90-117 .. .. e CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA RESOLUTION Date: September 24, 1990 Resolution No. 90-117 Motion By: Chmiel Seconded By: Johnson RESOLUTION AUTHORIZING ACQUISITION OP PROPERTY FOR PROPOSED TRUNK HIGHWAY 101 REALIGNMENT RESOLVED, that the city Council of the City of Chanhassen, does hereby determine that it is necessary and for a public use and purpose to acquire the Apple Valley Red-E-Mix property, legally described on the attached Exhibit "A", for the proposed realignment of Trunk Highway 101. AND BE IT FURTHER RESOLVED, that the Mayor and City e Clerk/Manager are hereby authorized and directed to execute all documents necessary to effect the acquisition of the afore- mentioned property, and that the City Attorney be, and hereby is, authorized and directed to effect negotiations and/or, if necessary, institute condemnation proceedings and to do all things necessary and incidental thereto to acquire the property pursuant to Minnesota Statutes Chapter 117 under the "quick take" provisions of the Statute. A parcel of land situated within the corporate limits of the Village of Chanhassen and being located in the Northeast Quarter of the Northeast Quarter of Section 13 , Township 116, Range 23, West which is adjacent t,o the right-of-way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad Corrpany and is more particularly described as follows: Corrrrencing at the point of intersection of the West line of said Northeast Quarter of the Northeast Quarter and the most Southerly right-of-way line of said Railroad Corrpany and running thence Northeasterly along the said right-of-way line a dis- tance of 120 feet, more or less, to the South line of State Trunk Highway No. 5; thence East along said South line a distance of 35 feet more or less, to a point on said line of said Trunk Highway 5 which is distant 35 feet when rreasured at right angles fran the said Southerly line of said Railroad right-of-way; thence Southwesterly along a line parallel to said Southerly line of said Railroad right- of-way, a distance of 122 feet, more 'or less, to the said West line of said North- east Quarter of the Northeast Quarter of said Section 13 ; thence North along the said West line of said Northeast Quarter of Northeast Quarter to the point of beginning; Also, that part of the Northwest Quarter .of the Northeast Quarter of Section 13, Town- ship 116 North, Range 23 West, described as follows: e Corrrrencing at the Northeast corner of the.
