The existing sewer main in Qnirm Road would havc to be extended appw~y 700 feet to serve the home at 8905 Qnirm Road. While the~ is sanitary sewer in Lymsn Boulevard, a large wetland exits on th~ south side oftbe applicant's pwperty between the house and Lymsn Boulevard. In order to preserve the wetlsn~ sanitary sewer for the ~.a has been planned to come from Qnirm Road. The extem/on of utih'ties to this area has nothing to do with the TH 312 project as allud~l to by the spplicant. In this cssc, as with th~ situation two ye~crs ago at 8955 Quinn Road~ it is the spplicsm's failing septic system that would trigger the utility extension. OPTIONS There m'e other options to the variant. One option is to replace the am'e~ failing septic syst~ with a new one. Tbe new syste~n would be required to meet to the property. This could e/ther be done by the at~licant as a private development project or the applicant could petition tbe City to extend the sewer as part of a public im.m-oveme~ project. The City would then assess thc cost of the project to all benefiting property owne~. RECOMb NDED cora)moNs oF, ov, a, 1. We would recommend denial of the requested variance for the following reasons: 1. Section 19-70 (a) (5) of your City Ordinance'clearly states the seller or buyer, not solely the seller, of a Falling System that is not an Imminent Threat to Public Health or safety must have the sewage systom upgraded to a complying system within three years of the date of the corr~ InspaclJon. The compliance Inspection report for the subject property Indicates the system was determined tobe Falling on 12/5/99;.. therefore the system should have been replaced by 12/5/2002. 'rTie ctrmnt owners ass .umed this' . responsibility when they purchased the property and It Is Incumbent upon them, or their, age~ acting'on their behalf, to know and comply with City requirements applicable to properly' tmnsfem.. We require the same.for property transactions within County Ordinance Jurisdiction. 2. The starting and completion dates for the pending Hwy 312 project Is unknown, therefore It Is unrealistic for any party Involved to assume municipal sewer and water services wtll be extended to the property 'soon'. 3. The Compliance InspactJon report Indicates the system status Is Falling based upon lack of verlJcal separation In the dmlnfleld; this means the system 18 falling to adequately treat the sewage effiuant entering the dmlnfletd. The fact the system was not designated an Immlnant Public Health Threat does not mean It is 4. The homeowner rites a section of Minnesota Rules 7080.0305, which refers to a variance to the required three (3) feet of vertical separation. We were unable to find this cttatlon in ~ current Minnesota Rules Chapter 7080; we did find It In an outdated version. The current Minnesota Rules 7080.0305, Subp. 3B. variances states that less restrictive verlJcal separation Is allowed If the requirements of Minnesota Statutes, sec~on 115.55, subdivision 7, am met or If the requirements In part 7080.0179 am met.
