CC SUM 2009 05 11 CHANHASSEN CITY COUNCIL REGULAR MEETING SUMMARY MINUTES MAY 11, 2009 Mayor Furlong called the meeting to order at 7:05 p.m. The meeting was opened with the Pledge to the Flag. COUNCIL MEMBERS PRESENT: Mayor Furlong, Councilman Litsey, Councilwoman Ernst, Councilwoman Tjornhom, and Councilman McDonald STAFF PRESENT: Todd Gerhardt, Roger Knutson, Laurie Hokkanen, Kate Aanenson, Greg Sticha and Terry Jeffery PUBLIC PRESENT: Hannah Hauan 9631 LaForet Drive th Nicole Krolikowski 761 West 78 Street Mike Schlangen 8175 Hazeltine Boulevard PUBLIC ANNOUNCEMENTS: Mayor Furlong invited all residents and veterans to attend the th Veterans Monument dedication ceremony on Memorial Day, May 25. CONSENT AGENDA: Councilwoman Ernst moved, Councilman McDonald seconded that the City Council approve the following consent agenda items pursuant to the City Manager’s recommendation: a. Approval of Minutes: -City Council Work Session Minutes dated April 27, 2009 -City Council Verbatim and Summary Minutes dated April 27, 2009 Receive Commission Minutes: -Planning Commission Verbatim and Summary Minutes dated April 21, 2009 b. Kerber Pond Park Landscaping Project: Approve Quotes. Resolution #2009-39: c. 2009 Inflow/Infiltration Project 09-03: Award Contract. e. Approve Agreement with Xcel Energy for Peak Electrical Control at City Hall. f. Award of Contract, Banking Services. g. Approval of Temporary Consumption and Display Permit, May 17, a Celebration of Chanhassen Music and History, Chaska Valley Family Theater. City Council Summary - May 11, 2009 h. Approval of Temporary On-Sale Liquor License, Fourth of July Celebration, Chanhassen Rotary Club. All voted in favor and the motion carried unanimously with a vote of 5 to 0. VISITOR PRESENTATIONS: None. PUBLIC HEARING: NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) ANNUAL REPORT. Terry Jeffery reviewed the highlights of the National Pollutant Discharge Elimination System annual report. Mayor Furlong opened the public hearing. No one spoke and the public hearing was closed. Councilman McDonald asked for clarification on the interaction between the City of Chanhassen and the watershed districts. Councilman Litsey moved, Councilwoman Ernst seconded that the Chanhassen City Council authorizes the Mayor to sign the City’s National Pollution Discharge Elimination System (NPDES) Phase II Annual Report, as attached to this report, and authorizes the distribution of the Annual Report to the Minnesota Pollution Control Agency. All voted in favor and the motion carried unanimously with a vote of 5 to 0. AWARD OF SALE, 2009A GENERAL OBLIGATION REFUNDING IMPROVEMENT BONDS. Greg Sticha provided background on the process of refunding the 2005 MnDOT loan and the 2006A MUSA area improvement bonds. Part of the process when bonds are issued is a review by your rating agency. As a part of that rating process the City of Chanhassen received an upgrade to a AAA bond rating, which is the highest rating a city can receive. The low bid came in with a true interest cost of 2.26% from Morgan Keegan resulting in a net present value savings of 4.2% or $376,000 over the life of the bonds. Councilman McDonald asked staff and Mark Ruff from Ehlers and Associates to explain the significance of the city receiving a AAA bond rating as well as the highest management rating given by Standard and Poors. Resolution #2009-40: Councilman McDonald moved, Councilman Litsey seconded that the City Council awards the bid for the issuance of $6,020,000 General Obligation Improvement Refunding Bonds, Series 2009A to the low bidder Morgan Keegan. All voted in favor and the motion carried unanimously with a vote of 5 to 0. Mark Ruff with Ehlers and Associates award the City and City Council with a Certificate acknowledging the rating upgrade to a AAA bond rating, emphasizing that it is a rather elite group in Minnesota and across the nation who have this bond rating. The council took a short recess at this point to take photographs commemorating this event. 2 City Council Summary - May 11, 2009 ARBORETUM TIRE AND AUTO: CONSIDER APPROVAL OF A CONDITIONAL USE PERMIT TO ALLOW AN ELECTRONIC MESSAGE CENTER ON A MONUMENT SIGN AND RECOMMENDATION TO DENY A SIGN VARIANCE FROM THE INDIVIDUAL DIMENSION LETTERING; LOCATED AT 8175 HAZELTINE BOULEVARD. APPLICANT/OWNER: MICHAEL SCHLANGEN. Kate Aanenson presented the staff report and Planning Commission update on this item. Mayor Furlong asked for clarification of the signage that is currently on the site. Mike Schlangen explained the request for a sign to replace what’s currently on site as a way to advertise the services offered by their small business. Councilman McDonald asked the applicant to explain why they want the sign to emphasize the services being offered rather than the name of the business. Councilwoman Tjornhom asked the applicant to elaborate on the dimensional lettering requirement and why they feel that is burdensome. After clarification of what was being requested, and comments and discussion by the council, the following motion was made. Councilwoman Ernst moved, Councilman McDonald seconded that the City Council approve Planning Case 09-04 for a conditional use permit for an electronic message center and approval of the sign variance request and adopt the revised Findings of Fact. All voted in favor and the motion carried unanimously with a vote of 5 to 0. COUNCIL PRESENTATIONS: Councilman McDonald noted that after attending the watershed district meeting he learned that they are approaching the issue of clean water differently than the Chanhassen City Council and suggested more coordination be done between the city and the watershed district to address the issue of clean water in the city. Councilman Litsey complimented Mayor Furlong for going a great job of presenting the State of the City address to the Chamber of Commerce. ADMININSTRATIVE PRESENTATIONS: Todd Gerhardt provided updates on the construction of the new public works facility, Arbor Day festivities and the beginning of road improvement projects. CORRESPONDENCE DISCUSSION. None. Councilwoman Ernst moved, Councilman McDonald seconded to adjourn the City Council meeting.
