SUBJ: Certification ofSewerlWater Bills to the County
Delinquent utility bills are considered a responsibility and liability of the property
serviced and, as in Minnesota Statute 444.057, the city may certify such delinquencies to
the County Auditor for collection with property taxes. In accordance with said statute
and City Code section 19, the attached detail listing identifies all properties and
associated delinquent amounts (including a certification fee) as of October 21, 1997. All
appropriate actions, notices, letters, etc., have been submitted to property owners of
record and at this time proposed certifications for collection with 1998 property taxes are
as detailed on the attached listing.
A public hearing is set for October 27, 1997 City Council meeting. We will need the City
Council action approving certification of the delinquent utility bills, plus certification fee
(which is included in the amount shown), to the homeowner's property taxes before we
are able to send this list to the County Auditor.

Manager's Comments:
Tomassen Complaint: Enclosed please find a letter to Mr. Tom~ssen. His letter had
been included in one of the previous administrative sections. Duting a discussion of
those enclosures, the council asked that I attempt to work out sorrj.e type of solution with
Mr. Tomassen. As of Wednesday morning, Mr. Tomassen was h~ppy with the proposed
solution, albeit he had not seen it in writing.
Sullivan Complaint: The Utility Department acknowledges that Mr. Sullivan has called
in complaining about rusty water. In each instance we did flush the line. No statement
was made that he should make a deduction from his utility payment. In regards to this
latter point, personal experiences come to mind. Specifically, years ago I purchased a
woodburning hot tub. It would take most of an evening to drain that using an ordinary
water hose. At noon I would turn on the water to refill the tub and by 5 :00 p.m. it would
be about three-fourths full. It would typically take a 7-8 hour period of time to fill the
700 gallon tub. Our current water rates are $1.30/thousand--in other words, it cost me
roughly $1 each time I filled that hot tub. As it deals with Mr. Sullivan, assuming he
drained his water one day per month, we're probably talking about $12 worth of water
over the course of a year. His typical monthly utility charge is approximately $140.

Dear Mr. Tomassen:
In light of your desire to resolve your CUlTent utility billing situation, I would be willing to offer
the following:
. Certification: Certifying the principal amount of your water and sewer bill would occur on
October 27,1997. One-half of that amount would then be due with each of your two
property tax payments in 1998; and
. Certification Charges: Deleting the certification charges would occur on October 27; and
. Establish Payment Schedule: You would be responsible for contacting Pam Snell (937-
1900 ext. 149) and establishing a monthly payment that would bring the account back to zero
by July 1, 1998. Assuming that you and Pam are able to develop a monthly payment plan,
additional late fees during the repayment period would be waived; and
· Late Fees: In regard to late fees amounting to approximately $165, I would suggest that you
contact Rick Rice on our staff to determine whether a fees for service contract can be
established through which the city could benefit from your computer skills in lieu of paying
the late charges; and
· Fees for Service: Should the city and yourself be unable to reach agreement on the first four
items by November 20, 1997, all water, sewer, late charges and certification fees will be
certified to the county for collection with your property tax payments in 1998. Note: I did
not include this "fees for service" section" as a requirement. I did this recognizing that either
party may determine that the late fees should simply be certified-such assumes that a
contract could not be worked out.

As I mentioned when we talked, I was dictating this letter when you called. I believe I was able
to remember each of the above points during our discussion. I was pleased with your agreement
that the solution seemed reasonable. Hopefully none of the points as presented in writing above
differ from my recollection. If any of the above points are different, please feel free to contact
me.

