City Council approval requires a two-thirds vote of the entire City Council (4 votes). BACKGROUND The City is required to update its Comprehensive Plan every ten years. As part of the update process, the City must submit the draft Comprehensive Plan to all adjacent governmental units for a review period of up to six months. The City must then submit the Comprehensive Plan to the Metropolitan Council for their review and approval. Following is a time line of the formal review and adoption process: . October 1, 2007 - The City submitted the draft 2030 Comprehensive Plan to adjacent communities for their review and comment. The agency review period ended on April 1, 2008. . Tuesday January 15, 2008 - The Planning Commission recommended approval of the 2030 Comprehensive Plan after public hearings on the Plan in October, November and December, 2007. . May 27, 2008 - The Chanhassen City Council approved the submittal of the 2030 Comprehensive Plan to the Metropolitan Council for their reVIew. . September 23, 2008 - The Metropolitan Council Environmental Committee recommended adoption. Chanhassen is a Community for Life. October 6,2008 - The Metropolitan Council Community Development Committee recommended adoption. . October 22,2008 - The Metropolitan Council approved the City of Chanhassen's adoption of the plan. Following is the proposed action requested by the Metropolitan Council: . Submit a copy of the adoption resolution to the Metropolitan Council for their records. . Submit two copies of the adopted City of Chanhassen 2030 Comprehensive Plan to the Metropolitan Council. . Submit any updated ordinances or controls intended to implement the Comprehensive Plan to the Metropolitan Council. . Reference the Water Conservation Plan (WCP), or include the WCP as an appendix to Chapter 9, Water. SUMMARY An overview and summary of the chapters and the changes made to the draft submitted to the Metropolitan Council follows: Introduction - Chapter 1 This chapter includes the vision statement of the City as well as the Community and Strategic goals. These goals were modified since the early draft to reflect 2008 data including the current bond rating and debt policy. Goals and policies for all chapters are also located in this section. Land Use - Chapter 2 The land use plan identifies appropriate locations for all types of uses and provides for the orderly expansion of municipal services through the Metropolitan Urban Service Area (MUS A) phasing plan. The land use plan provides the framework for the way the land is used. The plan deals with the following issues: . Development influences on the City. . The estimated consumption of land in five-year increments. . Comparison of the 2020 Land Use Plan and the 2030 Land Use Plan. . MUSA staging - Incorporates two MUSA stages, 2010 and 2015. . Discussion of each of the land use designations. An extensive section of the proposed commercial districts resulting from the Chanhassen Retail Market Study is included. Todd Gerhardt 2030 Comprehensive Plan November 10,2008 Page 3 The goal of the City is to create a mixture of land uses that provides a high quality of life and a reliable tax base. We have a very successful downtown and there is additional opportunity for retail; however, there is very little vacant commercial land. The existing 2008 land use, rather than the 2020 Land Use, was added to the plan (Figure 2-2 in Section 2.4 Land Use Comparisons on page 2-2) and the map (Figure 2-3) was changed to reflect the current 2008 existing land use. Resource Protection - Chapter 3 Our goal is to promote the preservation and protection of valuable historic and cultural resources through community partnerships and collaborations with citizens and non-profit state, federal, public and private entities. The City will identify where all of the historic properties in Chanhassen are located and the age of the structures and their significance, and encourage the preservation of these structures and development of buildings that compliment historic buildings. This chapter is new to the comprehensive plan and provides a brief narrative of the history of the City. The City will create an inventory of places, sites, and structures of historic/cultural significance. . Development of a recognition program. . Work under Carver County for the administration of a Historic Preservation Office. Revisions to Resource Protection due to Metropolitan Council Comments Aggregate - A section was added noting the one gravel operation in the City (Section 3.4 on page 3-4). Housin2 - Chapter 4 Chapter 4 of the Comprehensive Plan analyzes the existing and projected housing needs of the City. The City has adopted the Metropolitan Council's Systems Statement, which includes population, households and employment projects. Additionally, the City has included data from the Comprehensive Housing Needs Assessment for Carver