attending this meeting so I can report 6.,',Q:tije'Coordinating Committee. The notice

It just so happens that the Coordinating Committee is scheduled to meet the day after the
above-mentioned public forum. Therefore, I have been asked to include this topic on the
agenda given the timeliness of the subject matter. This memorandum along with the
accompanying materials are intended to help with this discussion. Included in these
materials are a sampling of social host ordinances in other communities.
I am a strong supporter of the need for a social host ordinance. It fills a gap in state law
that otherwise makes it difficult to hold individuals accountable for providing a haven for
underage drinkers. Ideally, it would be best if statewide legislation was enacted rather

than having to address the problem through a piecemeal of local or county ordinances.
This is unlikely to happen soon, given the current preoccupation among state officials
with the massive budget deficit. This puts the onus back on city and county officials to
fill this void.
Absent any real interest among Hennepin County Commissioners to enact a social host
ordinance countywide, I am advocating the cities in the SLMPD service area move ahead
with a common ordinance of their own. The Coordinating Committee would be the most
appropriate place to start this process. The details could then be worked out through the
Operating Committee with direction from legal counsel. Department Attorney Ken Potts,
Who also does prosecutions for three of the four cities in our service area, has expressed
his support for such an ordinance if crafted properly. The goal would be to come up with
a uniform social host ordinance that can be supported by all four City Councils.
As previously indicated, this item of business has been placed on the agenda for the
Coordinating Committee Meeting on Wednesday, January 28,2009.

Dear Mayor Ruehl,
We are writing to invite you to an informational presentation and dialogue about efforts to
address underage drinking in our community, with a focus on Social Host Ordinances. We would
also like you to extend this invitation to others as you deem appropriate: Suggested attendees
would include members of your city council, police chief, city manager and in some cases, city
attorney.
A number of communities in Minnesota, including Apple Valley, Chaska, Lakeville and Willmar
have recently passed such ordinances in an effort to curb underage drinking. Underage drinking
poses many risks to the young people who engage in it. In fact, a 16 year old is more likely to die
from an alcohol-related cause than from any other.
Please join us and other community leaders on the evening of January 27, 2009 from 6:30 - 8:30
PM at the Minnetonka Community Center for a discussion of this important issue. The forum
will be hosted by Hennepin County Commissioner-elect, current Mayor of Minnetonka, Jan
Callison. Representatives from the cities of Chaska and Lakeville will be there to talk about their
reasons for enacting Social Host ordinances and their experience in enforcement. Staff from the
ronka CARES Coalition (serving the communities of the Minnetonka School District), and the
One Voice Coalition (serving the Hopkins school district) will present information about
underage drinking in our communities and their current efforts to address the issue. Following
the preSeIitation, a facilitated.discussion will help us identify the pros and cans of SOGial host
ordinances in our communities, and determine any next steps.

A Message from the Mayor
Protecting the Safety and Health of Kids
It was 19th century political reformer and speaker Henry Beecher who said "the laws that are the most
operative are the laws which protect life." I would only add that the laws which protect kids are even more
essential. That is why I believe our City Council's unanimous approval of a social host ordinance at our last
meeting this year was so important. It is without question designed to protect kids, and I'm proud that Prior
lake became the first municipality in Scott County and the 16th in Minnesota to adopt a social host
ordinance.
I want to first clarify that a social host ordinance does not make it against the law to furnish alcohol to
individuals under age 21. That was against the law before the council acted. This ordinance makes it
unlawful to provide an environment where underage drinking takes place. It addresses how a typical person
ought to behave when there is potential harm to those under the legal age to drink. As a misdemeanor, any
adult host found criminally responsible of violating the social host ordinance will face a penalty of time in jail
and up to $1,000 in fines. .
Some may question whether such an ordinance is needed in our community. Well, according to the National
Institute of Alcohol Abuse and Alcoholism (NIAAA), people who began drinking at a young age are three
times more likely to get hurt in a car or alcohol-related accident and that alcohol can be a gateway to many
other problems. locally, about 40% of ninth-grade students in Scott County and about 70% of 12th graders
indicate they have used drugs and alcohol.
The city council is not in the business of parenting. That is not what this ordinance is all about. The
ordinance does not affect a parent's right to allow their own children to consume alcohol in their home as
presently provided under the law. It's about reducing underage alcohol consumption, keeping impaired
underage drivers off of our streets and creating a safer and healthier environment in Prior lake.
The social host ordinance is also consistent with our 2030 Vision and Strategic Plan's Safe and Healthy
Community vision element calling for "formal and informal efforts to facilitate a safe, livable and healthy
community for all persons."
By the Community, For the Community
The idea of a social host ordinance was brought before the City Council about 13 months ago right after the
City of Chaska approved one in their community. At that point, we deferred it to our newly forming
Community Safety Task Force. The council and I wanted the process to evolve with citizen involvement
within a citizen's group and have broad community support.
The Community Safety Task Force was a group of about 45 citizens charged with finding the major issues
facing Prior lake relating to health and safety. After the task force's work was complete, it recommended a
social host ordinance be sent to the city council through the Community Safety Advisory Committee, an
ongoing group of five citizens who research and recommend action related to keeping Prior lake safe and
healthy.
Now that Prior lake has a social host ordinance in place, the council would like to increase its effectiveness
by using it as a model for the broader Scott County community. I will be taking this information to the Scott
County Association for leadership and Efficiency (SCALE) in an attempt to garner support from the county's
elected officials and administrators. Hopefully, Prior lake can provide the leadership and influence
necessary to get social host legislation enacted beyond our boarders, ensuring that our larger community
continues to be a wonderful place to call home.

