City Council approval requires a simple majority vote ofthe City Council present." BACKGROUND Staff and City Council reviewed the proposed 2009 Street Improvement Project areas at the October 13,2008 work session. City Council authorized the preparation of the 2009 Street Improvement Project Feasibility Study at the October 27,2008 City Council meeting. The first neighborhood open house was held on November 12,2008. Over 27 property owners attended. At the January 12,2009 meeting, City Council accepted the Feasibility Study and called the public hearing. A neighborhood open house was held January 21, 2009. The purpose of the public hearing is to determine if the project should advance to construction. The public hearing is not for finalizing the assessment methodology or the amounts. The street segments within the proposed project were identified by the City's Pavement Management software in conjunction with site investigations. Proiect Area #1: Urban Residential The proposed improvements generally consist of milling and overlaying the pavement surface, removal and replacement of severe pavement distresses and minor drainage improvements. Draintile is included in various areas along the street to pick up residential sump pump water discharge and reduce the amount of groundwater in the street subgrade. Reducing the amount of groundwater in subsoils increases the pavement strength and reduces the likelihood of pavements heaving because of frost. Project Area # 1 b: Urban Residential (Medium Density) The original project proposal included the installation of sidewalks connecting the east-west segment of Kerber Boulevard to the north-south segment of Kerber Boulevard. The entire cost of the sidewalk installation was proposed to be assessed to the medium density properties within the project. There was opposition to this proposal at the November lih open house, therefore staff sent out a ballot to the residents within the medium density area of the project. Over half of the Paul Oehme January 26,2009 Page 4 of9 ballots were returned, and 89% of those who responded did not support the installation of sidewalks, therefore the installation of sidewalks is no longer proposed with this project. The estimated cost for improvements within the urban residential project area is $625,190. Consistent with past practice it is proposed that 40% of these costs be assessed to the adjacent benefitting properties. Staff proposes to split the project area in two for assessment purposes since the twinhomes and quadhomes are higher density. Based on this assessment methodology, the estimated assessments are: Proiect Area #la: Low Density Estimated project cost: $211,314.23 40% assessed: $84,525.69 Number of assessable units: 59 Estimated unit assessment: $1,432.64 Proiect Area #1 b: Medium Density Estimated project cost: $413,875.77 40% assessed: $165,550.31 Number of assessable units: 261 (includes 7 units for Meadow Green Park) Estimated unit assessment: $634.30 Proiect Area #2: Rural Residential !' _.'; , L ....' The proposed improvements in this project area include full depth milling and paving of the streets. Removal and replacement of the poor street sub grade areas is also proposed. Residents at the end of Lakota Lane requested that the area of the cul-de- sac be increased. Currently, the pavement area of the cul-de-sac is only approximately 40 feet in diameter which requires a passenger vehicle to make a three-point turn to turn around. Staff proposes that the project incorporate the construction of a standard 90-foot diameter cul-de- sac at this location, including the necessary right-of-way acquisition. The estimated cost of these improvements is $145,845. Consistent with past projects staff proposes to assess 40% of the improvements to the 24 benefitting property owners. Based on this assessment methodology the estimated assessment in this project area is $2,430.75 per unit. Staff is working with the Twin Cities and Western Railroad to replace the railroad crossing on West 78th Street east of Highway 101. The City's estimated share of the crossing replacement is $30,000 and is included in the construction cost estimate for the commercial-industrial street project. The original proposal presented to City Council in October, 2008 included directionally boring a replacement sewer force main within 77th Street. Subsequently, in November, 2008 there was a break in the watermain within 77th Street. Given the condition of the exposed watermain, staff requested funding to replace the watermain within 77th Street using the directional bore process. Once funding was granted, staff felt that the utility improvements within 77th Street should be bid separately from the 2009 Street Improvement Project, therefore, the replacement of the sanitary sewer forcemain within 77th Street is not proposed under this project. The estimated cost for the street improvements within this project area is $315,525. Consistent with past projects 40% of the street costs are proposed to be assessed to the 16 benefitting properties. A portion of this road lies within the City of Chanhassen, specifically the western lane between the northern Chanhassen City Limits to Highway 5. The City of Eden Prairie estimates that Chanhassen's share of the overlay cost is $75,000. The only property with access to this segment of Dell Road is 7770 Dell Road. This property is included in the assessment roll for the commercial-industrial project and is therefore not proposed to be assessed for the Dell Road improvements. The Dell Road mill and overlay is proposed to be paid entirely through City funds and is therefore not included in the proposed assessment roll. The project also includes the rehabilitation ofthe trail on the north side of Highway 5 between Highway 101 and Dell Road and miscellaneous sidewalk and curb repairs throughout the City. The cost of these improvements is estimated to be $100,000 and will be paid with City funds. FUNDING The Engineering staff prepared the feasibility report. Staff proposes to prepare the construction plans and documents and perform the construction observation for the project. The benefit of completing this work in-house represents $85,000 to $100,000 in savings for the project. Forty percent (40%) of the street rehabilitation cost will be assessed to the benefiting property owners. The remainder of the project cost will be paid from the storm sewer enterprise fund and revolving street assessment account. There is a 30+ stall parking lot in Meadow Green Park with two accesses to Pontiac Lane. Based on the park's frontage to Pontiac Lane and the average frontage of the twinhome lots to the north and east, it is proposed that the park be assessed for seven (7) medium density units. There are two City-owned properties within the Commercial-Industrial assessment area. The northeast portion of 100 West 78th Street contains a stormwater pond; the remainder of the lot is vacant. The other property, PID 019-251970010 is vacant. West 78th Street between Highway 101 and Dell Road has only one-sided benefit, meaning that there is only benefitting properties on one side of the street. To off-set the cost of the single-sided benefit it is recommended that these two City parcels be included in the commercial-industrial assessment roll.