County prepared by Maxfield Research, Inc. The housing chapter addresses the City's goals for housing in the community. The following issues are discussed: . Inventory of existing housing including types and price. . Analysis of future housing demand. . Status of the City's progress toward the Livable Communities Act. . Discussion of the City's demographics. Natural Resources - Chapter 5 The natural resources section identifies the important environmental amenities and attributes in the City and their corresponding issues. The mqin goals encompass identifying and preserving natural resources, protecting and improving surface water quality and wetlands, and increasing overall tree cover and maintaining the urban forest. Proper management of public natural resources is the overarching issue and critical to the success of Chanhassen retaining its natural resources identity. It is recommended that a Natural Resources Management Plan be developed that would encompass the management strategies for all natural resources in the City, complement the Bluff Creek Natural Resources ,Management Plan, and guide the City with the decision-making process for each issue. This chapter of the plan addresses natural communities including forestry and water resources. The following issues are addressed: Creation of a management plan for landJ that have been acquired by the City. Create an inventory of the natural resou~ces. The commitment of the City to preserve the City's natural resources; woodlands, wetlands, lakes, rivers and streams. . . . Todd Gerhardt 2030 Comprehensive Plan November 10, 2008 Page 5 Parks and Open Space - Chapter 6 This chapter of the 2030 Comprehensive Plan provides an overview and an analysis of the City's existing system. It identifies objectives and policies that will guide park and recreation decision making through the year 2030, as well as identifying key initiatives that will be completed to enhance the current park and trail systems. In our community, we have numerous non-City recreational facilities that play an integral role in fulfilling residents' recreational needs. Minnewashta Regional Park, the Minnesota Landscape Arboretum, the Minnesota Valley Wildlife Refuge, Raguet Wildlife Management Area, golf courses and Camp Tanadoona are all important recreation destinations. Two regional trails owned by the Hennepin County Regional Railroad Authority and managed primarily by Three Rivers Park District can be found in both the southern and northern tiers of the City. In addition, regional trails are located along State Highway 101 and State Highway 5. The parks and open space chapter deals with the! following issues: . Current park system adequate! y meets th~ needs of today' s residents. . Additional neighborhood parks (3 to 4) will need to be acquired in still developing areas. . Additional community ballfield space (up to 40 acres) will need to be acquired to meet demands of future growth. m' . Our pedestrian trail and sidewalk syste is widely recognized as one of the most comprehensive in the State. . In addition to local parks, residents are afforded convenient access to county, state and federal outdoor recreation destinations. I Revisions to Parks and Open Space due to Metropolitan Council Comments Parks and Trails - The names of the regional trLs have been changed in the text to the Lake Minnetonka LRT Regional Trail and the Minnejota River Bluffs LRT Regional Trail (Section 6.2.3 on page 6-6). Transportation - Chapter 7 ! The transportation chapter identifies the density and distribution of land uses in the community and their relationship to our transportation systi;' It provides a functional hierarchy of roadways for our community. It looks at syste improvements that will be required within the community and looks at transit services that wil be available, and finally it looks at an implementation program. The chapter is divide? into six sections: the goals and policies, the land use, MUSA staging and projections, the existing systems, the forecast, alternate modes of transportation or transit, and implementation of goals and policies. The transportation element is hased on the City'~ 2030 Land Use. Updates to these plans recognize changes in land use, development patterns, and other planning processes including: the Minnesota Department of Transportation's "Transportation System Plan 2008 - 2030" (TSP), Todd Gerhardt 2030 Comprehensive Plan November 10, 2008 Page 6 Carver County's Transportation Plan 2007 Update, and the Metropolitan Council's Transportation System Framework. . . The Plan shows how the City will achieve its goal of creating an integrated, multi-modal transportation system which permits safe, efficient and effective movement of people and goods while supporting the City's development plans, and complementing the County, metropolitan and State transportation systems that are within its