Extract of Minutes of Meeting of the City Council of the City of Chanhassen, Carver and Hennepin Counties, Minnesota Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Chanhassen,Carver and Hennepin Counties, Minnesota, was held at the.. City Hall in said City on Monday, January 25, 1988, com- mencing at 7: 30 o'clock p.m. The following members were present: Mayor Hamil ton, Coune ilmembers Horn, Geving, Boyt and Johnson. and the following were absent: None * * * * * * * * * The following resolution was presented by Councilmember Hamil ton who moved its adoption: RESOLUTION NO. 88-09 RESOLUTION DETERMINING THE NECESSITY FOR THE ISSUANCE OF GENERAL OBLIGATION BONDS AND CALLING A SPECIAL ELECTION THEREON BE IT RESOLVED by the City Council of Chanhassen, Carver and Hennepin Counties, Minnesota (City) as follows: 1. The City Council hereby finds and determines: a) The City Council has investigated the facts and that it is in the best financial interests of the City and the welfare of its residents that (i) the City acquire new fire fighting facilities consist- ing of an addition to the central fire station and a fire truck to be housed therein, at a cost of not to exceed $1,400,000; (ii) the City construct and equip a multipurpose community center building at a cost not to exceed $2,600,000; (iii) the City make improvements to land owned by the City adjacent to Lake Ann Park for park purposes,at a cost not to exceed $300,000; . ' < e (iv) the City construct a multipurpose trail system as part of the City recreation program, at a cost not to exceed $800,000; and (v) the City acquire real property in the City for use as parks and parklands as part of the City's recrea- tional program at a cost not to exceed $300,000. The items described above are collectively called the p'rojects and their description and the proposed financing thereof represents the City Council's determination of the need for and its method of financing the Projects as part of the City's capital improvement program for the ensuing five year period. b) The City is authorized by the provisions of Minnesota Statutes Chapter 475 (Act) to issue its bonds or other obligations to finance the Projects in whole or in part and to pledge its full faith, credit and taxing powers to the payment of such obligations; c) It is necessary and expedient to the sound financial manage- ment of the affairs of the City that the Projects be fi- nanced in whole or in part by the issuance and sale of the City's general obligation bonds pursuant to the Act in the amounts and for the purposes specified in clause a) above. e 2. The questions for the issuance of the bonds shall be submitted to the voters of the City at a special election to be held on Wednesday, February 24, 1988. The election shall be held and conducted in accordance with the laws of the State of Minnesota relating to special municipal elections. 3. The City Manager shall cause a notice of election in substantial- ly the form attached hereto as Exhibit A to be posted and published as re- quired by law as follows: .. (a) The notice of election shall be published once in the official newspaper of the City at least two weeks prior to the election; (b) The notice of election and a sample ballot shall be posted at each of the polling places at least ten days prior to the election; (c) The notice of election and a sample ballot shall be posted in the office of the City Manager at least four days prior to the election; and e (d) The sample ballot shall be published in the official newspaper at least one week prior to the election. . . e 4. The polling places and the respective judges for the election are set forth on Exhibit B. The polls shall be open from 7:00 a.m. until 8:00 p.m. 5. QUESTION 4: SHALL THE CITY OF CHANHASSEN ISSUE AND SELL ITS GENERAL OBLIGATION BONDS IN AN AMOUNT NOT TO EXCEED $800,000 FOR THE CONSTRUCTION OF A MULTIPURPOSE TRAIL SYSTEM IN THE CITY? YES NO J INSTRUCTIONS TO VOTERS: Voters desiring to vote in favor of the foregoing question shall make a cross mark (X) in the square opposite the words YES. Voters desiring to vote against the foregoing question shall place a cross mark (X) opposite the word NO. QUESTION 5: SHALL THE CITY OF CHANHASSEN ISSUE AND SELL ITS GENERAL OBLIGATION BONDS IN AN AMOUNT NOT TO EXCEED $300,000 FOR THE ACQUISITION OF PARKLANDS IN THE CITY? It is determined that the use of paper ballots for the special election is in the best interests of the economical and efficient conduct of the election. 7. The City Council shall meet in the City Hall on February 25, , 1988, at 6:15 o'clock p.m., C.T. to canvass the results of the election and to declare the results thereof. The motion, for the adoption of the foregoing resolution was duly seconded by Councilmember Geving , and upon vote being taken there- on, the following voted in favor thereof: Hamil ton, Horn, Geving, and Johnson. and the following voted against the same: Boyt whereupon said resolution was declared duly passed and adopted.