Chaska city council passes social host laws with
a positive ripple effect
In September of 2007, the city of Chaska passed the
first ordinance in Minnesota that holds "party" hosts
criminally liable for underage drinking on their
properties - even if they don't provide the alcohol.
Chaska now joins dozens of municipalities in at least
20 other States that have social host ordinances. The
Chaska City Council's unanimous decision came
after more than a year and a half of advocacy by
Chaska City Police Chief Scott Knight. Knight, who
has also been working with Carver County Sheriff
Bud Olson to pass a county ordinance, increased his
efforts after Sean Humphrey, 19, froze to death in
Chaska after a night of heavy drinking at a party. The
new city law, similar to the county proposal, makes it
a misdemeanor for a property owner or host to
knowingly allow underage drinking. The passage is a
victory. In some rural parts of the county, throwing a
graduation party where minors drink is considered
acceptable according to Carver County
Commissioner Randy Maluchnik. Although residents
in his district - which includes the cities of Carver,
Victoria and Chaska - have generally supported the
ordinance, residents in some other commissioners'
districts have not, he said. Chaska's ordinance does
provide exceptions. For example, it "does not apply
to conduct solely between an underage person and
his or her parents while present in the parents'
household;" and it does not apply to legally protected
religious observances. A main concern heard was
that a parent out of town during the party would be
held liable. That concern was addressed in that the
law's language protects those adults as it states that
the person must "knowingly" provide the venue.
Parents are therefore not culpable in that example."
Chaska's social host law carries with it possible
penalties of up to 90 days in jail and a $1,000 fine.

has been a useful tool for the police. Because of their
persistence other communities in the State are using
Chaska's ordinance as a template for their own
efforts - many with successful results. For example,
Mankato passed its social host ordinance in
November 2007, Fairfax adopted theirs in December
2007, Waseca recently passed one in March 2008;
and Prior Lake and Blue Earth County are now
considering one. To date, a total of nine
municipalities across the State have instituted social
host ordinances. Chaska's Police Department Chief
Knight has noted that the social host ordinance has
turned out to be a "very effective" and "very easy to
implement tool" for his department; he said "our
officers saw a void in the lack of tools to prevent
underage drinking". Knight now believes they have
covered that gap and are starting to see results in the
community.

