RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY
FOR PROPOSED TRUNK HIGHWAY 101 REALIGNMENT
RESOLVED, that the City Council of the City of Chanhassen,
(.oes hereby determine that it is necessary and for a public use
~nd purpose to acquire the property known as the Chanhassen Taco
~hop, legally described on the attached Exhibit "A", for the
~roposed realignment of Trunk Highway 101.
AND BE IT FURTHER RESOLVED, that the Mayor and City
(lerk/Manager are hereby authorized and directed to execute all
~ocuments necessary to effect the acquisition of the afore-
~entioned property, and that the City Attorney be, and hereby is,
~-uthorized and directed to effect negotiations and/or, if
~ecessary, institute condemnation proceedings and to do all
t~ings necessary and incidental thereto to acquire the property
~ursuant to Minnesota Statutes Chapter 117 under the "quick take"
provisions of the Statute.

of NE 1/4) of Section 13, Township 116 North, Range 23 West, Carver
County, Minnesota, lying Southerly of the Southeasterly right-of-
way line of Chicago, Milwaukee, St. Paul and Pacific Railroad and
rortherly of the Northwesterly right-of-way line of new Trunk
~ighway No. 5;
}XCEPT, a strip of land 35 feet wide running over and across the
~bove described tract, lying adjacent to and being parallel with
the Southeasterly right-of-way line of the Chicago, Milwaukee, St.
}aul and Pacific Railroad.
