RESOLUTION AUTHORIZING ASSESSMENTS FOR REPAIRING A FAILING
SEPTIC SYSTEM AT 6510 YOSEMITE AVENUE
WHEREAS, it has been determined that the property at 6510
Yosemite Avenue and more particularly described in Exhibit "A"
contained a failing septic system; and
WHEREAS, the City Health Officer, in a letter dated January
20, 1987, notified the property owner of 6510 Yosemite Avenue
that the septic system was failing and was causing effluent to
leach out onto the ground surface; and
WHEREAS, it was determined that it was posing as a potential
health hazard; and
WHEREAS, the property owner was ordered by Carver County on
February 9, 1987, to work with the City to repair the system; and
WHEREAS, the City received a waiver of trespass, right of
entry to the property dated February 6, 1987; and
~ WHEREAS, the City received a letter dated August 26, 1987,
waiving the rights to a public hearing on the repair of the
failing system; and
WHEREAS, said letter dated August 26, 1987, also agreed to
accept any assessments that result from the repair project.
NOW, THEREFORE, BE IT RESOVLED BY THE CITY COUNCIL OF
CHANHASSEN, MINNESOTA:
1. Authorizes the assessment of $8,064.32 to be certified
against the property for an assessment period of eight
years and shall bear interest at the rate of 9.0% annum
from the date of the adoption of this assessment resolu-
tion.
2. Such assessment shall be payable in equal annual principal
installments extending over a period of 8 years and
shall bear interest at the rate of 9.0% annum from the
date of the adoption of this assessment resolution. To
the first installment, due in 1988, shall be added
interest on the entire assessment from the date of this
resolution until December 31, 1988. To each subsequent
installment when due shall be added interest for one year
on all unpaid installments.

3. The owner of any property so assessed may, at any time
prior to certification of the assessment to the county

auditor, pay the whole of the assessment on such prop-
erty, with no interest charged lf the entire assessment
is paid within 30 days from the adoption of this resolu-
tion; and he may, at any time thereafter, pay to the city
treasurer the entire principal balance of the assessment
remaining unpaid. As such payments are made, current
annual amounts certified at the County shall remain
payable as part of the property tax process.
4. The clerk shall forthwith transmit a certified duplicate
of this assessment to the county auditor to be extended
on the proper tax lists of the county, and such
assessments shall be collected and paid over in the same
manner as other municipal taxes.
