In our Summer Reading Program 47 children received prizes of books as part of the grand
prize drawing for those who had read 30 books. There were 4 grand prize gift certificates from
Target and Toy World as well. 155 kids read 30 books or more and were eligible for the grand
prizes (this was up 55% from last years total). Performance attendance totalled 2,107 over 12
performances on 9 days. There was also an adult reading program, and 12 adults received
prizes.
Our new PC with graphic Internet access is proving quite popular- for business research
(humidors and synthetic turf!) and checking stock information, information on new cars, and on
health problems. It has also been used to check redpes from the foodtv satellite channel. Our
most interesting success was a woman who was looking for information on filing for a sodal
security dIsability pension due to a chronic disease. She had been involved in this process for
many years. She found lots of information on the web, both on the process and advice on filling
out forms. She recently stopped in to let us know she was finally successful with Social Security.

RE: City of Chanhassen v. Dean R. Johnson d/b/a Dean R. Johnson
Construction, Inc. - Oak Hill Townhomes, Chanhassen, MN
Dear Elliott:
As a follow-up to our telephone conversation of November 5, 1997, I write to
acknowledge the Oak Hill Homeowners' Association's ("Association") understanding that the
criminal prosecution of Dean R. Johnson, d/b/a Dean R Johnson Construction, Inc. will be put
on hold for an indefinite period of time.
As I told you in our conversation, it is the Association's intention to proceed with its civil
lawsuit against Dean Johnson and other named defendants. Based on a recent meeting with
counsel for all parties, the Association's experts and Mr. Johnson, it is apparent that it would not
be in the Association's best interest to enter into an agreement regarding a schedule of repairs.
Since the repairs that Johnson would agree to at this time are so minimal, it would not be
productive to retain a neutral and enter into such an agreement at this time.
It is my understanding that you will contact the judge and Johnson's counsel regarding
the City's request for an indefinite extension as well as the Association's intention concerning its
civil action. If you should need anything further from the Association, please feel free to call me.
Thank you for your assistance with this matter.
Sincerely.

Dear Judge Davies:
This letter is submitted with the approval ofM!'. Johnson's attorney, Chuck Nixon.
This case was set for jury trial before you on October 15~ 1997. After lengthy
dis~ussioll, it was agreed the prosecution would be suspended upon condition that the
parties select a neutral within 20 days, and meet with the neutral within 7 days after the
neutral's selection. If the parties failed to agree on a neutral, the Court would make a
selection from a list submitted by the parties.
The Homeowner's Association's attorney informed me that his client has requested

to that effect.
The City and Mr. Johnson will negotiate the terms of the Order and submit it to

Dear Sirs and Madames:
In the summer of 1995 I was contacted by Todd Hoffman about the
land east of the proposed interchange for Highway # 212 for a city
park.
I initially had a negative attitude about selling the land for use
as a city park. After spending time roving the area, enjoying the
maple, oak & butternut woods and the ponding areas, I conceded the
land has great potential for use as a housing development.
In May 1997 I was contacted by Michael Moore representing the
"Trust For Public Land" who was retained by the City of Chanhassen
to negotiate the purchase of the proposed park land.
I spent the summer of 1997 in the promotion ?f the Park Referendum
and in negotiation.
Approximately a month ago I was advised that the City of Chanhassen
was going to pursue the negotiations instead of using the "Trust
For Public Land".

Re: Speed Zoning - City of Chanhassen
Trunk Highway 101 (Great Plains Boulevard/Market Boulevard)
Dear Mr. Hempel:
We have scheduled a speed zoning study for Trunk Highway 101 from West 86th Street
to Trunk Highway 5, as requested by the Chanhassen City Council in Resolution No. 97-86
dated October 27, 1997.
Some delay in completion of the study is possible due to our current workload and the
approaching winter weather and road conditions. As soon as all necessary data has been
collected and evaluated we will contact you to discuss possible speed zoning alternatives.
If you have questions or additional information pertaining to the study, please contact
either Ed Brown (797-3129) or Jolene Servatius (797-3125). Future speed zoning
requests should be sent directly to Ed Brown at the above address to avoid delay caused
by forwarding.

Rusty and Odorous Water Complaint Form - PW024E
Based on recent discussions between the Mayor, you and myself regarding rusty water issues, it
was agreed that staff would develop a complaint form in order to provide a more efficient and
accurate tracking of rusty and odorous water complaints. I would ask that you work with Nikki
to develop a form which we could possibly print in-house that would include the name of the
complainant, address, phone number, date and time of complaint, a space for suggested action and
follow up action taken and the date and time the remedial action was taken. There should also be
a signature line for the operator who performed the remedial action. This is just some suggestive
information you might want to include in this form.
Also, Jerry, we talked about putting together a "what to do when you have rusty water" fact sheet
to give to new homeowners and/or to put in the newsletter, etc. Could you develop a draft of this
fact sheet when you get an opportunity and we can sit down and talk about it and how to
proceed.
If you have any questions or would like to discuss this further including have me review a draft
form, please let me know.

Re:

Closure of Through-Traffic on
Third Avenue East of Division St.
November 5) 1997
See ListBelow
Craig W. Dawson, City Managerc&>
Bac~aroUDd: On November 3, 1997, the Excelsior City Council considered residents' comments as
well as a traffic engineer's study of that part of Excelsior east of Mill Street and south of Highway 7.
Residents had approached the City Council in August about their concerns '\'Vith traffic speeds, traffic
volumes, and what they perceived to be an unreasonable amount of cut-through traffic in their
neighborhood. Data in the study showed that a majority of the traffic was generated by neighborhood
residents. but that there was a significant amount of "outside" traffic traveling through the
neighborhood (particularly to and from the south).
City Council Action: The City Council has decided to conduct one, and probably two experiments
on traffic for this area of Excelsior.
. From November 17 through December 19, a barricade ""ill be placed on lbird Avenue
immediately east of Division Street. This barricade would block through-traffic between Mill
Street and Christmas Lake Road/Highway 7. Third Avenue traffic east of Division Street
would have access only through Christmas Lake Road. All traffic west of Division Street
would end up on Mill Street.
· It is also likely that the eastbound Highway 7 !Division Street access point would be
temporarily closed for one month shortly into the new year.
The City Council will consider comments that the City receives during and about experiences with
the roadblocks as it decides what~ if any, long-tem1 actions should be taken for traffic management in
this area of Excelsior.
Implementation: The City is contracting with Warning Lites, Inc., to provide and maintain traffic
warning signs and barricades. Warning Lites plans to place the barricades across Third Avenue
before the morning rush-hour traffic on Monday, November 17. Signs advising motorists oftbe
planned roadblock should be in place by Friday, November 7.