boundaries. . Addresses existing and projected deficiencies in the City's roadway system. . Establishes a functional roadway classification system for the roads within the community. . Discusses existing and future funding mechanisms for the construction of transportation improvements. . Provides preliminary capital improvements. Revisions to Transportation due to MetroPolJtan Council Comments , Roads and Transit I . Revised the functional classification for CfAH 15, 18 and 19 to "A" minor arterials (Section 7.6.4). : . To be consistent with the City of Eden prat~' rie, Dell Road north of Highway 5 is classified as a major collector (Section 7.6.5). . The plan acknowledges that the City lies within the Metropolitan Council's Transit Market Area III (Section 7.8.1). l' . Comprehensive Sanitary Sewer System Plan :- Chapter 8 The sanitary sewer plan presents the existing satilary infrastructure and the general location and size of future sanitary sewer infrastructure under fully developed conditions. The sanitary sewer comprehensive plan covers ~he future extensions of municipal service to future development areas. Capital Improvements Plan. Comprehensive Water Plan - Chapter 9 The water plan identifies the existing trunk and lateral watermain and wells within the City. The general alignment and size of future trunk watermain and the general location of future well sites and future water towers is also shown. The Met Council recommended that the DNR Water Conservation Plan (WCP) be added as an appendix to Chapter 9. The WCP is now Appendix D of Chapter 9. The water comprehensive plan covers the futurd extensions of municipal service to future development areas. The plan deals with the following issues: I . Organized and cost-effective plan to exttnd water service to development areas of the community. o Plan is based on anticipated land use,! opulation growth, anticipated growth corridors, and estimated future water demand. · Future needs for wells, storage and treatfl ent facilities. . Maintenance and upkeep of the existing ater infrastructure. . Capital Improvements Plan. Capital Improvements - Chapter 10 . I This element contains a summary of the caPitallmprovements that are estimated to implement the comprehensive plan for the next ten years. ~t pulls together the recommendations of the various elements to provide an overview of the capital costs. The capital improvement element is designed to show the magnitude and timing f~r the construction of public improvements and provide a guide for future capital budgeting in tre community. However, the City will adopt a separate, five-year capital improvement program annually. Revisions to Capital Improvements due to M1 tropolitan Council Comments Plan Implementation - The City has provided t e 2008 to 2012 complete capital improvement program as an appendix to the 2030 Comprehe sive Plan. (See Figure 1) The 2030 Regional Development Framework (RDF), as adopted by the Metropolitan Council (Council) in January 2004, identified Chanhassen as a "Developing" community. Figure 2 shows the designation and regional systems in Chanhassen and the surrounding area. The City submitted its 2030 Comprehensive Plan (Update) to the Council for review to meet the Metropolitan Land Planning Act requirements (Minn. Stat. S 473.864, Subd. 2). The Council reviews plans to determine: . Confonnance with metropolitan system plans, . Consistency with other adopted Plans of the Council, and . Compatibility with the Plans of other local jurisdictions in the Metropolitan Area. The Council may require a local governmental unit to modify any plan or part thereof if, upon the adoption of findings and a resolution, the Council concludes that the Plan is more likely than not to have a substantial impact on or contain a substantial departure from metropolitan system plans (Minn. Stat. S 473.175, Subd. 1). Each local government unit shall adopt a policy plan for the collection, treatment and disposal of sewage for which the local government unit is responsible, coordinated with the Metropolitan Council's plan, and may revise the same as often as it deems necessary. Each such plan shall be submitted to the Council for review and shall be subject to the approval of the Council as to those features affecting the Council's responsibilities as determined by the Council. Any such features disapproved by the Council shall be modified in accordance with the Council's recommendations (Minn. Stat. S 473.513). CONFORMANCE WITH REGIONAL SYSTEMS Regional Parks Parks and Trails Reviewer: Jan Youngquist, CD - Regional Parks System Planning, (651-602-1029) The Update is in conformance with the Regional Parks Policy Plan (RPPP). Transportation Roads and Transit Reviewer: Ann Braden, MTS - Systems Planning, (651-602-1705) The Update is in conformance with the Transportation Policy Plan and addresses all the applicable