EXECUTIVE SUMMARY
The applicant, Carver County, is requesting site plan approval for a 13,260 square-
foot, two-story office building.
ACTION REQUIRED
City Council approval requires a majority of City Council present.
PLANNING COMMISSION SUMMARY
The Planning Commission held a public hearing on April 15, 2008 to review the
proposed development. The Planning Commission approved a motion, six for and
none against, recommending approval of the site plan. The only concern that the
Planning Commission expressed, was that there should be adequate signage to direct
people to the new service center. The Planning Commission minutes for April 15,
2008 are item la of the May 12, 2008 City Council packet.
The City is proposing providing directional signs on the signal arms of the light on
Kerber Boulevard and West 78th Street to direct people to the service center.
RECOMMENDA TION
Staff and the Planning Commission recommend adoption of the motion as
specified on pages 8 and 9 in the staff report dated April 15, 2008 approving the
Carver County Service Center.

SUMMARY OF REQUEST: The developer is proposing a two-story office building with a
basement. The main floor will be for a Carver County Taxpayer Service Center. The basement
level will be for mechanical equipment and storage. The second story is office space.
LEVEL OF CITY DISCRETION IN DECISION-MAKING:
The City's discretion in approving or denying a site plan is limited to whether or not the
proposed project complies with Zoning Ordinance requirements. If it meets these standards, the
City must then approve the site plan. This is a quasi-judicial decision.

PROPOSAL/SUMMARY
The applicant, Carver County, is requesting site plan approval for a 13,260 square-foot, two-story
office building.
The entire area around the site is zoned Planned Unit
Development, PUD. The property to the north contains
a two-story bank building with offices. To the east,
across Kerber Boulevard, is Market Square, a retail
center. To the south across Picha Drive is an office and
manufacturing building. To the west is the loading dock
area for the Target store.
The building is oriented on the property to provide a
vista from West 78th Street. The main entrance, which is
located on the north side of the building, is located on a
plaza which is accessed from Kerber Boulevard.
Parking is located to the north and west of the building.

City sewer and water are available in Kerber Boulevard. Access to the site is via Kerber Boulevard
and Picha Drive.
The site slopes from a high point of 962 on the north property line to a low point in the southwest
comer at an elevation of950. The site is vegetated, but has no trees.
The proposed development provides a welcome addition to the downtown area and is consistent
with the comprehensive plan. The site plan, subject to the adjustments recommended by staff,
complies with all district regulations for the property. Staff is recommending approval of the site
plan for the Carver County Service Center.

North Elevation
Size Portion Placement
The entrance to the building is off the plaza area on the north side of the structure. The north
elevation features the use of two-story window structures. The entrance area is highlighted by
projecting out from the main body of the building. Aluminum and glass curtain walls around the
stairwells emphasize the entry area. The building is articulated through the use of two primary
building materials: face brick and stucco. The lower story is differentiated by having the east
and south elevations projecting out from the main building envelop. Aluminum sun screen
canopies are incorporated on the east and south elevations.
Material and Detail
Building materials consist of face brick, stucco and aluminum and glass curtain walls and
windows.
Color
The face brick is grayish-tan in color. The stucco is painted
yellow and green.
Height and Roof Design
East Elevatlon
The building height is 30 feet 6 inches to the top of the parapet. There are multiple rooflines on
the building with three different levels. Metal sun screens are included on the east and south
building facades. Mechanical equipment is not being proposed on the roof.
Facade Transparency
The northern elevation of the building is the primary building fa<;ade which shall be visible from
West 78th Street. 54 percent ofthe northern first floor elevation includes transparent windows
and/or doors. All other areas include landscaping material and architectural detailing and

articulation. An additional window should be incorporated in the southeast comer of the
building to provide additional window area on Kerber Boulevard.
The architecture detailing includes the use of upper level windows, the use of spandrel glass or
architectural details which provide patterning, recesses and shadowing that create aesthetic
interest.
Site Furnishing
The site includes a pedestrian plaza on the north side ofthe building. The plaza features
benches, bike racks, landscaping, lighting, planters and retaining walls.
Loading Areas, Refuse Area, etc.
A screened waste and recycling area is located on the south side of the building. A small truck
area is included south of the building.
Landscaping
Minimum requirements for landscaping include 1,213 square feet of landscaped area around the
parking lot, two landscape islands or peninsulas, five trees for the parking lot, and bufferyard
plantings along the property lines. The applicant's proposed as compared to the requirements for
landscape area and parking lot trees is shown in the following table.

