The following issues were raised at the June 3, 2003 Planning Commission meeting. A planned course of action is listed beneath each condition- ho A resident, who couldn't attend the meeting, was concerned with how the school was going to handle mosquito control since a pond was now being installed on the site. The school does currently spray for mosquitoes. They commented that it is a delicate balance between spraying too much and not enough. They do not foresee having to do anything special, but if a problem arises they will address it. g. Neighbors (Mr. & Mrs. Mancino) to the south of the school site were concerned with an existing erosion and stormwater runoff problem between their site and the school's property. Staff commented that the existing erosion problem is really a separate issue from the IUP. The site improvements to the school's property are being done on the north part of the site, which is hundreds of yards from the Mancino's property. Staff did assure the Mancinos, however, that City staff will contact them to work on a solution to their erosion problem. C. The Mancinos asked that the construction hours be limited on Saturday firom 9am-5pm. The Mancinos mentioned that there is a trash dumping problem occurring along their property line with the school. The commissioners informed the Mancinos that this is a separate issue from the 1UP request and one that should be handled privately between the two parties. E. A couple commissioners were concerned with the proposed hauling operations. Specifically, these concerns centered on the hours of operation, dust control, and dirt being tracked onto Highway 41. Conditions were added that limit the hours of hauling operations fi'om 8:30am-3:30pm Monday through Friday, require a water truck to be used for dust control on the site, and require that Highway 41 be monitored and swept as needed. RECOMMENDED MOTION 'Whe Chanhassen City Council approves Interim Use Permit No. 03-02 with the following conditions:l 1. The applicant shall provide the City with a cash escrow or letter of credit in the amount of $8,400 to gumantee erosion control measures and site restoration and compliance with the interim use permit. The applicant must also pay the City an administration fee of $296.00 prior to the City signing the permi~ 2. Storm sewer sizing calculations will have to be provided for a 1 O-year, 24-hour storm event. 3. The applicant must provide a proposed haul route for review and approval. 4. If excess material will be hauled to another site in Chanhassen, a separate grading permit will be required for the other property. 5. All disturbed areas as a result of construction are required to be reseeded and mulched within two weeks of site grading. 6. A rock construction entrance must be ingtalled at the beginning of the driveway construction. 7. Add a four-foot high chain link fence to the west side of the proposed bituminous path along the entire length of the pond. 8. The applicant shall obtain and comply with all permit requirements of the Watershed District and Mn/DOT, if applicable. 9. The applicant shall supply the City with a mylar as-built stavey prepared by a professional en~neer upon completion of excavation to verify the grading plan has been performed in compliance with the proposed plan. Top soiling and disk mulch seexfing shall be implemented immediately following the completion of excavated areas. 11. Noise levels stemming from the operation are not to exceed MPCA and EPA regulations. If the city determines that there is a problem warranting such tests shall be paid for by the applicant. 12. Hours of operation are limited to 7:00 ama. to 6:00 p.m., Monday through Friday, 9:00 mm. to 5:00 p.m. Saturdays, and prohibited on national holidays. If the City Engineer determines that traffic conflicts result due to rash hour traffic flows, the hours of operation will be appropriately restricted. Hauling operations will be allowed from 8:30 am, to 3:30 p.m., Monday through Friday, or as approved by the City En~neer and/or Mn/DOT. 13. The applicant shall be responsible for any and all mad damage sustained from the truck hauling and construction activities. In addition, if any dirt or debris is tracked onto highway 41, the applicant will be required to sweep the road as necessary. 14. Use the City's standard outlet control smmmm for the pond outlet, as per City detail plate #3109. Also, add the other following detail plates to the plans: 5300 & 5301. 15. Show the NWL & HWL of the proposed pond. 16. Show the proposed grading for the new bituminous path for the entire distance to Melody I-tall Road. 17. Revise the drive aisle widths of the eastern parking lot to be 26-feet in width, as per City code. 18. Building Official Conditions: a. The plans must be signed by a professional engineer licensed in the State of Minnesota. b. Provide plans and details of the accessible parking space signage for review. c. A plumbing permit must be obtained before be~nning work on the site utilities. 