Family and Medical Leave Act - Modification to the City
Personnel Policy
BACKGROUND
The City is required by Federal law to provide up to twelve (12) weeks of unpaid
leave to eligible employees for certain family and medical reasons. Such reasons
include but are not limited to:
· To care for an employee's child after birth or placement for adoption or
foster care
To care for an employee's spouse, son or daughter, or parent who has a
serious health condition
· For a serious health condition that makes the employee unable to perform
the employee's job
· Any period of absence to receive multiple treatments by a health care
provider
The ct/rrent City personnel policy states "An employee may take a maximum of
twelve (12) work weeks of FMLA leave each calendar year." This is troublesome
in the event that an employee begins his or her leave less than twelve weeks
before the end of the calendar year, and therefore could ask for an additional
twelve weeks as soon as the new year begins, for the same incident/reason.
Staff is recommending that the policy be amended to state "An employee may take
a maximum of twelve (12) work weeks of FMLA leave per twelve (12) month
period measured forward from the date an emplOyee's first FMI.A leave begins."
RECOMMENDATION
The City Council adopt the attached resolution to amend the City's personnel
policy relating to the amount of leave time an employee can take under the Family
and Medical Leave Act.

ADOPT A RESOLUTION AMENDING THE CITY'S PERSONNEL POLICY TO
REFLECT CHANGES IN AMOUNT OF LEAVE TIME ALLOWED UNDER THE
FAMILY MEDICAL LEAVE ACT (FMLA)
WHEREAS, the City of Chanhassen is required to allow for unpaid leave under the Family
and Medical Leave Act (FMLA); and
WHEREAS, the City's personnel policy states "An employee may take a maximum of
twelve (12) work weeks of FMLA leave each calendar year."
WHEREAS, there could be cases where the twelve-week period overlaps between calendar
years, thus allowing for up to 24 weeks of FML,A leave;
NOW, THEREFORE, be it resolved by the City Council of the City of Chanhassen,
Minnesota:
That Section 7, subsection 6.a.2.b, as stated above, be amended to state:
"An employee may take a maximum of twelve (12) work weeks of FMLA leave per
twelve (1:2) month period measured forward from the date an employee's first
FMLA leave begins."
