Request for Claim as a Result of a Sewer Backup, 449
Summerfield Drive, Tom O'Brien
Mr. O'Brien was present at the December 9, 2002, City Council meeting
requesting reimbursement of $15,467.56 for a sewer backup that occurred at his
home at 449 Summerfield Drive on October 9, 2002 (see Attachment 1). The
claim was referred to the city's insurance company, St. Paul Fire & Marine, and
the claim was denied based on the facts that no liability existed on behalf of the
city (see Attachment 2). Also attached are various pieces of correspondence
from Mr. O'Brien (see Attachment #3).
History of Installation and Maintenance in the Summerfield Neighborhood
The Engineering/Public Works Division has reviewed the information
surrounding the sanitary sewer jetting schedule in the Springfield neighborhood.
The following is a summary of that information:
The sanitary sewer main was installed by Nodland Construction. It was
televised by Infratech Technology, Inc. on December 15, 1999. It is
industry standard to jet the pipe prior to televising so that any problem
areas will be readily visible. The report (see Attachment 4) indicates no
debris or problems with the pipe or service wyes at the time of
installation. The tape of the televising shows the pipe to be clean and in
good shape. A copy of the tape is on file in the Engineering Department.
2. The utilities in Summerfield Drive (Springfield 7th) were accepted by the
City on January 11, 2000.

A two (2) year maintenance bond was received from the contractor that
installed the utilities. The bond expired on January 11, 2002. No
problems were experienced during the bond period.
The City sanitary sewer jetting cycle is 3-4 years. Known problem areas,
such as areas with clay pipe or next to fast food restaurants, are jetted
more frequently.

every 3-5 years. The City's guidelines fall within this critea~
The streets in the Springfield neighborhood were jetted in November of
1999. Summea~eld Drive was tn'and new in 1999 and had be~m televised
in August of 1999 so it was known thai the pipes were clean. The
section of Summerfield Drive that experienced the back-up (449
Summerfield Drive) was not accepted by the City f~ ma~~ until
January of 2000.
The Springfield neighborhood is rh,e for jetting again in 2003. This will
be 4 years from the last jetting. Oiven that the pipe is plastic pipe and in
good condition, a 4 year cycle is acceptable and meets the City staadan:ls
for jetling ~cy.
RECOMMF. NDATION
Based on the ~on available, I cannot find any negligence on the part of
the city in either the dedgn or maintenanc~ of the sewer system along
Summerfield Drive. Staff recommends that the City Cotmcil de~y Mr.
O'Brien's claim based on the fact that no liability ~ on behalf of the city and
that Mr. O'Brien continue to work with the St. Paul Companies to resolve his
claim. The city has used St. Paul Companies to administer/manage claims
against the city for many years and I recommend that the Council not deviate
from this practie~

I am in receipt of a letter you received from the City's insurer St. Paul Pire and
Marine Inaurance Company. In this letter, they are denying the claim you
submitted for damages and cleaning charges d.e to a sewer backup tha~ occurred
in your basement on October 12, 2002. It is thc insurance company's
determination that thc City of Chanhassen is not respomiblc for thc damages you
incurred. After further review, and relying on the findings of our insurance
company, the City of Chanhassen will not be paying for the charges you
submitted.
This was indeed an unfortunate incident, but it docs appear that the~ was no
negligence by the City of ~ and therefore we do not feel the damage

This is a very new area in th~ city and backups are extremely uncommon in
developments where~ PVC sewer pipe has been installed. The logical culprit for the
backup would most lik~y be constmcti~ debris. This assumption is based on the fact
that this area was developed recently nnd the homes are very new. Foreign ~ grt
in to the linea through the connectiona that ate m~tt~, for the individual houaeholds. This
can include piecea of PVC pipe, rock, sand, dirt or building matea'i~ls. Typically, the
d~wlopm~t contractor is realxmaible for cleaning the lines to in~tlre that the~e mntexials
ar~ removed, and the project ia turned over to the City with clean 1inca. Nm:mally the city
