Staff requests the City Council consider a resolution adopting the 2008 Street Improvement
Project assessment roll.

ASSESSMENT HEARING PROCEDURE
Staff will provide a brief explanation of the work along with the proposed assessment
amount. Any issues that the City Council wishes to discuss regarding the project financing is
appropriate during the public hearing portion of the project. Public testimony should be
received for the project. The property owners should be reminded that if they wish, they
must file a written objection with the City either prior to or during the actual project hearings.
Objections after the public hearing are invalid.
The assessment objection is a request by the property owner for the Council to review the
assessment amount. Staff may have an immediate response to individual comments, or in
some circumstances, the objection should be received and referred to staff for investigation.
The remaining assessment roll should be adopted. If the City Council feels the objections
cannot be addressed immediately, a report will be presented to Council on all objections on
that particular project at the next City Council meeting. Council should adopt the remaining
assessment roll at that time in order for the process to stay on schedule. If there are no
objections filed, or if Council feels confident staffs investigation will not result in any
changes being made to the assessment roll, a motion by the City Council adopting the
assessment roll as prepared is needed for the project.
ASSESSMENT OBJECTIONS
Objections may be filed up to and at the public hearing. At the time of this submittal, no
written objections have been received. If any written objections are received in the interim
prior to the Council meeting, they will be provided to the Council at the public hearing. Staff
comments and recommendations will also be provided at the public hearing. The City
Council may choose to adopt staff's recommendation or revise the assessment roll. If
additional objections are filed either prior to or at the hearing, they should be received and if
necessary referred to staff for investigation and resolution.
SUMMARY OF ASSESSMENT PROJECT
Public Improvements
The City's Pavement Management Program recommends that streets in the Laredo Drive area
be reconstructed. The City receives the most complaints about the condition of Laredo Drive
from residents and the traveling public than any other street in the system. The public
utilities in the area are old, have had many problems and should be replaced or repaired.
Approximately 1.35 miles of streets are proposed to be reconstructed. The area for
improvements include: Laredo Drive, Laredo Lane, Longview Circle, Cimarron Circle and
Highland Drive (west of Laredo Drive).
All the streets are proposed to be reconstructed approximately the same width as the existing
streets. Laredo Drive between West 78th Street and Saratoga Drive is proposed to be built to
a 36-foot wide urban street section. Laredo Drive from Saratoga Drive to Frontier Trail is
proposed to be 31' wide. The side streets are proposed be built to a 28' wide roadway.
The streets are proposed to be urbanized and reconstructed with concrete curb and gutter.
Most streets currently have bituminous curb or concrete curb and gutter. Replacement of the
existing sidewalk panels is included in the project. No additional sidewalk or trail

improvements are included in the project at this time. No street light improvements are
included in the project.
Staff received some comments from a property owner who thought the pavement section
proposed for the project is over designed. A geotechnical report was drafted by a Braun
Intertec on December 21, 2007, which recommended a pavement section less than the
standard City pavement section used typically on new residential roadways. Staff used this
recommendation and refined the design to additionally save on the pavement section cost.
The City has incorporated site line improvements of the Laredo LaneILaredo Drive
intersection. The improvement includes slightly straightening Laredo Drive at the
intersection to improve the sight line and removing trees in the boulevard.
The reconstruction project will include the improvement or replacement of most public
utilities within the reconstruction project area. The watermain in this area is mainly cast iron
pipe which has experienced numerous breaks over the past few years. It is proposed to
replace all the watermain with PVC watermain pipe. Water service pipes and curb stop boxes
are proposed to be replaced.
The sanitary sewer service has been televised and approximately 1000' of sanitary sewer pipe
is proposed to be replaced. Also, several sanitary service pipes to residential properties have
been identified as needing replacement. Most of the pipes proposed to be replaced are clay
pipe that have off-set joints, cracks or groundwater infiltration problems. By replacing this
pipe, it is anticipated that the City will see a reduction of inflow/infiltration (1&1). This
reduction will be quantified and included in the City's MCES 1&1 surcharge reduction plan
for credits. Along with the sanitary sewer pipe, sanitary sewer services will be replaced to
the right-of-way line at sewer mainline replacement areas.
The project includes replacement and installation of additional storm sewer within the streets.
Three environmental manholes are proposed in the project area to help treat the runoff prior
to discharging into adjacent water bodies. Over 9,000 feet of draintile is included in various
areas along the street to pick up residential sump pump water discharge and reduce the
amount of groundwater in the street subgrade. Reducing the amount of groundwater in
subsoils should increases the pavement strength. The Watershed District may embark on a
raingarden program in this area in the future with property owner participation and City
approval. The contractor to who makes these improvements should be able to connect to the
draintile system to redirect the water. Staff will need to work with the Watershed District in
the future on any potential infiltration areas in the City right-of-way.
A storm water pond is proposed in Kerber Pond Park to treat run off from Longview Circle
and some of the run off from Laredo Drive and Saratoga Drive. Staff has discussed this
project with the adjacent property owners and Park Commission. An area in Kerber Park
Pond has been identified that does not need much grading work to construct a pond.
Additionally, the area adjacent to the trail extending from Laredo Drive to Kerber Pond Park
is proposed as an infiltration/filtration area. These storm water improvements were bid out as
an alternate to the base bid. Additional ponding areas off the project site have been identified
for additional water quality improvements. Staff is working with the residents in the area and
the Watershed District to try to make these improvements in the near future.

