast corner of said Lot 6; thence South 1
degree 1 minute 10 seconds East, along the east line of said Lot 6,
a distance of 191.73 feet to the point of beginning; thence South
12 degrees 1 minute 32 seconds West 33.00 feet; thence westerly a
distance of 76.26 feet along a curve not tangential with the last
described line, said curve is concave to the south, has a radius of
354.23 feet, a central angle of 12 degrees 20 minutes 08 seconds,
and the chord of said curve has a bearing of North 84 degrees 08
minutes 32 seconds West; thence northerly a distance of 33.68 feet
along a curve not tangential with the last described curve, said
curve is concave to the west, has a radius of 50.00 feet, a central
angle of 38 degrees 35 minutes 38 seconds, and the chord of said
curve has a bearing of North 3 degrees 29 minutes 11 seconds West;
thence easterly a distance of 85.20 feet along the south line of
said Lot 6, said south line of said Lot 6 being a curve not
tangential with the last described curve, said curve is concave to
the south, has a radius of 387.23 feet, a central angle of 12
degrees 36 minutes 23 seconds, and the chord of said curve has a
bearing of South 84 degrees 16 minutes 40 seconds East, to the
point of beginning.

A permanent easement for utility and drainage purposes over, under
and across the easterly, southerly and westerly 10 feet of that
part of the vacated north half of Lake Lucy Road adjacent to Lot 6,
Block 1, WHITETAIL RIDGE ADDITION; said permanent easement lies
parallel and immediately adjacent to the following described line:
Beginning at the southeast corner of Lot 6, Block 1, WHITETAIL
RIDGE ADDITION; thence south 120 01' 32" west a distance of 33.00
feet; thence westerly a distance of 76.26 feet along a curve not
tangential with the last described line, said curve is concave to
the south, has a radius of 354.23 feet, a central angle of 120 20'
08" and the chord of said curve ha~ a bearing of north 840 08' 32"
west; thence northerly a distance of 33.68 feet along a curve not
tangential with the last described curve, said curve is concave to
the west, has a radius of 50.00 feet, a central angle of 380 35'
38" and a chord of said curve has a bearing of north 30 29' 11"
west and there terminate.

purposes over, under, across and through that part of the vacated

Beginning at the southwest corner of Lot 6, Block 1,
2ND ADDITION; thence continuing southwesterly along
of the southeasterly lot line of Lot 6, Block 1 of
2ND ADDITION a distance of 49.80 feet more or
centerline of Lake Lucy Road and there terminating.
