IV/Construction Manager DATE: April 13, 2009 SUBJ: ()~ The Preserve at Bluff Creek 1 st & 2nd Additions, Project Nos. 06-12 and 07-11: Accept Street and Utility Improvements PROPOSED MOTION "The City Council accept the public street and utility improvements in The Preserve at Bluff Creek 1 st and 2nd Additions for perpetual maintenance and ownership." City Council approval requires a simple majority vote of the City Council present. Staffhas received a letter from Mark Sonstegard of Ryland Homes, requesting the City consider acceptance of the public street and utility improvements in The Preserve at Bluff Creek 1 st and 2nd Additions. Staff has performed a walk-through inspection and finds the completed improvements acceptable for perpetual maintenance and ownership. It is therefore recommended that the City Council contingent upon receipt of the two-year street and utility maintenance bonds. Attachments: 1. With the acceptance of the improvements, Ryland understands a 2- year warranty period begins. Attached please find a 2-year maintenance bond provided by the development's general contractor, S.M. Hentges. In addition, please provide a letter to Ryland approving the current LOC #1429 to be reduced down to 20% of the storm sewer costs which is calculated to be $48,000.
