Under current building codes, a building cannot encroach on two parcels that are under different ownerships. In this case, Lot 1, Block 2 is owned by the EDA and Lot 2, Block 2 is owned by the City. Staff is recommending approval of the attached resolution conveying the ownership of Lot 1, Block 2, Schneider Park from the EDA to the City. ATrA~ 1. Plat of Schneider Park 2. A grot place to live, work, and play. m UJ I I l CITY OF CHANHASSEN ECONOMIC DEVELOP~ Au'rHOR1TY CARVER AND HRNNEPIN COUN'I2~, MINNESOTA RESOLUTION Date: March ,2003 Resolution No. Motion By Seconded By RESOL~ON APPROVING CONVEYANCE OF EDA PROPERTY TO THE CITY WHE~AS, the City of Chanhassen ("City") is in the process of plaiting SCHNEIDER PARK SECOND ADDITION; and WHEREAS, one parcel of land that will be part of this plat is legally described as Lot 1, Block 2, SCHNEIDER PARK (the "Subject Propezty"); and WHEREAS, title to the Subject Property is in the name of the Housing and Redevelopment Authority in and for the City of Chanhassen ("HRA'); and WltEREAS, by Resolution 97-29, adopted April 28, 1997; the City mated an Economic Development Authority ("EDA") and tmnsfenexl to the EDA all activities, programs, operations and authority of the HRA; and WltlZ. REAS, to facilitate the platting process, the EDA proposes to convey the Subject Property to the City; NOW, BE IT RESOLVED that the EDA hereby conveys the Subject Property to the City. BE IT FURTHER RESOLVED, that the EDA hereby authorizes its Chairman and Executive Director to execute all documents necessary in the opinion of legal counsel to quit claim the Subject Property to the City.