Q: What is the Social Host Ordinance?
A: The proposed Social Host Ordinance would hold
individuals (social hosts) criminally responsible for.
hosting or allowing an event on private or public
property where persons under age 21 possess or
consume alcohol, regardless of who supplied the al-
cohol to the minors.
This ordinance applies to situations in which:
· The social host knows or reasonably should know
that alcohol is being possessed or consumed by underage
persons at their residence or premises or at any event they
are hosting on public or private property.
· The social host fails to take reasonable
steps to prevent possession or consumption by
the underage person or persons.
Under this ordinance, the social host does
not have to be present at the party, event or
gathering to be criminally responsible.
Q: Why is the ordinance being proposed?
A: Alcohol is the drug of choice of youth, and alcohol-
related incidents are a . leading cause of death among
teenagers. Alcohol use can lead to traffic accidents, fa-
talities and property loss, assaults, accidental overdose
and suicides. Research shows people who begin drink-
ing alcohol as adolescents are more likely to become
chemically dependent.
The Minnesota Student Survey indicates underage
youth obtain alcohol at parties. Currently in Carver
County, an individual can be charged with furnishing
alcohol to an underage person, and individuals under
age 21 can be charged with possession or consumption
of alcohol. What often happens is law enforcement of-
ficers will arrive at a party in which underage youth are
drinking alcohol, but they will be unable to determine
who provided the alcohol. This ordinance will allow
law enforcement to charge the individual who hosts the
underage drinking party.
The hope is that imposing criminal responsibility on
hosts will have a deterrent effect and reduce the number
of underage drinking parties and underage drinking.
Q. How will the ordinance be enforced, and
what are the penalties?
A: If enacted, the ordinance will be enforced by the
Carver County Sheriff's Office and the Chaska Police
Department. Violation of the ordinance will be a mis-
demeanor subject to a maximum penalty of 90 days in
jail and/or a $1,000 fine.

Q: Will I be held responsible if I am away
for the weekend and my kids have a party
at my home or if a young person sneaks
beer out of my refrigerator or cooler?
A: Parents will not be criminally responsible if they
did not know about the party. If the parents knew about
the party or gathering, knew that underage drinking
was occurring and did nothing to prevent it, they will
be criminally responsible. A host is not criminally re-
sponsible if a youth sneaks alcohol that is available for
adults at a event or gathering unless the adult has indi-
cated that it was OK for the underage person to do so.
Q: How can I voice my opinion?
A: There will be a public hearing on the Social Host
Ordinance at 9 a.m. on Tuesday, Aug. 28, in the County
Board Room of the Carver County Government Center.
Carver County residents are invited to fill out the Social

Cities adopting social host ordinance at rapid speed

About 16 months ago, Chaska became the first Minnesota city to enact a social host ordinance.
The popularity of the ordinance, which makes it illegal for anyone to knowingly provide a venue
for underage drinking, has since exploded in the state.
At least 18 Minnesota cities have now passed the ordinance, three in December alone -
Rosemount, Albert Lea and Prior Lake.
Carver County voted 3-2 against the ordinance in late 2007, so Kandiyohi County, which passed
its ordinance shortly before Chaska, is still the only Minnesota county with the law on the books.
City officials, from "near and far," have since contacted Chaska Police Chief Scott Knight, and
requested copies of the city's ordinance, when considering their own social host ordinances. He
was late for a recent interview on the topic because he was discussing the law with an interested
official in Steamboat Springs, Colo. Chaska Police Officer Rob Stock recently spoke about
Chaska's ordinance with Albert Lea City Council, which passed it.
At risk
Word is now out on the street that underage party hosts can be charged, Knight said.
"We are not seeing as many," he said. "They know that they are now at risk, that we have a tool
to hold them responsible."
Carver County Attorney Jim Keeler notes that the ordinance addresses a gap in the law. 4'While
you may not have someone furnish [alcohol], you may have someone present, and acquiescent in
ajuvenile's drinking alcohol," Keeler said.
Keeler also believes publicity about the ordinance is helping curb underage drinking.
"The fact that in the city of Chaska this ordinance violation is on the books, and there has been
an increase in public awareness of the problem, I think helps law enforcement and prosecutors in
combating teenage drinking," Keeler said. "People know they can be held liable for knowingly
providing a place where juveniles can consume alcohol illegally."
Since Chaska passed the ordinance, 13 individuals have been charged with violating the
ordinance, and 10 faced some sort of consequences, according to the Chaska Police Department
and Carver County court records.

