Approve Conveyance of Quit Claim Deed to Sunrise Hills Civic
Association - PW055A
REQUEST
Staff recommends the City Council approve the attached resolution and quit claim
deed to Sunrisc Hills Civic Association (SHCA).
BACKGROUND
In December, 2002, the City Council approved an easement agreement for access
to the Sunrise Hills beachlot between the City and SHCA. During the easement
negotiations, it was discovered that the City owned a small outlot which lies
between the Frontier Trail right-of-way and the beachlot (see picture below and
attached exhibit). As far as staff can tell, the City obtained ownership of the outlot
as a result of tax forfeiture.
DISCUSSION
As was discussed in the staff report for the easement agreement, staff sees no
reason to retain the small ouflot off of Frontier Trail. The ouflot contains no
public utilities or other structures of public value. In addition, the approved

access easement covers the entire gravel entrance drive so the City's access issues
have been addressed.
The City attorney's office has previously reviewed the Quit Claim Deed.
RECOMMENDATION
Staff recommends that the City Council adopt the following motion:
"The Chanhassen City Council approves the attached resolution and Quit Claim
Deed between the City of Chanhassen and Sunrise Hills Civic Association.

WHEREAS, the City of Chanhassen is the fee owner of the mai property ("Property") described as
follows:
Outlot 1, Sunrise Hills Second Addition, according to the plat thereof on
file and of record in the office of the County Recorder and/or the office
of the Registrar of Titles of Carver County, Minnesota.
WHEREAS, the City has previously agreed to dispose of the Property to Sunrise Hills Civic
Association, a MN corporation, as part of a recently negotiated easement dated January 2, 2003; and

WHEREAS, the City Council finds that the proposed disposal of the Property has no relationship to
the City's Comprehensive Plan; and
WHEREAS, the City Council finds that the conveyance of the Property to the Association is in the
best interest of the citizens of the City in that the Property will be returned to the tax rolls.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the Cit. y of Chanhassen,
Minnesota:
The City Manager and the Mayor are hereby authorized to execute the Quit Claim Deed and
any and all other documents necessary in the opinion of the City Attorney to convey to
Sunrise Hills Civic Association the following described property:
Outlot I, Sunrise Hills Second Addition, according to the plat thereof
on file and of record in the office of the County Recorder and/or the
office of the Registrar of Titles of Carver County, Minnesota.
Passed and adopted by the Chanhassen City Council this 13th day of January, 2003.