I have received your letter dated September 10 in connection to my letter of September 3,
1997. which was addressed to tne Mavor and Citv Council ofCnannassen

In response to your explanation for tne city charges applied. I conclude that the
foundation for the late fees is very weak and in fact non-existent because there are no
extra costs made for postage, past due statements. administrative tasks or otner duties in
connection to my past due account. I come to this conclusion because the late fee charge
is added 8utomatically per standard practice to eacn quarterly bill that is mailed
periodically.
Your reply only extensively and explicitly elaborates on the charge for certification by
summarizing a list of items, some of which are made in pluraL which should have been
singular, example: your office sent only one notice and not as vou indicated "notices" and
your office most likely ,vi!! provide a delinquent customers' list to the city council for its
hearing on October 27, 1997, and not as vou indicated "hearin!:!s". With regard to your
statement that properties are to be removed from the main computer system, 1. a computer
expert myself since 1972, conclude that your statement is impressive but unlikely except
th?t the computer file records pertaining to my account, or perhaps T snould use the term
datab?se or even better RDB(M)S, will be flagged until such time that the past due is
satisfied, Sucn a method would be in compliance with the uniform FASB principles which
are to 'varrant a correct reflection of the financial condition of an enterprise.

T also find you statement despicable to generalize me with the rest of the delinquent
customers and take your remark as a serious personal insult for \vhich I demand your
apology. Furthermore, T have called your office in the spring of this year, like I did to
other service providers, to kindly ask to work with me during this dreadful situation,
Whatever the reason I did not prevail. Even ifI would have, the fact remains that the late
fee charges are detrimental to the relief I need to overcome my temporary financial
distress, Tfthe city really wants to help out, it should consider reducing my financial
burden by waiving the late fee charges and offer me to make payment arrangements,
L therefore, ask the city's clemency to grant a payment plan that allows me to bring the
account current by the spring of 1998,

Dear Mr. Thomason:
A copy of your letter of September 3, 1997 as well as this response has been forwarded to the
Mayor and City Council.
The city's latc fees and ce11ification costs have very little to do with the cost of bOlT owing money
to make up for late payments. The cost of certification is a very real cost for the city.
Specifically, sending notices, removing properties from the main computer system,
advertisement, hearings, and finally, certification to the county are all highly labor intensive.
Following certification, the city incurs additional costs for auditing, receipting, and accounting
for that secondary set of accounts. As a consumer, I can fully understand and would agree with
your comments that the amounts charged by the city are significant. However, I would disagree
that costs are absorbent for more than the costs incurred by the city in handling delinquencies.
Despite the fact that the charges are high to offset our costs, we typically have upwards of 200
accounts that are delinquent each year. Ironically, 75% of the names on that list continue year
after year.
Finally, I believe our finance department tries to work with our customers. We have had several
cases where the property owner has notified us of their inability to make a particular payment and
his/her desire to start making payments of $20 or $30 a month until the bill is paid. We have
honored those request, however, in this instance, so many months have gone by with no payment
and the babnce has reached such a proportion that we are forced to follow state statute as it deals
with procedures for repayment of extended utility delinquencies.

As T mentioned to Pam Snell and Danielle Washburn yesterday, all T am asking for is
additional time to pay for the used services and a waiver of the late fees to reduce my
financial burden, T also indicated that T expect to find employment in the next 3 to 6
weeks and to be able to pay the balance due in Q 1 of 1998 or perhaps earlier,
I kindly request your assistance in finding a workable solution in this matter and I look
forward to a positive arrangement.

Dear Mayor and City Council,
Please consider the following at your hearing to certify delinquent utility accounts on
October 27th:
I have refused to pay my water bill because the Public Works Dept. is apparently unwilling
acknowledge disputes I have made over the last several years regarding the amount due.
Since 1991, I have been calling the sewer/water department to complain of brown water--
not just a little bit of brown water, every once in a while, for an hour or so-- really
disgusting brown water for days at a time, several times a month. My appliances are
stained, we have ruined laundry, replaced a water softener and choked the stuff down as
drinking water. When I call, they tell me to run the outside hoses until it goes away (which
it doesn't) and that it is a temporary problem, caused by flushing hydrants or gunk coming
off of the main.
Your people suggested that I keep track of the days when it happened and deduct when I
paid the bill (not to mention the water I was charged for, running the hose like they told
me to). I did this for quite some time, and they kept billing me back for the unpaid portion.
At this point, I think you should forgive 1/2 of my current bill of $545, which would
amount to about 15 weeks worth of water over the last 7 years.
