CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DATE: August 28, 1989 RESOLUTION NO: 89-95 MOTION BY: Johnson Dimler SECONDED BY: A RESOLUTION PETITIONING THE CO~~lISSIONER OF THE MINNESOTA DEPARTMENT OF TRANSPORTATION TO CONDUCT A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC GRADE CROSSINGS SHOULD BE ESTABLISHED ON TRUNK HIGHWAY 101 AND THE WEST 78TH STREET FRONTAGE ROAD WHICH WOULD TRAVERSE THE RIGHT-OF-WAY AND TRACK OF THE SOO LINE RAILROAD COMPANY IN CHANHASSEN, MINNESOTA WHEREAS, a critical element of the Downtown Redevelopment Plan was the relocation of Trunk Highway 101 from the current downtown corridor to Dakota Avenue. As a result of meetings with the public, City staff and MnDOT, it was concluded that the Dakota Avenue route was the best alternative; and WHEREAS, the Land Use/Transportation Study commissioned by the City dated August 1, 1986 and the subsequent Broadened Study Area Plan recognized a need for a railroad crossing if Trunk Highway 101 was relocated to Dakota Avenue; and WHEREAS, the Dakota Avenue realignment and crossing is the alternative deemed most acceptable by MnDOT; and WHEREAS, a Feasibility Study was conducted for the project, and the City has concluded the improvements are feasible; and WHEREAS, the construction of the roadways and railroad grade crossings are programmed for 1991 construction season; and WHEREAS, the Soo Line Railroad Company has objected to the installations for reasons of cost and liability, and negotiations to date have been inconclusive; and WHEREAS, the Feasibility Study included the capital improve- ment costs for construction of the grade crossings. NOW, THEREFORE, BE IT RESOLVED by the Chanhassen City Council as follows: 1. The City hereby requests that the Commissioner of the Minnesota Department of Transportation conduct a public hearing to determine whether public grade crossings should be established on Trunk Highway 101 and the West 78th Street frontage road which would traverse the right-of-way and track of the Soo Line Railroad Company in Chanhassen, Minnesota. 2.