Applicant does not meet minimum requirements for understory trees in the bufferyard plantings
along the north property line. Considering the neighboring use, views and planting space, staff
recommends that the bufferyard be accepted as proposed.
The applicant's proposed shrubs and trees for the north and west bufferyards are appropriate for
the site and will require less ongoing maintenance than turf. Staff recommends that the wood
chip mulch specified along the north property line be extended to the proposed turf area under
the tree at the northwest comer of the parking lot. Wood chip mulch is the preferred ground
cover for trees and will reduce maintenance input in this area of the site.
Lot Frontage and Parking location
Parking is distributed on the north and west sides of the building. No parking is proposed
between the front fa<;ade and Kerber Boulevard. One (1) "van-accessible" parking space is
required.
LightinglSignage
The applicant illustrates site lighting on their lighting plan with three different light fixtures, but
provides no detail on the proposed lighting. City Code requires a decorative, shoebox fixture (high-
pressure sodium vapor lamps) with a square ornamental pole to be used throughout the development
area for area lighting. All light fixtures shall be shielded.
Signage is permitted on two building elevations. The applicant is proposing wall signage on the
north and east elevations. Wall signage shall comply with City Code requirements for signage in
the Central Business District. Signs must use individual dimension letters with a minimum of Y2-
inch depth. Logos may not exceed 15 percent of the signage area. Wall signage shall be backlit
if illuminated.
A future monument sign location is shown on the plans. The site is permitted a monument sign
near the driveway entrance to the property. The sign shall not exceed sixty-four (64) square feet
in sign display area nor be greater than eight (8) feet in height.
A separate sign permit is required for signage.
STREETS
There are no public streets proposed or required for development of this site. The site is
bordered by Kerber Boulevard to the east and Picha Drive to the south. Both public streets are
34 feet wide within a 60-foot wide right-of-way. No improvements or right-of-way acquisition
is required for either public street.
SITE ACCESS AND SITE CIRCULATION
The only access to the site is proposed on Kerber Boulevard and will be 26 feet wide and
accommodate two-way traffic. At the right-of-way line this access will be approximately 27 feet

south ofthe M&I Bank access; however, the curb cut at the street will tie into the bank's curb
cut. The City's access spacing guideline for the street and use is 50 feet. Staff supports the
reduced spacing for the following reasons:
1. Kerber Boulevard dead ends approximately 500 feet south of the proposed access.
2. The grades south of the proposed access are too steep to construct an access that would
meet the City's maximum driveway grade requirement.
3. A joint access with the bank cannot be achieved due to the grade difference between the
two properties.
A second access is proposed on Picha Drive. This access will be for traffic exiting the site only.
The proposed driveway is 22-feet wide curb to curb and aligns with the existing driveway on the
south side of Picha Drive. This access will provide egress for drive-thru traffic and staff parking.
This access does not align precisely with the driveway to the south; however, staff supports the
proposed alignment due to the low traffic volume in this area and because this access will be
one-way only.
The driveway at Kerber Boulevard will provide the only ingress to the site. The customer
parking area will lie on the north side ofthe building; therefore, the majority of customer egress
from the site will be from the Kerber Boulevard driveway.
The proposal includes a drive-thru window on the west side of the building. The one-way drive
aisle to serve the drive-thru and the parking will be 26 feet wide. Staff recommends minor
modifications to the curb north of the drive-thru window to allow for more vehicle stacking. The
wider drive aisle can accommodate stacking for the drive-thru and a bypass for vehicles wanting
to exit the drive-thru queue.
GRADING AND DRAINAGE
The elevation on the site drops approximately 10 feet from the north to the south. The site
currently drains to the catch basin located at the low point on the southwest comer of the
property.
The applicant proposes to mass grade the site. Storm sewer will be installed within the parking
area and will discharge to an existing catch basin in Picha Avenue near the Target loading dock
access. Staff recommends that manhole 4A be shifted into the curb line and replaced with a
catch basin to capture additional runoff from the parking lot.
A rain garden feature is proposed on the east side of the building. The drain tile outlet for the
rain garden will connect to the existing storm sewer on the south. The applicant proposes to
install a manhole over the existing pipe to accommodate the connection.
The developer's contractor must contact the Engineering Department a minimum of two business
days prior to connecting to the public storm sewer.