Of those charged, three were juveniles. And of the adults charged, except for a 52-year-old man,
all were between the ages of 18 and 23.
Pleaded guilty
Of the adults charged, only three were charged solely with violating a social host ordinance.
Typically, they also faced charges of providing alcohoIto a minor, or other alcohol/drug-related
charges. (See adjoining chart.)
A social host violation would be considered a misdemeanor, similar to underage consumption.
Providing alcohol to a minor is a gross misdemeanor. Defendants usually pleaded guilty to the
charge of the social host ordinance, with the other charges being dismissed.
In cases where someone was charged both with furnishing alcohol to a minor and a social host
ordinance, but pleaded guilty to the lesser charge of social host, it may have been an "an
evidentiary issue," Keeler said. If prosecutors can't prove a defendant purchased the alcohol, they
may be able to prove a homeowner or renter was present, he said.
"Prosecutors seek to prove and prosecute the most serious charge [but that's] not always
possible," Keeler said.
For those convicted, fines ranged up to $282.
Kandiyohi
The Kandiyohi County Board passed the ordinance in August 2007. Like Knight, Kandiyohi
County Sheriff Dan Hartog believed it would serve as a tool to use with underage parties.
"If we could show that the person that was hosting the party knew that there were underage
people there, it would be something to use to get the party broken up and get kids out ofthere,"
Hartog said.
Kandiyohi passed the ordinance unanimously. Unlike Carver County's drafted ordinance,
Kandiyohi's ordinance only applies to county jurisdiction, outside of city limits, Hartog said.
Currently there are two social host cases pending in the county court system, "so we'll see what
happens with that," Hartog said.
Party parents?
When the Carver County Board initially reviewed the ordinance, one of its concerns was the
liability of parents who didn't know a child was hosting a party in their own home. So the board
revised the ordinance to target those who "knowingly" provide a venue for underage drinking.
The same wording is used in the Chaska ordinance.
However, so far, those charged don't fit the scenario of the prosecuted parent. Most were charged
with hosting parties for their own age group. Only one person charged with the crime was a
parent. However, he was also was charged with purchasing alcohol for minors.

"The whole thing about unsuspecting parents being charged unfairly certainly doesn't appear to
be the case so far," Keeler said. Regardless, when making the decision to charge someone,
prosecutors consider whether they are a "victim of circumstances," Keeler said, adding, "We
make t.nose judgments all the time."
"It's a bit of a red herring," Keeler said of the argument.
Ordinance evolution
According to Knight, Patrol Officer Greg Reinhardt had approached him and said, "Chief, there's
a gap in the law. This is what it is." Knight approached then-County Attorney Mike Fahey, who
drafted an ordinance, which was then brought to the Carver County Board.
Carver County commissioners wrestled with a proposed social host ordinance for several months
in 2007 before scrapping the idea of a countywide ordinance on a 3-2 vote.
Meanwhile, Chaska went ahead and passed the ordinance. Officials often cited the February 2007
death of Sean Humphrey as rationale for the law. Humphrey, 19, died due to hypothermia and
acute alcohol intoxication, according to a medical examiner.
Two Chaska residents who allegedly threw the party Humphrey attended, and faced
misdemeanor charges of providing alcohol to a minor, had charges dismissed. Had the social host
ordinance been in effect, the prosecutor beli~ved it would have applied to the duo.
"[The ordinance] was in the works well before Sean Humphrey, but it certainly pointed out the
absolute need for such an ordinance," Knight said.
County hesitant
Commissioners expressed interest in monitoring Chaska's ordinance to see whether it would be
worth implementing at the county level in the future. Commissioner Randy Maluchnik, who
represents Victoria and a portion of Chaska, said last month he'd consider bringing the ordinance
back for discussion, but he's waiting for more data that would clarify whether social host
ordinances reduce underage drinking. If the data does indicate a reduction, Maluchnik said he
would like the county to reconsider an ordinance.Maluchnik and Commissioner Gayle Degler,
who represent parts of Chanhassen and Chaska, voted in favor of a countywide ordinance in
2007.
But there is not a groundswell to bring the issue back to the county board table. Commissioner
Tom Workman said last month that the social host ordinance wasn't a high priority for him.
Commissioner Jim Ische reiterated a stance he took in 2007 and said if the ordinance is
worthwhile it would be better to be considered at a statewide level rather than a city-by~city or
county-by-county basis.
It's not an argument Knight agrees with.
"People will use the argument there should be a state law. Well often those people say that the

