FROM: DATE: June 1, 2009 SUBJ: Contract with School District 112 - School Resource Officer PROPOSED MOTION The City Council authorizes the Agreement with School District 112 for the shared services and expenses of a School Resource Officer (SRO) for the period of September 2009 through June 2010. BACKGROUND As part of the three-year Police Services Plan, the City and the School District programmed the addition of a School Resource Officer to coincide with the September 2009 opening of Chanhassen High School. The purpose of a School Resource Officer is to have a police presence in the school. The officer is able to establish a relationship with the students, and often, is able to prevent incidents. Currently, the City of Chaska has a SRO at Chaska High School and the City of Minnetonka has a SRO at Minnetonka High School. The 2009 Police Services Contract included the addition of the SRO for September, 2009. Deputy Bob Zydowsky is scheduled to assume that position on August 17, 2009. The District has agreed to pay for 50% of the costs of the Officer. This agreement provides for the District to reimburse the City for those costs. The City will have the benefit of the Officer during non-school hours/days, as well as in the summer months. For 2010, the rate for the SRO is $83,882 plus $5,383 for the SRO vehicle. The City and the School District would each be responsible for $44,623.50. RECCOMENDATION Staff reccomends approval of the Contract with School District 112 for a School Resource Officer. Providing for Today and Planning for Tomorrow MEMORANDUM OF UNDERSTANDING BETWEEN CITY OF CHANHASSEN AND INDEPENDENT SCHOOL DISTRICT 112 This agreement made and entered into this _ day of ,2009, by and between the CITY OF CHANHASSEN and INDEPENDENT SCHOOL DISTRICT 112. GOALS AND OBJECTIVES 1. Support a safe and secure environment on campus, which will be conducive to learning. 2. Establish a positive working relationship in a cooperative effort to prevent juvenile delinquency and assist in student development. 3. Promote positive attitudes regarding the police role in society and educate students about their rights and responsibilities as lawful citizens. A. EMPLOYMENT AND ASSIGNMENT OF SCHOOL RESOURCE OFFICER 1. The City of Chanhassen agrees to provide one (1) School Resource Officer at Chanhassen High School. 2. The City of Chanhassen shall select the School Resource Officer (SRO) and assign the officer. School District 112 Administration will be invited to interview Carver County Sheriff's Department School Resource Officer candidates. 3. In the event the SRO is absent from work, the SRO is to notify his/her supervisor at the Sheriff's Department and the Principal at the school. The Sheriff's Department agrees to assign a SRO alternate when an officer is not available. 4. The School Resource Officer shall remain an employee of the City of Chanhassen and shall not be an employee of the School District. The School District and City of Chanhassen acknowledge that the School Resource Officer remains responsive to the commands of the Carver County Sheriff's Department. 5. The SRO Supervisor will have regular and ongoing contact with the school Principal. B. COST ALLOCATION 1. District 112 and the City of Chanhassen agree to share on a 50%-50% basis the total annual cost of providing one (1) School Resource Officer. 1 2. Total cost shall include annual salary, employer insurance contribution, social security, retirement, and uniform allowance. 3. The City shall provide, at its cost, supervision and a vehicle for the officer. 4. For the 2009-2010 school year, the City will submit an invoice to School District 112 on or before July 1,2009, and District 112 will pay in full by August 1,2009. In future years, the City will invoice by June 1 and District 112 will pay in full by August 1. 5. The School District will pay all extra costs for any holidays that apply to SRO but not school. C. HOURS AND SPECIAL EVENTS 1. The SRO is assigned during the school year on a full-time basis. The SRO shall be on duty at Chanhassen High School. During regular hours, the SRO may be off campus performing such tasks as may be required by their assignment (Court, Truancy Center, Arrest). 2. The School District 112 may pay overtime for special events or details that are authorized by the SRO Supervisor. Additional overtime may be requested and paid for by City of Chanhassen. 3. School Resource Officers may wear their uniform or plain clothes and will carry their duty weapon while at school. D. DUTIES OF THE SCHOOL RESOURCE OFFICER 1. The SRO will assist the Principal in developing plans and strategies to prevent and/or minimize dangers situations that may occur on campus. 