88-138 e e e CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, t-UNNESOTA DATE: December 12, 1988 RESOLUTION NO: 88-138 t-10TION BY: Johnson SECONDED BY: Hamilton A RESOLUTION ACCEPTING SUPPLEMENTAL REPORT NO. 1 AND AUTHORIZE PREPARATION OF PLANS AND SPECIFICATIONS FOR PHASE I OF THE TH 101/LAKE DRIVE IMPROVEMENT PROJECT 88-22 WHEREAS, on November 28, 1988, the City Council accepted the feasibility study for the TH 101/Lake Drive improvement project. A public hearing was also scheduled for December 12, 1988. Since the acceptance of the feasibility study, staff felt it was necessary to prepare a supplemental report to look at assessments and phasing of the project. NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby accepts the Supplemental Report No. 1 to the feasiblity study as prepared by BRW, Inc., and dated December, 1988: and that plans and specifications for Phase I of the pro- ject be prepared by BRW, Inc. Separate construction document packages will be prepared for the north leg of the TH 101 improve- ments and for the south leg TH 101 and Lake Drive Improvements. BE IT FURTHER RESOLVED that the City Attorney is hereby authorized and directed to acquire the property described on the attached exhibit (a portion of the Ward property) by eminent domain proceedings, including the quick-take provisions of Minnesota Statutes, Chapter 117, unless acquired by negotiation or otherwise before the proceedings are complete.