Project Costs and Assessments
Staff is proposing a different assessment
calculation then what was identified in the
feasibility study. Many residents were
concerned about having an assessment
calculation which combined both the residential
and non-residential properties. Staff is
proposing to split the assessment calculation for
the residential properties north of Saratoga
Drive so only these costs are used in the
assessment calculation.
The drawing to the right shows the streets that
are included in the residential assessment
calculation. The residential properties on
Laredo Drive south of 76th Street are also
proposed the same assessment as the residential
properties north of Saratoga Drive.

The assessments for the non-residential properties south of Saratoga Drive are proposed to
use the same assessment methodology as was detailed in the feasibility study but with only
the street cost of Laredo Drive south of Saratoga Drive included in the calculation. The
oversizing cost of Laredo Drive from Saratoga Drive to West 78th street from 31' to 36' is
proposed to be a City cost. The oversizing cost for this work using the bid prices is $90,574.
Per the City assessment practice, forty percent (40%) of the street costs are proposed to be
assessed to the benefiting property owners; the City will be responsible for the remaining
60%. One hundred percent (l 00%) of the utility costs will be paid for by the respective
enterprise funds. The Laredo Drive oversizing between West 78th Street and Saratoga Drive
as not included in the residential or non-residential assessment calculations but again is
proposed to be paid for by the City.
There are 80 residential and 6 commercial properties proposed to be assessed for the street
improvements. At the public hearing for this project, the biggest concern about the project
was the assessment costs and combining the assessment methodology of the residential
properties with the commercial properties. Staff feels we have addressed this concern with
separating the residential assessment calculations with the non-residential calculations.
The total project cost including all construction, engineering, soil borings, legal costs etc. is
$2,842,940. The total assessment proposed for residential and non-residential properties is
$610,770.54. The City is paying for 79% of the project if utility costs are included.
The proposed assessment for residential properties is $5,934.80/lot. The preliminary
assessment estimate was $7,075.00/lot. The City is proposed to pay for the all the utility
improvements and street over sizing cost. The terms of the assessments are 6% over lO
years.

Attached are three traffic studies we took on Laredo Drive. They are from three different intersections,
taken on a weekday in the afternoon at IS-minute intervals when school was in session:
1) Laredo Dr. & Chan View Ave. (vicinity of the Post Office),
2) North entrance to Chan Elementary near intersection with West 76th Str.,
3) Laredo Dr. & Frontier Tr. (the Laredo Dr. cul-de-sac is just north of this intersection).

Conclusions:
. Traffic on Laredo Drive increases as you get closer to the south end (West 78th Street).
It is logical to expect denser traffic in the south portion (i.e., the comer of Laredo and Chan View
Ave.) because that includes traffic to the Post Office, City Hall, the Fire Station, the school and
other traffic on Laredo north of the school.
Traffic on Laredo is much higher than an average residential street. It should be categorized as a
collector street (at least the south portion). The city acknowledges this because the south portion
from W. 78th to Saratoga Drive is proposed to be the 36' width of a collector street.
A collector street as defmed in city code is "a street that carries traffic from minor streets to arterial
* streets" .

sample of afternoon traffic excluded commuters who return home after 5 p.m. Assuming morning traffic is 10%
greater than afternoon traffic, the total traffic for a 5Y2-hour period would be about 1650 vehicles. Adding in the
balance for the other 19Y2 hours, there would be at least 3200 vehicles per day. Weekend traffic would remain
high because of vehicles accessing the Post Office (utilizing postal services and pick up mail from 1050 active
P.O. boxes), and Saturday sports activities at the school.
Figure 2: (North entrance to Chan Elementary near W. 76th Str.) Much of this traffic continues north to Saratoga
Dr. and Frontier Tr.. In November the city had a traffic counter at the north entrance to Chan Elementary that
counted only half the traffic entering the school because there are two north entrances. The city has not
provided us with that traffic data.
Figure 3 (intersection of Laredo and Frontier) shows an expected lower traffic count with a peak at 3:45 p.m.
and another through 5:15 p.m.
The Staff Memo of January 28, 2008, shows 1450 vehicles per day south of Chan View Ave. This is well under
my estimate of 3200 per day. My count included traffic that did not cross the city counter just south of the
intersection of Chan View and Laredo.