19. The applicant shall verify that hawthorns planted on the south side of the parking lot have adequate growing space and protection ff planted within the sidewalk. 20. The revised layout negates the need for a variance with the project. Specifically, the revised layout eliminates the two-way drive aisle adjacent to 45° angled parking. Tnstead, a one-way drive aisle is now proposed along the 45° angle parking. The one-way aisle continues around the perimeter of the parking area and still keeps the bus and car traffic separated. "' Minnetonka West IUP June, 2003 Page 2 APPLICABLE REGUlaTIONS Chap. 7, Article Ill EXCAVATING, MINING, FII.I.ING AND GRADING ORDINANCE Section 20-231 through 20-237, Conditional Use Permit The applicant is requesting an interim use ea~work _permit to grade appro~ly 8,000 cubic yards of material for site improvements to the Minnetonka School District's Junior I-~gh site in Chanhassen. The site is located on the east side of state highway 41, just south of Chaaka Road. The proposal must comply with Chapt~ 7 of the City Code. The ordinance requixes the agplicamt to provide a haul route for any proposed hauling otnmations associated with the grading work. This information has not been provided and has been added as a condition of approval. Staff is recommending approval with conditions. GRADING/DRAINAGE/EROSION CONTROL The applicant is requesting an interim use permit to grade approximately 8,000 cubic yards of material. The grading is being done as a part of some overall site improvements to the property. These improvements include a revised parking lot with separate areas for car and bus traffic, a pond to treat the parking lot runoff, and a new bituminous trail fi'om the parking lot to Melody Hill Road. The grading work is anticipated to begin as soon as permit approval is obtained. Permitted hours of Minnetonka West 1UP June, 2003 Page 3 operation are 7:00 a.m. to 6:00 p.m_, Monday through Saturday with no work permitted on Sunday or legal holidays. Staff has not yet received a proposed haul route as requirecC Staff is recommending that the applicant provide a proposed haul route for review and approval. The applicant should also be aware that if any excess material is going to another site in Chanhassen, a separate grading permit will be required for the other property. Thc existing parking area on thc east side of the site drains to a storm sewer linc which outlets thc stormwater to a swale. This swale is within a grove of trees on the north edge of the existing bus turnaround area. The swale provides the only form of treatment for the stormwater before it is discharged to the eastern ditch along highway 41. The existing drainage from the east side of the school and the bus turnaround area flows down the driveway to a storm sewer. This storm sewer discharges the water to the highway 41 ditch without any prior treatment. Under the proposed plan, 90% of the improved area will be conveyed to a new NURP pond within the site. This pond will treat the stormwater prior to dischargi~'ng it to the above-mentioned swale and, ultimately, the highway 41 ditch. Staff believes the inclusion of the NURP pond is a major positive for this project. The school property is going from a site with no significant stormwater treatment, to a site with a NURP pond for treatment. Drainage calculations for the proposed pond have been submitted. Storm sewer design data must still be submi~ for staff review and approval. Erosion control has been shown on the plan in ~ce with the City's Best Management Practices Handbook (BMPI-I). Staff would only recommend that a rock construction entrance be installed at the beginning of the driveway construction. All disUa'bed areas as a result of construction are required to be reseeded and mulched within two weeks of site grading. This interim use permit will expire one year from the date of City Council approval. The permit maybe renewed, however, on an annual basis subject to City Council approval. If this is necessary, the applicant will need to request a formal extension 45 days prior to the expiration date. Financial permit is also subject to administration fees. The administration fees are based on the number of cubic yards of material being graded. The fees are taken from the Uniform Building Code Appendix, Chapter 33. Based on 8,000 cubic yards of material, the applicant shall pay the City $296.00 prior to the City signing the permit. The proposed interim use permit application is fairly straight forward. With the conditions added by staff to ensure proper restoration and minimize any traffic conflicts, staff is recommending approval of the interim use permit. PARKING LAYOUT There is one issue with the bus parking layout. Thc applicant has proposed 45°-angle parking with a two-way drive aisle adjacent to the stalls. City code only allows 45°-angle parking when adjacent to a one-way drive aisle. Therefore, approval of the submitted plans will be conditioned upon the applicant receiving a variance