transportation and transit requirements of a comprehensive plan. TH 212, a principal arterial, has recently been reconstructed as a four-lane freeway on approximately 12 miles of new alignment that runs southwest from Hennepin CSAH 4 (Eden Prairie Road) in Eden Prairie, where it connects to existing Highway 212. The highway runs through the cities of Eden Prairie, Chanhassen, Chaska, Carver and Dahlgren. TH 7, another principal arterial runs along a portion of the city's northern border. The transportation chapter includes an extensive analysis of existing and future transportation deficiencies and recommends improvements to the minor arterial, major and minor collector and local roadway networks. Chanhassen lies within Transit Market Area III. Service options for Market Area III include peak-only express, small vehicle circulators, midday circulators, special needs paratransit (ADA, seniors), and ridesharing. Regular route transit service is provided by Southwest Metro Transit. Dial-a-ride service is provided by Carver Area Rural Transit. 4 Aviation Reviewer: Chauncey Case, MTS - Systems Planning (651-602-1724) The Update is in conformance with the Aviation System Plan and consistent with Council policy. The nearest metropolitan aviation facility to the City of Chanhassen is the Flying Cloud Airport (FCM) located in the City of Eden Prairie. Chanhassen is affected by the need to protect the region's general airspace from potential airspace hazards and recognize that certain surface waters are permitted seaplane use areas. Also, a portion of Chanhassen is within the FCM airport influence area (AlA) and is affected by specific airport zoning requirements. The City is not within the future noise contours for the expanded airport. The Update addresses the protection of the region's general airspace through use of the "Notification" process to FAA and MnDOT. The Update addresses the permitted use of seaplanes on Lakes Riley, Hazeltine and Minnewashta. The federal record of decision (ROD) on the airport expansion FEIS has been recently approved by the FAA and the new airport development plan is now being implemented. In 2008, the Metropolitan Airports Commission (MAC) will be updating the FCM long-term comprehensive plan likely to 2030. There will be an effort to establish a joint airport/community zoning board for FCM that would include Chanhassen, Eden Prairie and possibly Shakopee and Bloomington along with the MAC. A primary objective of the board is to establish a local airport zoning ordinance to protect the airport environs primarily through height controls. In the case of Chanhassen it is critical that specific height controls are in place to protect the approaches to runways 10L and lOR. The instrument landing approach to runway lOR is system-critical to the function of FCM and operations in the southwest portion ofthe region. The City is encouraged to participate in the zoning process for protection of Flying Cloud Airport operations and system role. Water Resources Management Wastewater Service Reviewer: Kyle Colvin, ES - Engineering Services, (651-602-1151) The Update is in conformance with the Water Resources Management Policy Plan. The Update summarizes the City's vision to year 2030. The Update includes growth forecasts that are consistent with the Council's forecasts for population, households and employment. Current regional wastewater treatment services are provided to the City by the Metropolitan Council Environmental Services. Wastewater generated within the City is conveyed to and treated at the Blue Lake Wastewater Treatment Plant located in Shakopee. The Update projects that the City will have 14,800 sewered households and 15,600 sewered employees by 2030. The Metropolitan Disposal System with its scheduled improvements has or will have adequate capacity to serve these needs. The Update provides a sanitary flow projection for year 2030. This projection represents ultimate build-out of the City. The bases for the projections were given in the Update and were determined appropriate for planning for local services. Chanhassen has been identified as a community impacted by wet weather occurrences. The City is currently on the Council's list of communities having an III reduction goal. The City has committed to mitigate excessive III at levels equal to the Council's Surcharge amount. The City's III reduction plan includes investigative efforts for locating sources of excess III through system flow monitoring, sump pump inspections and disconnections and system inspection and rehabilitation. The City and the Environmental Services conducted a joint investigative study to examine potential sources of III entering the regional system. The findings of that joint study resulted in follow-up minor improvements to the regional disposal system including MH structure casting adjustments and joint sealing. 