March 5, 2003 Denial of Kennel Permit - Loren Veltkamp, 6724 Lotus Trail BACKGROUND Loren Veltkamp has applied for a private kennel permit at his residence located at 6724 Lotus Trail. Community Service Officer Jeff Meixner and Carver County Sheriff Deputies have been called to Mx. Veltkamp's residence on numerous occasions for animal control complaints. After a recent call and citation, he applied for a private kennel permit. This original kennel permit application listed only one animal, while CSO Meixner observed three dogs and one eat when the citation was written. Approximately three weeks aft~ submitting his application, Mr. Veltkamp called City Hall and added three dogs to the application. As of this time he has yet to add the cat to the application. Mr. Veltkamp claims that two of the dogs belong to renters, and that he continually has people renting rooms from him with frequent turnover. After receiving this application, it was published in the Chanhassen Villager on February 6, 2003, as required by City code. No comments were received in the required mn-day period. Recently a tenant has moved into his residence and brought three pit bull dogs. This week there was an incident where two of the pit bulls attacked a fellow renter and caused severe bites to the arm, causing a trip to the emergency room. As required by City code, these dogs have been impounded for a period of ten days. These animals were not licensed in the City of Chanhassen at the time, nor were they listed on the private kennel application. It should also be mentioned that Mr. Veltkamp has criminal charges pending against him, which should have no bearing on the kennel application. This is only mentioned because Mr. Veltkamp has stated in the past that the actions against him by the City of Chanhassen and the Carver County ShefiWs Department are related to these charges and that he is being unfairly targeted. Attached to this report is an incident report from December 18, 2002, copies of the kennel applications, pertinent City code sections, call log for this address since August 2001, and citations recently issued to Mr. Veltkamp. RECOMMENDATION Due to the consistent animal control complaints at this residence, as well as the apparent inability of Mr. Veltkamp to control and monitor the ~ at his residence in a neat, orderly, and safe condition, it is staff's recommendation that this application for a private kennel permit be denied. Council should be aware that even if this application is denied, Mr. Veltkamp can still have animals at his residence without a kennel permit as long as he does not have more than two dogs or a combination of four dogs and cats over six months in age, as permitted in City code. (Ord. No. 24-C, § 14, 7-12-76) Sec. 5-18. Kennel license. (a) No person shall m,lntain a private or commercial kennel in the dty without securing a license therefor from the city council. The fee for the license shnll be as established by resolution. No license shall be required for a private kennel consisting of cats, if the kennel is located on a tract or parcel of land being used for agriculture as that term is defined in the zoning ordinance, and if the cats are kept for rodent control' purposes inddent to the agricultural use of the tract or parcel of land. (b) Kennel licenses shall expire on the April 30 next following their iss-~-ce. Upon application for renewal of a kennel license, an authorized dty employee shall inspect the kennel of the applicant. The employee shall submit to the dty clerk either an nt~rmative certification that the kennel is mnintained in a neat, orderly, and safe condition, or a negative certification that said kennel is not so m~intained. The city clerk may issue a renewal kennel license provided that~ (1) The certificate is -m~m-tive; and (2) No complaints have been received by the city. In all other cases, the kennel license shall be renewed only upon city council approval. (Ord. DETAILS: On 12/18/02 I, Community Service Officer JeffMeixner #763; received a call at approximately 1655 hours to respond to the complainant's address for a dog at large complaint. I eventually made contact with the complainant, Pat Gun, on by phone. Cmnderson stated that she had been having problems with a neighbors dog being at large numerous times and that she was afraid, of the dog. Gunderson explained that a "pit bull" residing at 6724 Lotus trail had been at large most recently at approximately 1630 hours and attacked her dog. Gundemon stated that there were no visible injuries to her dog but she felt afraid of the "pit bull" and feared further instances. It should be noted that on 12/16/02, Deputy Walgrave and I responded to another complaint-of the same dog being at large earlier in the day. (ICR 02-31059) In that incident I was able to make contact with Mr. Veltkamp, and advised him of the pertinent animal ordinances. He stated that the dog belonged to a renter but would not provide me with the renter's information. Deputy Walgrave and I also observed the "pit bull" off of Veltkamp's property without restraint. The dog was wearing a muzzle but it was not properly secured. I had previously spoken to Gunderson on 11/25/02 regarding this dog and similar circumstances. In that case I responded to Veltkamp's residence and left a written notice of animal ordinances. ICR #02-31079 In the notice I advised Veltkamp to register all dogs and cats residing on his property, secure a kennel permit since it was reported to me that there are at least three pets on the premises, and advised against allowing pets to be at large. Additionally on 12/06/02, I impounded Veltkamp's cat and issued citation number 114036 (iCR #02-30883) for animal at large, no animal license, and no kennel permit. At this time I still have not received a kennel permit application or animal registrations.
