RESOLUTION PURSUANT TO
INDIVIDUAL SEWAGE TREATMENT SYSTEM ORDINANCE
WHEREAS, the City of Chanhassen Individual Sewage
Treatment System Ordinance, Ordinance No. 10-B regulates the
installation, repair, and maintenance of individual sewage treat-
ment systems, and
WHEREAS, said Ordinance stated that by resolution the
City Council shall establish certain permit fees, license fees,
minimum qualifications for certain licensees; and
WHEREAS, said Ordinance adopts the Minnesota Rules
Chapter 7080 regarding Individual Sewage Treatment System
Standards; and
WHEREAS, the State of Minnesota has established an
Individual Sewage Treatment System Advisory Committee to review
and evaluate proper design guidelines contained in Minnesota
Rules Chapter 7080.
NOW THEREFORE, BE IT RESOLVED, that the Chanhassen City
Council hereby adopts the following license fee schedule pursuant
to said Ordinance No. 10-B:

Any person seeking to acquire a Chanhassen license must
pay the above license fee, however, a person meeting the primary
qualifications shall not be required to have a separate city license.
The license year shall run from April 1 to March 31.
The license fee shall not be refunded in the event of denial,
surrender, or revocation of a license.
D. Three Year System Cleaning Administration Fee
A charge of $30 is required every three years to process
the documentation verifying the cleaning of an
individual sewage treatment system as provided under
Section 5.01 of Ordinance 10-B.
BE IT FURTHER RESOLVED, that the following license
application requirements pursuant to Ordinance 10-B are hereby
established.
A.
Installer License:
1.
Primary Qualifications:
Proof of issuance of a valid Carver County Installer
License under Carver County Ordinance 21, as amended;
and
2.
A satisfactory record of Compliance (where applicable)
with Chanhassen Ordinance 10-B; and
3 .
Filing of a $2,000.00 performance bond with the City
Inspector.
B.
Pumper License:
1.
Primary Qualifications:
Proof of issuance of a valid Carver County Pumper License
under Carver County Ordinance 21, as amended; and
2.
A satisfactory record of compliance (where applicable)
with Chanhassen Ordinance 10-B; and
3.
Filing of a $2,000.00 performance bond with the City
Inspector.

Site Evaluator License:
Primary Qualifications:
1.
Proof of issuance of a valid Carver County Percolation
Tester/Site Evaluator License under Carver County
Ordinance 21, as amended; and
2. Filing of a $2,000.00 performance bond with the City
Inspector; and
3. A satisfactory record of compliance (where applicable)
with Chanhassen Ordinance 10-B.
D.
Designer License:
Primary Qualifications:
1. Proof of issuance of a valid Carver County Designer
License under Carver County Ordinance 21, as amended;
and
2. A satisfactory record of compliance (where applicable)
with Chanhassen Ordinance 10-B; and
3. Filing of $2,000.00 performance bond or certificate of
errors and omissions insurance with the City Inspector.
In the case of any licensee who was issued a Chanhassen
license under the primary qualifications requirements of this
resolution, the City of Chanhassen license of said licensee shall
be subject to the same restrictions and limitations which were
imposed on his Carver County' License.
BE IT FURTHER RESOLVED that the Chanhassen City Council
hereby adopts the Individual Sewage Treatment System Advisory
Committee's proposed and subsequent changes to the Minnesota
Rules Chapter 7080 as presented in Exhibit A to act as design
review guidelines for proper installation of septic systems.
Passed and adopted by the City Council of the City of
Chanhassen, this 26th day of January , 1987.

PROPOSED CHANGES FOR MINNESOTA RULES CHAPTER 7080
Adopted by ISTS Advisory Committee
Note: Numbers in parenthesis refer to 6 MCAR 4.8040
The following changes have been proposed by the ISTS Advisory Committee
for purpo~es of accuracy, improving clarity, and because of recent technical
advances. These changes will be recommended as proposed by the ISTS Advisory
Committee to the Minnesota Pollution Control Agency Board. The proposed changes
will not officially be part of Minnesota Chapter 7080 until after being
presented at public hearings throughout Minnesota and being adopted by the MPCA
Board of Directors.
The proposed change for 7080.0020, Subp. 17, page 5691 (B.16. on page 4) is:
Subp. 17. ~~~~ ~~~&% Drainfield ~ Clean rock, crushed igneous
rock'or similar insoluble, durable and decay-resistant material ~ ~ ~
~ ~ ~ percent ~ wei~ht of dust, sand, silt, or clay. The size shall
range from three-fourths inch to two and one-half inches.
Reason: The trench rock of three-fourths inch size or greater cannot possibly
perform any filtration function on septic tank effluent. The fact that trench
rock is called "filter material" has lead to many misunderstandings and
misconceptions by sanitary engineers who are familiar with the operation of a
trickling filter. The primary purpose of the trench rock is to distribute
effluent over the soil surface. It simply does not perform any filtration
function. The words "filter material" appear numerous times in Chapter 7080 and
all of the references to filter material will also need to be changed.
The words "free from" mean that absolutey no material can be in the trench rock.
Thus, if someone rigorously applied this definition, practically all of the rock
presently available could be declared improper. The amount of 0.1 percent by
weight provides a quantity by which the rock can be judged and is approximately
equivalent to about 1/25 inch of depth of this material over the bottom vf the
trench. This small amount should provide little restriction to flow.
The proposed change for 7080.0020, Subp. 29, page 5692 (B.28 on page 5) is:

Reason: It is important that the sand layer which is referred to in mound
construction have no more than 10 percent of particles smaller than 0.05 mm.

Also, for the proper performance of sewage treatment mounds and liner systems it
is critical that the amount of silt or clay, and fine sand and very fine sand be
limited. Since research has shown that soils having more than 50% of very fine
sand and fine sand will have a slower long term acceptance rate than would be
indicated by their percolation rate, the amount of fine sand and very fine sand
permitted in this definition should be reduced.

Reason: One of the proposed changes is to move the section on mounds from

Reason: The Minnesota Association of Township Officials changed their name to
the Minnesota Association of Townships.
The proposed change for 7080.0100, Subp. 5, page 5695 (C.3.e. on page 9) is:
e. All members shall be appointed by the Agency Board from
recommendations by the affected groups. All members shall serve for ~~ ~
years, with terms staggered so as to maintain continuity.
Reason: The Advisory Committee has not followed the term of office as
specified, a rigorous application of the two year term would mean that we would
need to meet once each year to select one-half of the members. Also, two years
is not long enough for an individual to become acquainted with the various
aspects of Chapter 7080 and possible changes to that document. Should members
not be able to serve for a four year term, Subp. 5 has a provision for filling a
vacancy.
The proposed change for 7080.0130, Subp. 2.F., page 5698 (F.2.a. (6) on page 13)

Reason: Septic tank maintenance firms are having difficulty locating septic
tanks and the suggestion has been made that there be an allowance for the septic
tank cover to extend to the ground surface. In the interest of safety, there
should be an additional cover at the bottom of the manhole which can be removed
by special equipment. Thus, this cover needs to have some minimum weight to
prevent the curious from opening it. See the attached sketch for details.
