CC SUM 2008 05 27 CHANHASSEN CITY COUNCIL REGULAR MEETING SUMMARY MINUTES MAY 27, 2008 Mayor Furlong called the meeting to order at 7:10 p.m. The meeting was opened with the Pledge to the Flag. COUNCIL MEMBERS PRESENT: Mayor Furlong, Councilman Litsey, Councilwoman Ernst, Councilwoman Tjornhom, and Councilman McDonald STAFF PRESENT: Todd Gerhardt, Elliott Knetsch, Laurie Hokkanen, Paul Oehme, Kate Aanenson, Todd Hoffman and Terry Jeffery PUBLIC ANNOUNCEMENTS: None. CONSENT AGENDA:Councilman Litsey moved, Councilwoman Ernst seconded to approve the following consent agenda items pursuant to the City Manager’s recommendations: a. Approval of Minutes: -City Council Work Session Minutes dated May 12, 2008 -City Council Verbatim and Summary Minutes dated May 12, 2008 Receive Commission Minutes: -Park and Recreation Commission Summary Minutes dated April 22, 2008 b. Accept $750 Donation from Minnetonka Lacrosse for Field Usage. c. Lyman Boulevard Improvement Project: 1) Approval of Wetland Alteration Permit, Planning Case 08-12. Resolution #2008-37: 2) Award of Bid, Improvement Project 06-03. Resolution #2008-38: d. Lifetime Fitness, Project 04-15: Accept Public Improvements. All voted in favor and the motion carried unanimously with a vote of 5 to 0. VISITOR PRESENTATIONS: Tommy Scanlon, speaking on behalf of his father who owns the Chanhassen Dinner Theater, addressed the issue of his displeasure with language that was inserted into a legislative tax bill that covered the Mall of America essentially targeting the dinner theater and knocking them out of that bill. He asked City Council to direct staff members, or anybody speaking for Chanhassen, to quit implying that the dinner theater is receiving and being lured by a subsidy. He invited council members to visit the Chanhassen Dinner Theater to learn personally what obstacles they have to staying in Chanhassen. City Council Summary - May 27, 2008 LAW ENFORCEMENT/FIRE DEPARTMENT UPDATE. Sergeant Peter Anderley reminded everybody with the warm weather to secure their valuables and watch for children playing. He reviewed curfew times for the different age groups, noting that the sheriff’s department will be working on enforcement of the curfew over the summer. Councilman Litsey asked about the work load of the new investigator. Councilwoman Ernst asked about the status of open cases that were outstanding before the investigator started. Chief Gregg Geske reviewed the numbers from the fire department for the previous month. Mayor Furlong asked how the department handles calls during holiday weekends when people are out of town. PUBLIC HEARING: STORMWATER POLLUTION PREVENTION PROGRAM (NPDES), PHASE II MS4 PERMIT. Terry Jeffery discussed the MS4 permit and specifically the 2007 Annual Report before asking the council to open the meeting for public comment. Councilwoman Tjornhom asked about the success of the rain gardens that have been installed. Mayor Furlong opened the public hearing. No one spoke and the public hearing was closed. Councilman McDonald moved, Councilwoman Ernst seconded that the Chanhassen City Council authorize the mayor to sign the City’s National Pollution Discharge Elimination System (NPDES) Phase II Annual Report, as attached, and authorize the distribution of the Annual Report to the Minnesota Pollution Control Agency. All voted in favor and the motion carried unanimously with a vote of 5 to 0. CONSIDER APPROVAL OF RESOLUTION AUTHORIZING SUBMITTAL OF THE 2030 COMPREHENSIVE PLAN TO THE METROPOLITAN COUNCIL. Kate Aanenson explained the approval process for the first reading of the 2030 comprehensive plan. Councilman McDonald, along with the rest of the council, thanked Kate Aanenson and the planning staff for making a very complex and complicated document such an easy process to understand and work through. Councilman Litsey moved, Councilman McDonald seconded that the City Council approves the first reading of the 2030 comprehensive plan and authorizes submittal to the Metropolitan Council for review pursuant to Minnesota Statutes 473.175, 473.851, 473.866. All voted in favor and the motion carried unanimously with a vote of 5 to 0. COUNCIL PRESENTATIONS: The council members discussed the ground breaking ceremony for the construction of the Veteran’s Monument. ADMINISTRATIVE PRESENTATIONS: Todd Gerhardt thanked Mayor Furlong for his participation in the State of the City Address to the Chamber of Commerce, breakfast with the seniors the following week, and an update on the well construction. CORRESPONDENCE DISCUSSION. None. 2 City Council Summary - May 27, 2008 Councilwoman Ernst moved, Councilman McDonald seconded to adjourn the meeting.
