TO: FROM: DATE: SUBJECT: Chanhassen Public Works Facility Project No. 08-03: Approve encroachment agreement with the Metropolitan Council. PROPOSED MOTION "The City Council approves an Encroachment Agreement with the Metropolitan Council for the Chanhassen Public Works Facility, Project No. 08-03" City Council approval requires a simple majority vote of the City Council present. DISCUSSION The Metropolitan Council obtained an easement over their trunk sanitary sewer line in 1987. This easement is located on Lot 6, Block 1, Chanhassen Lakes Business Park 5th Addition. The new Chanhassen Public Works Facility is proposing to encroach upon this easement with storm sewer and parking lot. The Metropolitan Council has agreed to allow the City to encroach upon its easement with an encroachment agreement which is attached. This agreement has been reviewed by the City Attorney and he finds it acceptable. Attachment g:\eng\public\_2008 projects\08-03 chanhassen maintenance (pw) facility\04-13-09 approve encroachment agreement met council.doc Chanhassen is a Community for Life - Providing for Today and Planning for Tomorrow CONSENT TO ALLOW ENCROACHMENT ONTO SANITARY SEWER EASEMENT Interceptor Number: 8253-328 County of Carver Encroachment Number: xxx The Metropolitan Council, a public corporation and political subdivision of the state, Successor in interest to the Metropolitan Waste Control Commission, being the holder and owner of a sanitary sewer easement described in Document No. T-55349, filed in the office of the County Recorder on January 7TH, 1988, in Carver County, Minnesota, covering the premises lying and being in Chanhasssen, Minnesota, and described as: Lot 6, Block 1, Chanhassen Lakes Business Park 5th Addition, Carver County MN. In consideration of the sum of One Dollar and other good and valuable consideration to it in hand paid, the receipt and sufficiency of which is hereby acknowledged, hereby consents to the encroachment onto that certain easement between the owner of said property and the Metropolitan Council, to-wit: See attached Exhibit A The encroachment permitted by this Consent is described as follows: Grade changes, driveway, retaining wall, and storm sewer construction over the sanitary sewer interceptor as shown in the plans and specifications of the Public Works Facility 7901 Park Place prepared by Joseph Shamla P.E. dated March 3, 2009 Selected Plan Sheets and showing the improvements to be constructed over the interceptor are attached hereto and made a part hereof as Exhibit B. The Metropolitan Council and the City of Chanhassen it's successors and assigns, hereby agree that said encroachment shall be subject to the following conditions: 1. The City of Chanhassen and the Metropolitan Council agree that each will be responsible for their own acts and the results thereof, to the extent authorized by law and shall not be responsible for the acts of the other party and the results thereof. The City of Chanhassen and the Metropolitan Council's liability is governed by the provisions of Minnesota Statutes, Chapter 466. 2. The City of Chanhassen , it's successors and assigns, will notify the Metropolitan Council at least 72 hours in advance of the actual physical start of any construction. - 1 - 3. The City of Chanhassen, it's successors and assigns, hereby agree that it will ensure their contractor and subcontractor's compliance with all applicable safety standards pertaining to working in the atmosphere of sanitary sewers. Attention is specifically directed to the confined space rules adopted by the Minnesota Department of Labor and Industry Regulations 5207.0300. 4. The City of Chanhassen, it's successors and assigns, hereby agree that construction of the project is in accordance with the construction plans as reviewed by the Metropolitan Council. The City of Chanhassen, its contractors and subcontractors must protect the Metropolitan Council facilities during construction. Stockpiles of soil and construction material and imposition of excessive loading over the interceptor sewer force main is not permitted. 5. The City of Chanhassen, it's successors and assigns, hereby agree that the Metropolitan Council employees, agents, and successors in interest shall have access to its facilities at all times. 6. The City of Chanhassen, it's successors and assigns, will pay for repair or replacement of any damage to or destruction of Metropolitan Council's facilities, which damage or destruction arises from or is attributable to the encroachment described in this consent. 7. Should the Metropolitan Council find it necessary to remove or disturb in any way the driveway improvements, retaining wall and storm water pipes shown on plan sheet C 4. in the pipe easement area, reconstruction shall be paid for by The City of Chanhassen it's successors and assigns. 8. This agreement shall be binding upon and inure to the benefit of the parties hereto and their successors and assignees and the consent granted herein shall be perpetual and shall constitute a covenant running with the land. 9.