state has no business telling us how to run our political entity. .. This is a fall-back, 'The state
should handle this, not us,' which 1 think is an abdication of responsibility."
The city of Chaska attempted to partner with Carver County on the social host law, Knight said.
However, when it became clear that wasn't going to happen, "I wasn't going to wait any longer."
He brought the ordinance to the Chaska council, which passed it.
Keeler ultimately hopes the ordinance will be statewide.
"I think that prosecutors are generally in support of any effort to combat underage dinking, but
we recognize that doing it as a city or county-ordinance level is probably not the most effective,
because you tend to have a patchwork network," Keeler said.
"Most prosecutors support the idea of social host liability. [They] believe it should be in the form
of a state statute. Ifwe're going to prohibit this behavior, do it statewide so you have uniformity
throughout the state," he said. "I do believe that if we're going to have social host liability, and it
is appropriate, the most effective way to inform citizens would be by way of a state statute, rather
than leaving it to municipalities and the counties."
Legislature
With the budget crisis, a statewide social host law this year would be unlikely, according to
Minnesota Rep. Paul Kohls, who represents western Carver County, and part of Chaska, in the
Legislature. Kohls serves on the Public Safety Committee, which reviews proposed bills.
"The budget's going to drive anything, and adding new crimes increases court costs and
increased cost of public defenders," Kohls said. "So 1 think any new category of crimes is going
to start off on the wrong foot in the fiscal situation we find ourselves in," Kohls said.
Kohls notes that he's sponsoring a bill that puts third-time violent offenders in prison without the
possibility of parole - something that will be a "huge challenge," given the economic climate.
Not too many constituents have told him their opinion of the social host ordinance, Kohls said.
Before he took a position, Kohls said he'd need to review data collected from cities that have
passed the social host ordinance.
"I don't see myself doing it, at least not this year," he said.
If the Minnesota Legislature took on the social host ordinance, it wouldn't be the first time cities
acted first, leading a groundswell of state support.
Jennifer O'Rourke, a lobbyist with the League of Minnesota Cities, gave a couple of examples
where city activity pushed the state Legislature - notably the recently passed smoking ban. She
also notes how the city of Austin regulated the purchase of pseudoephedrine products, a key
ingredient in methamphetamine. The state of Minnesota later followed suit.

Chaska city council passes law making party hosts liable for
underage drinking

Chaska has a new target in its fight against underage drinking: the party's host.
The City Council Monday night unanimously passed a law that makes people criminally
liable for allowing underage drinking on their property - even if they don't provide the
alcohol.
It's the first ordinance of its kind in Minnesota.
Chaska is moving ahead with the law because city officials are concerned that Carver
County won't. The county has been discussing the same ordinance since July but hasn't
taken action on it.
"Frankly, we're tired of waiting," said Chaska Police Chief Scott Knight. "This needs to
happen, and it needs to happen now."
When Carver County was first set to discuss the law, County Commissioner Randy
Maluchnik guessed that it would pass unanimously within the month.
But at Monday night's council meeting, he expressed concern that it would ever pass. He
explained it as "a cultural thing."

considered acceptable, Maluchnik said. Although residents in his district -- which includes
Carver, Victoria and Chaska - have generally supported the ordinance, some other
commissioners' residents have not, he said.
At an August board meeting, County Commissioner James Ische said parents had told
him that they'd prefer their children drink in their homes, "where they have control over
the situation... rather than have them going out on the roads."
Chaska's ordinance, which has the same wording as the one Carver County is
considering, does provide exceptions. For example, it "does not apply to conduct solely
between an underage person and his or her parents while present in the parent's
household."
And it doesn't apply to legally protected religious observances.
Some parents also have been concerned that if they were to take a trip to Florida and
their kids threw a party in their absence, they would be held liable, said Council Member
Jay Rohe.
The law's language protects them from that, Knight said, as it states that the person must
"knowingly" provide the venue. "Of course the parents are not culpable [in that example]."
Right now, the county can charge people for providing alcohol to minors, which only
happens in some cases and can be tough to prove, said Janet Barke Cain, assistant
county attorney and head of the office's juvenile division.
When it comes to hosting the party, "the law is silent," Knight said. "This is one of those
'Aha!' moments. Of course there is a gap in the law, and of course this would solve it."
Chaska's social host law carries with it possible penalties of up to 90 days in jail and a
$1,000 fine. Carver County has been exploring alternative punishments, such as
restorative justice programs.
The county has been designing the social host ordinance for more than a year and a half.
Earlier this year, Sean P. Humphrey, 19, froze to death in Chaska after leaving a party
where he was given alcohol by an adult.

