Gabberts' Community HomelModel Home
Gabberts Furniture is requesting to open a Community Model Home to be located at Halla
Groves Development. Gabberts' Community Home is a builder's model home which remains
open for six months or more. It is similar to those seen at the parade of homes. Gabberts'
designers team-up with the builder in the early stages of planning a home and through that
partnership, they create an entire interior design theme throughout the home. Gabberts and the
builder would then offer seminars, open house, and charitable events at the home to entertain and
educate the public on topics relating to the home. These events take place on an average once a
week.
City Code does not address such proposals, therefore, staff is presenting this request to the City
Council for direction. There are some issues that we have investigated.
A preferable location for such an operation would be in a fairly new subdivision that is not fully
developed. This will limit the number of people or neighbors impacted by the model home.
Improved streets will also be needed to accommodate on-street parking for those attending the
educational seminars or visiting the model home. The Halla Groves Development appears to be
the least objectionable location for such a request. There are nine (9) lots in the northwestern
portion of the subdivision that have newly constructed streets to accommodate on-street parking.
Gabberts' previous model home was located in West Lakeland Township. Staff contacted West
Lakeland Township and spoke to their Building Official to find out if there were any issues
dealing with neighborhood complaints, noise, parking, traffic congestion, etc. We were informed
that their operation ran very smoothly and the township never received any complaints.

STAFF RECOMMENDATION
Should the City Council approve this use, staff recommends the following conditions:
1. The seminars may be offered for a maximum of (8) eight months, commencing on the day
a certificate of occupancy is issued for the model home, or when 4 homes have been
given a certificate of occupancy (within the 9 northwesterly lots of the Halla Groves
subdivision), whichever comes first.
2. The applicant shall meet with the building official to discuss the home design and address
any issues relating to accessibility requirements. At a minimum, the entrance into the
home, a bathroom, and a meeting room must be accessible.
3. Parking shall be permitted on one side of the street only.
4. No seminar shall be offered after 7:00 p.m.

Thank you for taking Ithe time to talk with me regarding the Community
Home in Chanhassen~ I appreciate your support of the project and your
assistance in getting this approved.
Gabberts' Community Home is simply a builder model home. It remains
open for an extended period of time (six months or more), just as a Parade
home would that doesn't sell. OUf designers team up with the builder in the
early planning stages lor the home, offer their creative input into the design
and details of the overall scheme, and then create an entire interior design
theme throughout the! home. Gabberts and the builder then host seminars,
open houses and charhable events at the home to entertain and educate the
public on topics relatilng to the home.

In the seven months the home was open, there were never any problems with
traffic, parking, noise" etc. I would be happy to give you the names of some
neighbors of the Community Home to use as a reference if you would like to
confirm this.
The Community Ho~e in West Lakeland just closed at the end of March,
but I must add that it was a huge success. Tn fact, we have received many
comments from peopJe who are disappointed that the Community Home
closed! To give you an idea on the types of activities that took place at the
Community Home, rye enclosed a couple of advertisements and brochures

COMMENTS: Upon review of infonnation relating to the Community IIome. it is apparel1t
thCl.t the intended use of this facility extends far beyond that of the typical
model home, According to the infonnation provided by Gabbcrts, "Gabberts
and the builder [will) host seminars, open houses and charitable events at the
home to enter~.in and educate the public on topics relating to the home," It is
clear from promotional brochures that the events held at the home are not
related strictly to the home and/or sale of the home but rather are generic
design and construction topic seminars unrelated to the home,
Since this bldlding is open to the general public for seminars and educational
purposes, it must meet current accessibility requirementS of the Minnesota
State Building Code. You may also want to check the requirements of ci viI
rights laws of both the State Human Rights Act and the federal Americans
with Disahilities Act. A violatiun of the ADA may result in compensatory
daIl"Jages being paid to the complainant.