Yes, we agree Laredo Dr. needs repair. But we maintain the current assessment method will
result in the School, Apartment and Kerber Pond Park not being assessed a fair share of
reconstruction cost.
SchooVCity Center Park: We believe it is illogical to base the School assessment on only one-
third of the 15 acres owned by the School. Since the School has verbally agreed to share the
western two-thirds of the parcel (City Center Park) with the City, the City should share an
assessment with the School. How can the City say the other two-thirds of the parcel will be
assessed when Kerber Dr. is improved? There is no access to the property from Kerber Dr. If
all 15 acres were included in the Benefiting Lot Area the additional assessment would be about
$119,900.
Response: City Center Park accesses Kerber Boulevard via the western parking lot 0/ City
Hall. Staff/eels the proposed assessment amount is the amount the school benefits/rom the
street project.
Our Response to City: Doesn't City Center Park benefit since it shares usage with the
School? City Center Park has tennis courts that utilize the School parking lot off Laredo Dr. on
the north side of the school.
Apartment: We question the city opinion that one-half of this parse I is a wetland that should
not be assessed. What kind of wetland is it, a shallow marsh? Do you maintain that 50% of the
parcel is wetland? If the south part of the property is a wetland, why is there a fire hydrant in the
middle of this area? If all the Apartment property were assessed, their additional assessment
would be about $25,500.
Response: The wetland is classified as a Type 1 wooded marsh. The 50% developable area
was an estimate- during the growing season the wetland can be delineated. Once the
delineation is complete, the appropriate buffer and setbacks will be added to the wetland area
to determine the developable area o/the property. The apartment also has an additional
access off Saratoga Drive that needed to be considered in the assessment methodology.
OUf Response to City: Unanswered question: Why is there a fire hydrant in the middle of this
"wetland"? Figure 10, National Wetlands Inventory, Surface Water Mgt Plan Update (28 Aug

2006) shows this area of the Apartment property as a "shallow marsh", and shows it
encompassing half of the Apartment parking lot, and unrealistically extending into the City
ballparks in the property west of the apt parcel. See Attachment.
$25,500 and $119,900 = $145,400 divided by 80 residential properties equals a reduction of
about $1820 per residential property.
Kerber Pond Park: You stated this 32-acre City property (with frontage on Laredo Dr.) should
not be assessed because there is no vehicle access or parking on this property (even though the
entrance signs state vehicles are permitted during park hours ). You also stated the City has not
assessed Outlots that do not benefit from a street improvement project. The Park consists of five
parcels. Less than one-half of the total acreage is categorized as an Outlot. Do you maintain that
this property would be assessed when Kerber Dr. is improved (the same as the school)? The
assessment for this property would be about $27,000.
Response: The entrance sign at the park is a generic sign that is used in parks throughout the
City- there is no public vehicle access or parking in this park. Parcels that do not benefitfrom
a street project are not assessed. The park would not be assessed for a project on Kerber
Boulevardfor the same reasons it is not being assessedfor the Laredo project- the park does
not have vehicular access to the street. If a parking lot was in Kerber Park Pond the park
would be assessed.
Our Response to City: This park has "on street" parking, and the City benefits the same as .
any park.
The bottom line is that some non-residential properties (Bank, Retail, P.O.) are being assessed on
the basis of their property area. But the School, Apartment and Kerber Pond Park, are not being
assessed with the same criteria. When non-residential properties are not assessed for their total
area, residential properties are unfairly forced to pay a higher share of the project. This applies
to the current assessment, and also on all future taxes because property values can be increased
by the cost of the assessment.
Response: The assessments proposed are consistent with the last two street reconstruction
projects the City has completed. I maintain the assessment policy has been followed as best
and consistently as possible even with non-residential and residential properties in the project.
The Laredo Drive in the non-residential area are oversized and the over sizing is not proposed
to be assessed back to the benefiting residential property owners.