The existing storm sewer infrastructure servicing the site was sized to accommodate fully
developed conditions. The storm sewer conveys runoff to the City owned and maintained pond
on the south side of the Target building.
The stairs on the northeast side of the building will accommodate the grade change along the
east-central portion of the site. The grade of the parking lot on the north side ofthe building is
approximately 7% to accommodate the grade differential.
Three retaining walls are proposed. A 170-foot long, 3.7-foot high (maximum) wall will be
constructed on the north side ofthe site. The second retaining wall will be approximately 85 feet
long, 3 feet high (maximum) and centrally located on the west side of the property. The third
retaining wall will be approximately 60 feet long, 2.8 feet high (maximum) and located in the
southwest portion of the property.
All retaining walls will encroach into the perimeter drainage and utility easements; therefore, an
encroachment agreement is required.
The developer must ensure that the "no build easements" noted on the Certificate of Survey will
allow for the construction of parking lots and retaining walls.
UTILITIES
Six-inch diameter sanitary sewer and water services were stubbed from the laterals within Kerber
Boulevard to serve the site. The sanitary sewer service is not deep enough to provide gravity
flow to the basement.
City trunk sanitary sewer and water hook-up fees and the MCES SAC fee are due with the
building permit. The 2008 rates are $4,799/unit for City water, $1, 769/unit for City sanitary
sewer and $1 ,900/unit for the MCES SAC. These fees are based on the number of SAC units as
determined by Met Council.
MISCELLANEOUS
The building is required to have automatic fire extinguishing systems. Building plans must be
prepared and signed by design professionals licensed in the State of Minnesota. Retaining walls
over four feet high must be designed by a professional engineer and a permit must be obtained
prior to construction. Detailed occupancy related requirements will be addressed when complete
building plans are submitted. The owner and/or their representative shall meet with the
Inspections Division as soon as possible to discuss plan review and permit procedures.

subject to the following conditions:
1. Wood chip mulch area will be extended in the northwest comer of the site. The proposed
turf area under the tree in the comer peninsula will be removed. If desired, a single strip of
sod may be placed along the curb line of the peninsula.
2. The building is required to have automatic fire extinguishing systems.
3. Building plans must be prepared and signed by design professionals licensed in the State of
Minnesota.