5 Tier II Comments Reviewer: Kyle Colvin, ES - Engineering Services, (65]-602-115]) The Tier II Sewer Element of the Update has been reviewed against the requirements for Tier II Comprehensive Sewer Plans for developing communities. It was found to be complete and consistent with Council polices. Upon adoption of the Update by the City, the action of the Council to approve the Tier II Plan becomes effective. At that time, the City may implement its Update to alter, expand or improve its sewage disposal system consistent with the approved Tier II Sewer Plan. A copy of the City Council Resolution adopting its Plan needs to be submitted to the Metropolitan Council for its records. Surface Water Management Reviewer: Judy Sventek, ES - Water Resources Assessment (651-602-1156) The City's draft Storm Water Management Plan (SWMP) is consistent with the Council's 2030 Water Resources Management Policy Plan. The City of Chanhassen is located in four watersheds: Lower Minnesota River Watershed District, Riley Purgatory Bluff Creek Watershed District, Minnehaha Creek Watershed District, and the Carver County Watershed Management Organization. The Metropolitan Council reviewed the City ofChanhassen's Local Water Management Plan (LWMP) in May of2006. All four watersheds approved the City's LWMP in 2006 and the City adopted the final LWMP in August 2006. The Metropolitan Council found the L WMP to provide an excellent framework for managing storm water in the City. The Council has no further comments on the LWMP element of the Comprehensive Plan Update. CONSISTENCY WITH COUNCIL POLICY Forecasts Reviewer: Todd Graham, CD - Research, (651-602-1322) The Update is consistent with Council's forecasts and consistent with regional policy in this respect. In the Wastewater Chapter, the segmentation of sewer-serviced and "unsewered" forecasts is slightly different from Council's System Statement (unsewered population and households in 2020, also 100 jobs at unsewered worksites in 2010 and 2020). Council staff can agree to the forecast in table 8.6.2 and reflect the change in Council's forecasts set. City Population Households 38,000 14,800 15,600 Employment 2030 Regional Development Framework and Land Use Reviewer: Jim Uttley, CD - Local Planning Assistance, (651-602-1319) The Update is consistent with the 2030 Regional Development Framework's (RDF), which designates Chanhassen "developing." Council policy for developing communities calls for an average density 00 to 5 plus units per net developable acre for areas within the MUSA serviced by the Metropolitan Disposal System. Chanhassen is a participant in the Council's Plat Monitoring Program (PMP). According to the PMP, Chanhassen approved 45 subdivisions between 2000 and the end of 2007 adding 2,347 housing units at an average density of 5 units per net acre. 6 The Update is consistent with the Council's land use guidelines for communities in the developing area. The Update indicates that the City proposes that its existing MUSA will be fully developed by 2030 with no vacant land remaining for development after that date. The City has 1,800 acres that are outside the MUSA at the present time and it does not plan for urbanization of those lands before 2030. Densities throughout the planning period are proposed to remain above 4 units per net acre. Housing Reviewer: Linda Milashius, CD - Livable Communities, (651-602-1541) The Update is consistent with the Council's housing policy and meets the affordable housing planning requirements ofthe MLPA. The Update acknowledges the City's share ofthe region's affordable housing need of 1,166 affordable units for the 2011-2020 time period. The Update indicates that the City has an adequate supply ofland available through 2020 for medium density (4-8 acres per unit) and high density residential (8-16 units per acre), as well as an additional 20 acres designated as mixed use residential (8-20 units per acre) that can be used to provide opportunities to meet the City's affordable housing need. The Update provides the implementation tools and programs the City will use to promote opportunities to address its regional fair share housing need. The Update indicates the City will consider the use of Tax Increment Financing for affordable housing and is committed to continue working with the Carver County Community Development Agency and Minnesota Housing to pursue opportunities and resources to maintain housing affordability in the community and to accommodate additional new affordable units. Chanhassen is a participant in the LCA Local Housing Incentives Program. Individual Sewage Treatment Systems (ISTS) Program Reviewer: Jim Larsen, CD - Local Planning Assistance, (651-602-1159) The Update is consistent with Council policy rdative to ISTS. The Update indicates there are currently 415 ISTS operating in the City. Figure 3.4 in Appendix A identifies where the systems are in