SOCIAL HOST ORDINANCE
This ordinance prohibits, and establishes penalties for, any person hosting an
event or gathering where alcohol is present and being possessed or consumed
by persons under twenty-one (21) years of age.
Be it enacted by the Chaska City Council, as follows:
Subd. 1. Purpose and Findings. The Chaska City Council intends to
discourage underage possession and consumption of alcohol, even if done within
the confines of a private residence, and intends to hold persons criminally
responsible who host events or gatherings where persons under 21 years of age
possess or consume alcohol regardless of whether the person hosting the event
or gathering supplied the alcohol. The Chaska City Council finds that:
(a) Events and gatherings held on private or public property where alcohol
is possessed or consumed by persons under the age of twenty-one
are harmful to those persons and constitute a potential threat to public
health requiring prevention or abatement.
(b) Prohibiting underage consumption acts to protect underage persons,
as well as the general public, from injuries related to alcohol
consumption, such as alcohol overdose or alcohol-related traffic
collisions.
(c) Alcohol is an addictive drug which, if used irresponsibly, could have
drastic effects on those who use it as well as those who are affected
by the actions of an irresponsible user.
(d) Often, events or gatherings involving underage possession and
consumption occur outside the presence of parents. However, there
are times when the parent(s) is/are present and, condone the activity,
and in some circumstances provide the alcohol.
(e) Even though giving or furnishing alcohol to an underage person is a
crime, it is difficult to prove, and an ordinance is necessary to help
further combat underage consumption.
(f) A deterrent effect will be created by holding a person criminally
responsible for hosting an event or gathering where underage
possession or consumption occurs.
Subd.2. Authority. This ordinance is enacted pursuant to Minn. Stat. S145A.05
subdivision 1.
Subd. 3. Definitions. For purposes of this ordinance, the following terms have
the following meanings:
(a) Alcohol. "Alcohol" means ethyl alcohol, hydrated oxide of ethyl, or
spirits of wine, whiskey, rum, brandy, gin, or any other distilled spirits
including dilutions and mixtures thereof from whatever source or by
whatever process produced.
(b) Alcoholic beverage. "Alcoholic beverage" means alcohol, spirits,
liquor, wine, beer, and every liquid or solid containing alcohol, spirits,
wine, or beer, and which contains one-half of one percent or more of
alcohol by volume and which is fit for beverage purposes either alone
or when diluted, mixed, or combined with other substances.
(c) Event or gathering. "Event or gathering" means any group of three or
more persons who have assembled or gathered together for a social
occasion or other activity.
(d) Host. "Host" means to aid, conduct, allow, entertain, organize,
supervise, control, or permit a gathering or event.
(e) Parent. "Parent" means any person having legal custody of a juvenile:
(1) As natural, adoptive parent, or step-parent;
(2) As a legal guardian; or
(3) As a person to whom legal custody has been given by
order of the court.
(f) Person. "Person" means any individual, partnership, co-partnership,
corporation, or any association of one or more individuals.
(g) Residence or Premises. "Residence" or "premises" means any home,
yard, farm, field, land, apartment, condominium, hotel or motel room,
or other dwelling unit, or a hall or meeting room, park, or any other
place of assembly, public or private, whether occupied on a temporary
or permanent basis, whether occupied as a dwelling or specifically for
a party or other social function, and whether owned, leased, rented, or
used with or without permission or compensation.
(h) Underage Person. "Underage person" is any individual under twenty-
one (21) years of age.
Subd. 4. Prohibited Acts.
(a) It is unlawful for any person(s) to;
(1) host or allow an event or gathering;
(2) at any residence, premises, or on any other private or public property;
(3) where alcohol or alcoholic beverages are present;
(4) when the person knows or reasonably should know that an underage
person will or does
(i) consume any alcohol or alcoholic beverage; or
(ii) possess any alcohol or alcoholic beverage with the intent to
consume it; and
(5) the person fails to take reasonable steps to prevent possession or
consumption by the underage person(s).
(b) A person is criminally responsible for violating Subdivision 4(a) above if the
person intentionally aids, advises, hires, counsels, or conspires with or otherwise
procures another to commit the prohibited act.
(c) A person who hosts an event or gathering does not have to be present at the
event or gathering to be criminally responsible.
Subd. 5. Exceptions.
(a) This ordinance does not apply to conduct solely between an underage
person and his or her parents while present in the parent's household.
(b) This ordinance does not apply to legally protected religious observances.
(c) This ordinance does not apply to retail intoxicating liquor or 3.2 percent malt
liquor licensees, municipal liquor stores, or bottle club permit holders who are
regulated by Minn. Stat. ~340A.503 Subd.1 (a)(1).
(d) This ordinance does not apply to situations where underage persons are
lawfully in possession of alcohol or alcoholic beverages during the course and
scope of employment.
Subd. 6. Enforcement. This ordinance can be enforced by any police officer or
sheriffs deputy in the county.
Subd 7. Severability. If any section, subsection, sentence, clause, phrase,
word, or other portion of this ordinance is, for any reason, held to be
unconstitutional or invalid, in whole, or in part, by any court of competent
jurisdiction, such portion shall be deemed severable, and such unconstitutionality
or invalidity shall not affect the validity of the remaining portions of this law, which
remaining portions shall continue in full force and effect.
Subd.8. Penalty. Violation of Subdivision 4 is a misdemeanor.
Subd. 9. Effective Date. This ordinance shall take effect thirty (30) days
following its final passage and adoption.