FINDINGS OF FACT
AND RECOMMENDATION

Application of Carver County for Site Plan Approval for a 13,260 square-foot, two-story
office building.
On April 15, 2008, the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of Carver County for a site plan review for the property
located at 7808 Kerber Boulevard. The Planning Commission conducted a public hearing on the
proposed site plan with variance which was preceded by published and mailed notice. The
Planning Commission heard testimony from all interested persons wishing to speak and now
makes the following:
FINDINGS OF FACT
1. The property is currently zoned Planned Unit Development, PUD.
2. The property is guided by the Land Use Plan for Commercial.
3. The legal description ofthe property is: Lot 2, Block 3, Burdick Park Addition, Carver
County, Minnesota.
4. Site Plan Findings:
a. Is consistent with the elements and objectives ofthe city's development guides, including
the comprehensive plan, official road mapping, and other plans that may be adopted;
b. Is consistent with the site plan division of the City Code;
c. Preserves the site in its natural state to the extent practicable by minimizing tree and soil
removal and designing grade changes to be in keeping with the general appearance of the
neighboring developed or developing or developing areas;
d. Creates a harmonious relationship of building and open space with natural site features
and with existing and future buildings having a visual relationship to the development;
e. Creates a functional and harmonious design for structures and site features, with special
attention to the following:
1
1) An internal sense of order for the buildings and use on the site and provision of a
desirable environment for occupants, visitors and general community;
2) The amount and location of open space and landscaping;
3) Materials, textures, colors and details of construction as an expression of the
design concept and the compatibility of the same with adjacent and neighboring
structures and uses; and
4) Vehicular and pedestrian circulation, including walkways, interior drives and
parking in terms of location and number of access points to the public streets,
width of interior drives and access points, general interior circulation, separation
of pedestrian and vehicular traffic and arrangement and amount of parking.
f. Protects adjacent and neighboring properties through reasonable provision for surface
water drainage, sound and sight buffers, preservation of views, light and air and those
aspects of design not adequately covered by other regulations which may have substantial
effects on neighboring land uses.

RECOMMENDATION
The Planning Commission recommends that the City Council approve the site plan.

April 3, 2008, the duly qualified and acting Deputy Clerk of the City ofChanhassen, Minnesota;
that on said date she caused to be mailed a copy of the attached notice of Public Hearing for
Carver County Service Center - Planning Case 2008-09 to the persons named on attached
Exhibit "A", by enclosing a copy of said notice in an envelope addressed to such owner, and
depositing the envelopes addressed to all such owners in the United States mail with postage
fully prepaid thereon; that the names and addresses of such owners were those appearing as such
by the records of the County Treasurer, Carver County, Minnesota, and by other appropriate
records.

The purpose of this public hearing is to inform you about the
applicant's request and to obtain input from the neighborhood
about this project. During the meeting, the Chair will lead the

at the Meeting: 1. Staff will give an overview of the proposed project.
2. The applicant will present plans on the project.
3. Comments are received from the public.
4. Public hearing is closed and the Commission discusses
the ro' ect.

City Review Procedure:
. Subdivisions. Planned Unit Developments, Site Plan Reviews, Conditional and Interim Uses. Wetland Alterations.
Rezonings. Comprehensive Plan Amendments and Code Amendments require a public hearing before the
Planning Commission. City ordinances require all property within 500 feet of the subject site to be notified of the
application in writing. Any interested party is invited to attend the meeting.
. Staff prepares a report on the subject application that includes all pertinent information and a recommendation.
These reports are available by request. At the Planning Commission meeting, staff will give a verbal overview of
the report and a recommendation. The item will be opened for the publiC to speak about the proposal as a part of
the hearing process. The Commission will close the publiC hearing and discuss the item and make a
recommendation to the City Council. The City Council may reverse, affirm or modify wholly or partly the Planning
Commission's recommendation. Rezonings. land use and code amendments take a simple majority vote of the
City Council except rezonings and land use amendments from residential to commercial/industrial.
. Minnesota State Statute 519.99 requires all applications to be processed within 60 days unless the applicant
waives this standard. Some applications due to their complexity may take several months to complete. Any
person wishing to follow an item through the process should check with the Planning Department regarding its
status and scheduling for the City Council meeting.
. A neighborhood spokesperson/representative is encouraged to provide a contact for the city. Often developers
are encouraged to meet with the neighborhood regarding their proposal. Staff is also available to review the
project with any interested person(s).
. Because the Planning Commission holds the public hearing, the City Council does not. Minutes are taken and
any correspondence regarding the application will be included in the report to the City Council. If you wish to have
somethin to be included in the re ort. lease contact the Plannin Staff erson named on the notification.
