RESOLUTION AUTHORIZING ACQUISITION
BY CONDEMNATION OF PROPERTY WITHIN
THE DOWNTOWN REDEVELOPMENT PROJECT AREA
WHEREAS, the City by Resolution No. 87-17 on March 2,
1987, and by Resolution 87-37 on May 4, 1987, determined that it
is in the public interest to acquire certain property within the
Chanhassen Downtown Redevelopment Project Area, as stated in the
Amended and Revised Plan dated January 1987, and in Modification
No. 7 to the Amended Redevelopment and Tax Increment Financing
Plan, dated March, 1987; and
WHEREAS, the Plan as amended and modified, requires the
acquisition of additional property within the project area; and

WHEREAS, the City has determined that it is in the public
interest to acquire these additional properties within the
Project area; and
WHEREAS, the City has determined it requires title and
possession to the property to be acquired prior to the filing of
an award by the court appointed commissioners.
NOW THEREFORE, it is resolved by the City Council of the
City of Chanhassen, Minnesota:
The City Attorney is hereby authorized and directed to
acquire the property described on the attached Exhibit
"A" by eminent domain proceedings, including the "quick
take" provisions of M.S. ~ 117.042, unless acquired by
negotiation or otherwise before the proceedings are
complete.
Adopted by the Chanhassen City council this 16th day of
November , 1987.

EXHIBIT "A"
That part of the Southeast Quarter of the Southwest Quarter (SE
1/4 of SW 1/4) of Section Twelve (12), Township One Hundred
sixteen (116) North, Range Twenty-three (23) West, Carver County,
Minnesota, described as follows: Commencing at a point on the
South Line of said section Twelve (12), 673.5 feet west of the
South Quarter corner of said section Twelve (12); thence north
133 feet to the actual point of beginning; thence east parallel
with the South Line of said Section Twelve (12) a distance of 100
feet; thence north at right angles 70 feet; thence west, parallel
with the South Line of said Section Twelve (12), 100 feet; thence
south at right angles 70 feet to the point of beginning.
Together with a seven foot strip of land adjoining the easterly
boundary of the above-described premises.

feet West of the South Quarter corner of section 12; thence North
33 feet to the actual point of beginning; thence East parallel
with the South line of section 12, 107.00 feet; thence North at
right angles 100 feet; thence West parallel with the South line
of section 12, 107.00 feet; thence South to the point of
beginning.