Alcohol is the drug of choice for teens and young adults, and alcohol.related incidents are the
leading cause of death for this age group. Alcohol use and abuse often leads to traffic accidents
and fatalities, property damage, assaults, accidental overdose and even suicide. Research shows
people who begin drinking alcohol as adolescents are more likely to become chemically
dependent. The Minnesota Student Survey, excerpts of which will be highlighted at the Council
presentation, indicates that consumption of drinking by teens is a significant issue in Roseville,
as it is in most communities throughout the state and the nation, and that youth often obtain
alcohol at house parties.
Current Law: It is a criminal offense for an adult to furnish alcohol to a minor, and an individual
under age 21 can be charged with possession or consumption of alcohol. If a person is injured
by an underage intoxicated person, the injured person can sue to recover damages for the harm
suffered.
The Problem: It is not currently illegal (a criminal offense) for an adult to allow teens and young
adults (under age 21) to consume alcohol in their homes - it is only illegal for the adult to furnish
the alcohol. Often,. law enforcement is called to the site of a loud party and finds adults in the
home while a teen/young adult party involving alcohol is in progress. If everyone present denies
that the adults furnished the alcohol, the adults cannot be arrested.
The Solution: A Social Host Ordinance would allow law enforcement to charge the individual
who hosts the underage drinking party. Imposing criminal responsibility on hosts will have a
deterrent effect and reduce the number of underage drinking parties and, hopefully, reduce the
numbers of teens and young adults who choose to use alcohol.
Policy:
The proposed Social Host Ordinance would make it a misdemeanor offense for an adult to host
or allow an event at their home or other property if: (1) they know that an underage person is
drinking or in possession of alcohol and; (2) the adult fails to take reasonable steps to prevent
possession or consumption. The adult would not have to be present at the party, event or
gathering to be criminally responsible.

No. Parents will not be criminally responsible ifthey did not know about the
party. If the parents knew about the party or gathering, knew that underage
drinking was going to occur and did nothing to prevent it, they will be crhninally
responsible. A parent is not criminally responsible if a youth sneaks alcohol that is
available for adults at a event or gathering unless the adult has indicated that it
was OK for the underage person to do so.