use in the City. The City's ISTS management program is consistent with Minnesota Pollution Control Agency and Council requirements and policies. The City has provided a copy of its current ISTS ordinance in Appendix I of the Update. Water Supply Reviewer: Sara Bertelsen, ES - Water Supply Planning, (651-602-1035) The City's water supply plan (WSP) is consistent with the policies of the Council's Water Resources Management Policy Plan. The Council commends the city on its recent effort to expand its water conservation programs in order to reduce the city's outdoor water use. Resource Protection Historic Preservation Reviewer: Jim Uttley, CD - Local Planning Assistance, (651-602-1319) The Update contains a section on Historic Preservation as required by the MLP A. Solar Access Protection Reviewer: Jim Uttley, CD - Local Planning Assistance, (651-602-1319) The Update addresses the subject of solar access protection on page 3-4. The paragraph indicates that the City is addressing solar access protection via zoning codes. Aggregate Resources Protection Reviewer: Jim Uttley, CD - Local Planning Assistance, (651-602-1319) The Council's Aggregate Resources Inventory does not identify the presence of any aggregate resource deposits of sufficient size to be viable for mining. The Update does identify a 36-acre site on the southern perimeter of the City that was historically utilized as a mineral extraction site. Interim use of the site as a 7 shooting range has left it in need of environmental reclamation. The land use plan proposes high density residential for its future use. Chanhassen does not need to address the protection of these resources and the Update does not propose protection of the aggregate resources at this site. The Update is incomplete in areas as identified in this letter. For this reason, the formal review of the Update is suspended until the Council receives supplemental materials from the City to address the areas discussed below. Once the supplemental materials are received and evaluated, if the Update is then found to be complete, the formal review process will resume. Land Use The Update is incomplete for land use.' The Update does riofcontain an existing larid use map. Table 2':'1 identifies "existing" land use as being for the year 2000 . Existing land use should reflect 2008 or 2007 land use acreages. Plan Implementation The Update does not adequately addresses two ofthree sub-elements required by statute (Minn. Stat. 9473.859, Subd. 4). The Update does not adequately address the following requirements that the plan: . Describes public programs, fiscal devices and other specific actions to be undertaken in stated sequence to implemerlt the comprehensive plan.. .. An implementation program shall contain at least the following parts: (1) A description of official controls, addressing at least the matters of zoning, subdivision, water supply, and private sewer systems, and a schedule for the preparation, adoption, and administration of such controls; (2) A capital improvement program (CIP) for transportation, sewers, parks, water supply, and open space facilities; In order to make the Official Controls section of the Upda(e complete, the City will need to provide the Council with a copy of the City's existing zoning map and those sections of the zoning ordinance that deal with zoning district densities/lot sizes (including conditional use and PUD regulations), as well as copies' of the city's subdivision regulations, POD ordinance (if a separate ordinance) and any other applicable land use controls. While the City's Update contains a chart (Figure 10-1) on page 10-2 that is referred to as a CIP, the chart does not satisfy that statutory requirement for a ClP. Minnesota Statutes S473.852, Subdivision 4 requires that the ClP include "the need for each improvement, financial sources, and the financial impact that the improvement will have on the local governmental unit or school district." h1 order to make the Official Controls section of the Update complete, the City will need to provide information on the need for each improvement, financial sources, and the financial impact that the improvement will have on the local governmental unit or school district. In addition, Council staff has questions about the sewer-related section of the Update. Sewers The plan indicates that the City will consider providing wastewater services to the large lot developments (2.5 acre lots) if they have failing systems. The plan does not indicate if the City would require the lots to be subdivided and at what density. lfthe City intends to allow such lots to be sewered "as is" it would be helpful ifthe City could indicate the total number of such lots and the total acres involved, so that Council staff can determine the potential impact on the City's overall density and conformance with Council policy if such lots were sewered.
