Approve Access Easement Agreement with Sunrise Hills Homeowners

REQUESTED ACTION
Approve the access easement agreement with Sunrise Hills Homeowners Association.
DISCUSSION
On November 25m, the City Council voted to table this item pending submittal of a cost
benefit analysis of the easement agreement. This memorandum is a summary of that
analysis. Actual' calculations supporting the analysis arc not included.
The easement was.valued at $19,009.20 based on 70% of land value and a comparable
sale value of $3.72 per square foot. Recent permanent casements were purc~ for
70% of land value. Land values have continued to increase during the negotiations.

Placing sod would not correct the access problem. It has been assum~ for analysis purposes
that sod would need to be replaced 4 times in a 20-y~ar period. Historical experienc~ with this
lift station has indicated that the sod would be i .mpactmt every 2-3 ymu-s. In addition, the lack of

additional cost of pavers over bituminous pavement. The homeowners association's
counter offer was for $40,000, with a statement that they would settle for $20,000 if
pavers were installed in place of bituminous.
If condenmation were required to obtain the easement, the City would incur costs for
attorneys and appraisals. Staff felt the continued delay and costs of condemnation
outweighed the increaseA cost of pavers.
The $20,000 and brick pavers were verbally agreed to by the homeowners association in
April of 2002 following a year of negotiations; however, continued negotiations on
wording of the easement have delayed the approval of the easement until December of
2002.