The Roseville City Council intends to discourage underage possession and
consumption of alcohol, even if done within the confines of a private
residence, and intends to hold persons criminally responsible who host
events or gatherings where persons under 21 years of age possess or
consume alcohol regardless of whether the person hosting the event or
gathering supplied the alcohol. The Roseville City Council finds that:
A. Events or gatherings held on private or public property where alcohol is
possessed or consumed by persons under the age of twenty-one are
harmful to those persons and constitute a potential threat to public
health requiring prevention or abatement.
B. Prohibiting underage consumption acts to protect underage persons,
as well as the general public, from injuries related to alcohol
consumption, such as alcohol overdose or alcohol-related traffic
collisions.
C. Alcohol is an addictive drug which, if _used irresponsibly, could have
drastic effects on those who use it as well as those who are affected by
the actions of an irresponsible user.
D. Often, events or gatherings involving underage possession and
consumption occur outside the presence of parents. However, there
are times when the parent is present and condone the activity, and in
some circumstances provide the alcohol.
E. Even though giving or furnishing alcohol to an underage person is a
crime, it is difficult to prove, and this Chapter is necessary to help
further combat underage consumption.
F. A deterrent effect will be created by holding a person criminally
responsible for hosting an event or gathering where underage
possession or consumption occurs.
509.02: AUTHORITY
This Chapter is enacted pursuant to Minn. Stat. 914SA.OS.
509.03: DEFINITIONS
For the purpose of this Chapter, the following terms shall have the
meanings stated:
A. ALCOHOL: Ethyl alcohol, hydrated oxide of ethyl, or spirits of wine,
whiskey, rum, brandy, gin, or any other distilled spirits including
dilutions and mixtures thereof from whatever source or by whatever
process produced.
B. ALCOHOLIC BEVERAGE: Alcohol, spirits, liquor, wine, beer, and every
liquid or solid containing alcohol, spirits, wine, beer, and which contains
one-half of one percent or more of alcohol by volume and which is fit
for beverage purposes either alone or when diluted, mixed, or
combined with other substances.
C. EVENT or GATHERING: Any group of three or more persons who have
assembled or gathered together for a social occasion or other activity.
D. HOST: To aid, conduct, allow, entertain, organize, supervise, control,
or permit a gathering or event.
E. PARENT: Any person having legal custody of a juvenile:
1. As a natural, adoptive parent, or step-parent;
2. As a legal guardian; or
3. As a person to whom legal custody has been given by order of
the court.
F. PERSON: Any individual, partnership, co-partnership, corporation, or
any association of one or more individuals.
G. RESIDENCE or PREMISES: Any home, yard, farm, field, land,
apartment, condominium, hotel or motel room, or other dwelling unit,
or a hall or meeting room, park, or any other place of assembly, public
or private, whether occupied on a temporary or permanent basis,
whether occupied as a dwelling or specifically for a party or other social
function, and whether owned, leased, rented, or used with or without
permission or compensation.
H. UNDERAGE PERSON: Any individual under twenty-one (21) years of
age.
509.04: PROHIBITED ACTS
A. It is unlawful for any person(s) to;
1. Host or allow an event or gathering;
2. At any residence, premises, or on any other private or public
property;
3. Where alcohol or alcoholic beverages are present;
4. When the person knows or reasonably should know that an
underage person will or does
a. Consume any alcohol or alcoholic beverage; or
b. Possess any alcohol or alcoholic beverage with the
intent to consume it; and
S. The person fails to take reasonable steps to prevent possession
or consumption by the underage person(s).
B. A person is criminally responsible for violating subsection A of this
section if the person intentionally aids, advises, hires, counsels, or
conspires with or otherwise procures another to commit the prohibited
act.
C. A person who hosts an event or gathering does not have to be present
at the event or gathering to be criminally responsible.
509.05: EXCEPTIONS
A. This Chapter does not apply to conduct of an underage person
specifically authorized by his or her parent while present in the parent's
household or when the underage person and his or parent are guests
in the household of another.
B. This Chapter does not apply to legally protected religious observances.
C. This Chapter does not apply to retail intoxicating liquor or 3.2 percent
malt liquor licensees, municipal liquor stores, or bottle club permit
holders who are regulated by Minn. Stat. 9340A.503, Subd. l(a) (1).
D. This Chapter does not apply to situations where underage persons are
lawfully in possession of alcohol or alcoholic beverages during the
course and scope of employment.
509.06: ENFORCEMENT
This Chapter can be enforced by any police officer.
509.07: SEVERABILITY
If any section, subsection, sentence, clause, phrase, word, or other portion
of this Chapter is, for any reason, held to be unconstitutional or invalid, in
whole, or in part, by any court of competent jurisdiction, such portion shall
be deemed severable, and such unconstitutionality or invalidity shall not
affect the validity of the remaining portions of this Chapter, which
remaining portions shall continue in full force and effect.
509.08: PENALTY
Violation of this Chapter is a misdemeanor.
SECTION II: Effective date. This ordinance shall take effect upon its
passage and publication.

In an effort to discourage underage drinking, even when done on private property, the Lakeville Police
Department has drafted a Social Host Ordinance. The ordinance would make adults criminally responsible if they
knowingly organize, supervise, or permit a gathering on public or private property where underage people
consume alcohol, even if they did not supply the alcohol or are not present at the event.
Most often, underage drinking occurs outside the presence of or without the knowledge of parents. This
ordinance applies only to instances where a parent or other adult is either present or condones the activity. This

Enclosed is a summary of work done by the Metropolitan Mosquito Control District (MMCD) in
Chanhassen during the 2008 mosquito control season.
MMCD's region-wide larval control activity prevents billions of immature mosquitoes and biting
gnats from hatching into adults. MMCD also works to prevent Lyme disease by monitoring the
distribution of deer ticks, the carrier of this bacterial infection, throughout the metropolitan area.
Our control work is based on data obtained from adult mosquito traps, annoyance calls and dead
bird reports from citizens, and surveillance of area wetlands and storm water management
structures. MMCD controls adult mosquitoes to reduce disease risk and reduce mosquito
annoyance for outdoor events. The overall result is significantly fewer mosquitoes and gnats