for the two-way drive aisle. A couple of options for the parking layout were discussed with the applicant. One is to simply convert the 45°-angle parking to parallel parking. The applicant's concern with this option is that Minnetonka West IUP June, 2003 Page4 there would not be enough space to hold all of the buses within the parking area before they would start stacking down the driveway. Another option is to e 'luninate the two-way drive aisle and install a one-way drive aisle around the perimeter of the parking lot. The applicant's concern with this option is that they did not want to impact the existing grove of trees on the north side of the parking lot. LANDSCAPING Minimtun requirements for landscaping include 4,901 sq. ft. of landscaped area around the parking lot, 14 trees for the parking lot, and 10 landscape islands within the parking lots. Applicant's proposed as compared to the requirements for landscape area and parking lot trees is shown in the following table. COMPLIANCE WITH THF. EXCAVATING, MINING, FH.LING AND GRADING ORDINANCE Section 7 of the ordinance provides a sex/es of standards which an interim use permit must be in compliance with. Section 7-40- Fees The ordlmmce nllows the City to determine the fee schedule for ench permit nnd thnt ench permit must be nnnunlly reviewed by the City Engineer. Section 7=41 provides for nn irrevomble letter of credit that will be required to ensure compliance with conditions of approval. Finding Staff is proposing that an $8,400 letter of credit or cash escrow be required to ensure compliance with conditions outlined below. The letter of credit will cover erosion control measures, site restoration and compliance with the interim uae permit. In addition, a permit fee from the Uniform Building Code will be applied requiting a permit fee of $296.00 to be paid. Section 7-42. Setbacks The ordinance requires that a sflback of 100 feet fi-om existing street rights-of-way and 300 feet from adjoining property lines be required for mining activities. Finding This condition does not apply. It is intended for mining activities only. Minnetonka West IUP June, 2003 Page 5 Section 7-43- Fencing The ordinance requires fencing for areas which will be converted to steep gmde~ or where on ~ite ponding exists if the Council determines that a mfety hazard exists. Finding No on site ponding exists; however, a pond is proposed to be installed along with an adjacent bituminous path. Due to the steep pond slopes and the adjacent trail, staff is reco~g the installation of a four-foot tall chain link fence along the west (pond) side of the trail. Section 7-44 - Appearance and Screening The ordinance requires that the visual .tm!mcr of grading and mining operations be minimized and that where necesmu'y, screening be provided. Finding This will be a temporary excavation proce~. The applicant intends to complete the grading work before school beans in the fall. Once complete, the site will be immedi~ly restored with seeding. Therefore, the visual impact of the grading will be ~ and screening will not be necessary. Section 7-45 - Operations, Noise, Hours, Explo~es, Dust, Water, Pollution, Top Soil Pram'ration A~ Finding Staff does not feel that the earthwork on the site will be excessive beyond the activities being experienced in the area already (highway 7, for example). To ensure that the noise levels do not become excessive, a condition is being provided that noise levels not exceed MPCA and EPA limits. If noise testing is required by the city, the cost shall be paid by the applicant. Be Earth work is permitted only during the hours of 7:00 a.m. to 6:00 pan. Monday through Saturday and prohibited on national holidays. Finding The hauling operation is anticipated to begin as soon as permit approval is obtained. Finding A stockpile will be provided for the topsoil which will be respread on the site as soon as the excavation is completed. Operators shall use all practical mca_ ,n to reduce the amount of dust, smoke and fumes caused by the operations. If problems do arise, dust control measures such as water application will be required. L To control dust and minimize ~ of sand, gravel and dirt onto public streets, internal private roads to any public roadway shall be paved with asphalt or concrete for a distance of 300 feet to the intersection of the public roadway. Alternate means of controlling this problem may be accepted by the city. Finding There will be, approximately, 170-feet of the existing paved ma'face zcmaining during constriction. Finding The applicant must provide a haul foul Section 7-,16- Restoration Standards The ordinance provides a series of standards outlining site restoration. These are reviewed below. A. The plan must be consistent with the City's Comprehensive In_an and Zoning Ordinance. Finding The Comprehensive Plan illustrates this area as institutional. The applicant is not proposing to change the use on the site. The applicant is ~mply proposing to upgrade the existing parking