88-48 ~ ~ CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA e DATE: May 31, 1988 RESOLUTION NO: 88-48 MOTION BY: Hamilton SECONDED BY: Geving A RESOLUTION VACATING A PORTION OF 64TH STREET IN THE PLAT OF SEVEN FORTY ONE CROSSING WHEREAS, a petition was received for the vacation of a portion of 64th Street {Bardwell Road} in the Plat of Seven Forty One Crossing legally described as follows: That part of 64th Street, originally dedicated as Bardwell Road in the plat of Bardwell Acres, Lake Minnetonka and now vacated which lies easterly of the southerly extension east line of the west 258.40 feet of Lot H in said plat and lying northwesterly of the northwesterly right-of-way line of State Highway No. 41. Also, vacation of the right-of-way easements along Bardwell Road as follows: e The 9.00 foot public right-of-way easement over and across that part of Lot H, Bardwell Acres, Lake Minnetonka, according to the recorded plat thereof which lies east of the west 258.40 feet of said Lot H as dedicated in Book 109 of Deeds, Page 490. The 9.00 foot pulbic right-of-way easement over and across that part of Lot F, Bardwell Acres, Lake Minnetonka, according to the recorded plat thereof which lies west of the northwesterly right-of-way line of State Highway No. 41 as dedicated in Book 109 of Deeds, Page 485. WHEREAS, a public hearing was held on said petition on May 31, 1988; and WHEREAS, said public hearing was preceded by two weeks' published and posted notice as required by Section 412.851 of Minnesota Statutes; and WHEREAS, there is no public interest to be served by the continued public ownership of that portion of the above described right-of-way. NOW, THEREFORE, BE IT RESOLVED, that any and all of that the above described roadway easement is hereby vacated subject to retaining a 20 foot drainage and utility easement in the afore- mentioned lots.
