Update to Approval of Change Order No. 2, Marsh Glen Trail
At the direction of the City Council, staff hosted two additional meetings with the
parties involved in the Marsh Glen Trail project. The first meeting held on
April 1, 2003 did not end with any final agreeanents being reache~ A second
meeting held on April 7, 2003, with you and City Attorney Knutson present,
resulted in a settlement agreement between all parties being reached. This
agreement has the net effect of reducing .Change Order No. 2 by $10,000, bringing
the total change order payment to $21,623.36.
RECOMMENDATION
It is recommended that the City Council approve the settlement agreement
reducing Marsh Glen Change Order No. 2 by $10,000 resulting in a new change
order amount of $21,623.36.

Attached please find a memorandum from Paul Paige of Hoisington Koegler
Group detailing the need for a substantial change order on the Marsh Glen Trail.
This trail connector is situated adjacent to Rice Marsh Lake, affording furore trail
users some inspiring views. Unfortunately, trailway ali~ments situated near
marshes are also prone to exhibiting poor soils. In this case, soil borings were
conducted that identified some unstable soil would be encountered in the
construction of this trail. The trail design and bid package accounted for the
amount of poor soils estimated to be encountered.
The amount of poor soil actually present turned out to be substantially greater than
initially anticipate& In order to "get to the bottom" of the bad soil deposits under
the trail alignment, an additional 609 cubic yards of soU was excavated at a cost of
$15 per cubic yard. Backfilling this sub-cut trench necessitated the import,
placement, and compaction of select granular fill at a cost of $28.54 per cubic
yard. Other added costs include $4,757.50 in equipment and labor to haul and
grade these additional soils, and $350 for a culvert extension. On the bright side
of things, staff was success~ in negotiations to dispose of the majority of this
excess material on private property adjacent to the project site. In doing so, the
City avoided significant trucking costs to haul the material off site.
The original contact sum for this project was $99,655.00. Change order No. 1 for
an additional culvert cost $3,927.00. This Second change order for soft correction
cost $31,623.36, bringing the total contract to date to $135,205.36.
RECOMMENDATION
It is recommended that the City Council approve change order No. 2 for the
Marsh Glen Trail Project in the amount $31,623.36, bring~g the total contract
award to $135,205.36.

The Marsh Glen Trail and Pedestrian Bridge is being built directly adjacent to a wetland complex. Due to
the proximity to the wetland, the soils are wet and unstable and special subgrade preparation is needed.
Prior to construction, American Engineering Testing, Inc., a geotechnical consulting firm, took soil borings
in the trail area and recommended subgrade preparation to ensure that the trail would be stable and resist
frost heave. American Engineering Testing recommended that all organic wpsofl be removed and that the
resulting subcut should be filled with select granular borrow wrapped in geotexfile fabric. The ~
depth of subcut in unstable areas was to be 1'-6" to allow for at least 1' of select granular borrow under 6"
of Class 5 Aggregate Base. The original contract sum is based on thia cross section.
During construction, to ensure that the Contractor had completely removed the organic topsoil layer,
American Engineering Testing was asked to inspect the trail subcut. Upon inspection, American
Engineering Testing found that along much of the trail, the organic topsoil layer extended several feet
deeper than originally anticipated. A representative from American En~neefing Testing was on site
supervising the necessary removal of organic topsoil from the subbase from December 18, 2002 to
December 28, 2002. During this time, 609 C.Y. of ~ddifional organic soil needed to be removed and then
filled with select granular borrow in order to ensure a stable subbase for the trail. The ContracWr then had
to relocate the removed organic material to an on site location. All of this work was outside of the original
contract sum.
In addition to the above work, Sunram Construction has been asked to extend a 12" CMP culvert that has
been placed under the trail in a low spot to allow the flow of water under the trail. The 10' culvert
extension will allow for a safer, more gradual slope away from the finished trail edge at this location-
I have reviewed excavation information from ~can Engineering Testing, and select granular borrow
receipts from Sunram Construction and have determined that 609 C.Y. of additional subcut was removed to
properly prepare the trail subgrade. In addition, I have reviewed the costs of additional subcut, placed
select granular borrow, moving the additional organic topsoil on the site, and the cost of the culvert
extension and feel that the prices are fair. I recommend that the City Council approve the change order
sum of $31,623.36.
Due to proper preparation of the subbase, the City can be assured that the Marsh Glen Trail will remain in
excellent condition with ~ additional maintenance for many years to come.