lot on the site. Therefore, staff believes that the tn'otmsal is conaistent with the Comprehensive Plan and Zoning Ordinance. Bm Restoration shall be a continuing operation occurring as quickly as possible after extraction operation has moved. Finding Restoration will be completed immediately af~ the grading is completed. The applicant wishes to expe~te the entire project and have it completed prior to school be~ in the fall. Staff will be maintaining a letter of credit to cover the restorati~ costs in the case that the applicant does not or is unable to restore the site in a timely manner. AH banks and Mopes shall be left in accordance with the restoration plans submitted with the permit application. Minnetonka West IUP June, 2003 Page 8 Finding Staff is recommending that an as-built grading plan be provided at the completion of the project so that staff can confirm the volume of material that has been imported and that the site is comtmctexi as proposed. Such ground cover shall be tended as necessary until it is self Finding The topsoil shall be preserved on the site and respread after grading is complete. The topsoil will then be seeded to ensure ground cover for stabilization of the area. E. All water areas resulting fi'om excavation shall be eliminated upon restoration of the site. Finding The only allowed water areas, resulting from the excavation of the aite, will be the proposed pond. F. No part of the restoration area which is planned for uses other than open space or agricultural shall be at an elevation lower than the minimum required for connection sanitary or storm sewer. Finding The finished grade of the site will allow for the connection of municipal water, sanita~ and stonll sewer. Provide a landscaping plan mustrating reforestation, ground cover, wetland restoration or other feature~ Finding A landscaping plan has been provided. INTERIM USE PERRHT STANDARDS Mining operations are allowed in the RSF District as an interim use permit. The ordinance provides that interim use permits are reviewed under the general issuance standards established for conditional use permim, Section 20-232, of the ordinance. The following constitutes a compilation of the general issuance standards and staffs findings for each. 1. Will not be detrimental to or danger the public health, safety, comfort, convenience or Minnetonka West KIP June, 2003 Page 9 general welfare of the neighborhomt or the dry. *The improvements will acUmlly enhance the public school site and will make the site easier to navigate by separating the bus/car parking lots. 2. Will be consistent with the objectives of the city's Comprehensive Plan and this chapter. *The earthwork will be maintaining the site in a form suitable for institutional use which is compatible with the Comprehensive Plan and this chapter. Will be desi_ ~ed, constructed, operated and main~ed so to be compatible in appearance with the existing or intended character of the general vicinity and will not change the essential chara~ of that area. *The proposed earthwork and assodated improvements will be maintaining the site, compatible appemance with existing or intended character of the general vicinity. 4. Will not be hazardous or disturbing to existing or planned ~rlng uses. *With the tnecautions being taken by the applicant and with the conditions of approval, the activity will not be hazardous or c~~ to and schools; or will be served adequate~ by such facilities and services provided by the persons or agendes responsible for the estabHshnamt of the proposed use. *The grading o~on is a temporary use. The finiahed elevation will allow the site to continue to be served by sanitary sewer, storm sewer, and water. Will not create excessive requirenmnts for public facilities and services and will not be detrimental to the economic welfare of the conummity. *The activity will not create excessive ~quirements for public facilities and will not be detrimental to the economic welfare of the community. e wm not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimen~ to any persons, property or the general w~ because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash. *The proposed excavation could result in a temporary increase of traffic, noise and fumes during cons~on. The conditions of approval will provide standards by which the activities should be minimize. Will have vehicular approaches to the property which do not create traffic congestion or interfere with traffic or surrounding public thoroughfares. Staff is recommending that ff it is felt that traffic during rush hour is potentially a hazardous situation, the city could limit the hours of hauling on weekdays to non-rash hour periods. With this condition, staff feels the potential traffic conflicts will be minimi?exl and will not be a potential hazard. Will not result in the destruction, loss or danmge of solar access, natural, scenic or historic features of major significance. *The proposal will result in thc removal of some existing trees. 10.
