SUBJ: Lyman Boulevard Project 06-03: Approve Purchase Agreement for a Portion of the Holasek Property PROPOSED MOTION "The City Council approves a Purchase Agreement for a portion of the Holasek Property" City Council approval requires a simple majority present. City Council BACKGROUND At the November 13, 2007 Council work Boulevard roadway agreement with Council Lyman Boulevard for Phase 1. On December 10, 2007, Council approved Lyman Boulevard improvements. On January 28, 2008, the Council Boulevard for the Phase 1 area. At the February 25, 2008 Council work session, Boulevard Plans with Council. At the Apri128, 2008.Council work Lyman Boulevard plans with Council. On May 12,2008 Council approved plans and On May 20, 2008, staff held an'open house meeting Recreational Center. On May 27,2008 Council project. Todd Gerhardt Lyman Boulevard: Approve Purchase Agreement June 9, 2008 Page 2 DISCUSSION Council is requested to approve the attached land purchase agreement for Lyman Boulevard. The master agreement Council approved in December 2007 states the City is responsible for acquiring the right-of-way necessary to facilitate the construction of the roadway. The City of Chanhassen is responsible for 40.29%, Carver County 40.29%, and City of Chaska 19.41 % of the project costs west of the rail road tracks including the right-of-way. Carver County identified the amount of right-of-way necessary for the project and completed a roadway plat identifying the permanent, temporary right-of-way and drainage and utility easement. City staff used this information and worked with the City's attorney's office to obtain an appraisal for the land. Over the last several months, staff has been discussing the project with the property owner. The property owner requested several items be added to the project. They include a signal at the intersection of Galpin Boulevard and Lyman Boulevard, a right turn lane on westbound Lyman Boulevard to the private property, and sewer and water service stubbed to the property. The settlement agreement stipulates the turn lane and sewer and water stubs are 100% paid for by the property owner. The signal is 25% paid for by the property owner since the south leg of the intersection is a private drive. The City will pay for the land acquisition at this time but will invoice Carver County for the County and the City of Chaska share, including attorney's fees and appraisal costs. Chanhassen is responsible for $160,354.20 of the right-of-way cost ($398,000) for this property. The other items paid for by the property owner will be deducted from the project costs. The contractor for the Lyman Boulevard improvements is responsible for repairing any damaged draintile that may occur during construction. Staff is still working with the property owner south of Lyman Boulevard between Audubon south and north to obtain the necessary right-of-way. The amount payable to Holasek under Paragraph 1 herein shall be reduced by the amount of $144,600.00, which constitutes payment for the following: (a) the cost of installing the right tumlane at Lyman and Galpin, including administrative, engineering and design costs; (b) one-fourth (1/4) of the cost ofinstalling the Lyman and Galpin signal system, including administrative, engineering and design costs; and (c) the cost of installing sanitary sewer and water stubs to the Holasek property, including administrative, engineering and design costs. 3. In addition to the cash payment to Holasek, the City agrees to the following additional items: (a) City will repair or replace any tile lines impacted by the construction of the pond; and (b) Assuming it is feasible from an engineering standpoint and does not adversely impact the public system, as determined in the sole discretion of the City Engineer, City will allow Holasek, at her cost, to expand or oversize the pond being constructed as part of this project to accommodate additional ponding required by development of the Holasek property. 4. The cash payment to Holasek shall be made within ten (10) days after execution by Holasek and City Council approval of this Stipulation. 5. Upon payment of the amounts due hereunder, the City may file its Final Certificate, a copy of which is attached hereto as Exhibit A, and upon filing said Final Certificate these proceedings shall be concluded. 138329vl 2 agreement.