2. The SRO will present programs on various topics to students. Subjects shall include a basic understanding of law, role of law enforcement, drug awareness, anger management, the mission of law enforcement, and staff/student requested topics. 3. The SRO is encouraged to interact with students on an individual basis and in small groups. 4. The SRO will make himself/herself available for conferences involving teachers, parents, and students. 5. The SRO will be familiar with agencies and resources that offer assistance to youth and their families and make referrals to agencies when necessary. 6. The SRO shall take law enforcement action when necessary. 2 7. The SRO will contact the principal of the school about his/her actions to make them aware of arrests or crimes. 8. The SRO shall notify the Principal or designee before removing a student from school. 9. The SRO will take law enforcement action against intruders and unwanted guests who appear on school property. 10. The SRO will conduct investigations of crimes which occur at the school and use other resources if needed for follow-up investigations. 11. The SRO shall not be used as a school disciplinarian. If the Principal believes an incident is a violation of the law, he/she may contact the SRO to see if law enforcement action is needed. 12. The SRO can enforce school rules and policies. 13. The SRO shall follow the guidelines of State and Federal law, School Board Policy, and the Carver County Sheriff's Department General Orders in regards to investigations, interviews, and searches relating to juveniles. 14. The SRO will operate under all established Carver County Sheriff's Department policies and procedures. E. RIGHT AND DUTIES OF THE SCHOOL BOARD The School District will provide to the SRO the following materials and facilities, which are deemed necessary to the performance of the SRO: 1. Access to private office containing a telephone line to be used for general business purposes. 2. A desk with drawers, a chair, and a filing cabinet that can be locked and secured. 3. Access to a computer terminal or computer hookup. The City of Chanhassen will supply the officers with the usual and customary office supplies and forms required in performance of their duties. F. DISMISSAL OF SRO 1. In the event the Principal ofthe school feels that the SRO is not effectively performing his or her duties and responsibilities, the Principal shall contact the SRO Supervisor. Within a reasonable amount of time after receiving the information from the Principal, the SRO Supervisor shall advise the Carver County Sheriff's Department of the Principal's request. If the Carver County Sheriff's Department desires, the Principal and 3 the Carver County Sheriff's Department or their designees shall meet with the SRO to mediate or resolve any problems which may exist. 2. The Carver County Sheriff's Department may dismiss or reassign an SRO based upon the Carver County Sheriff's Department's rules, regulations, and General Orders. G. INDEMNIFICATION The School District agrees to defend, indemnify, and hold harmless the City of Chanhassen against any and all claims, liability, loss, damage, or expense arising under the provisions of this Agreement and caused by or resulting from negligent acts or omissions of the School District and/or those of School District employees or agents. The City of Chanhassen agrees to defend, indemnify, and hold harmless the School District against any and all claims, liability, loss, damage, or expense arising under the provisions of this Agreement for which the City of Chanhassen is responsible and caused by or resulting from negligent acts or omissions of the City of Chanhassen and/or those of City of Chanhassen employees or agents, if applicable. All parties to this agreement recognize that liability for any claims arising under this agreement are subject to the provisions of the Minnesota Municipal Tort Claims Law; Minnesota Statutes, Chapter 466. In the event of any claims or actions filed against either party, nothing in this agreement shall be construed to allow a claimant to obtain separate judgments or separate liability caps from the individual parties. H. EFFECTIVE DA TE/TERMINA TION 1. This agreement will be effective July 1, 2009. 2. This agreement shall remain in force until terminated by either party pursuant to this agreement. 3. Either party may terminate this agreement by giving written notice a minimum of 180 days before the start of any school year. This agreement constitutes a final written expression of all the terms of this Agreement and is complete and is an exclusive statement of those terms. 4 IN WITNESS WHEREOF, the parties have caused this Agreement to be signed by their duly authorized officers.
