Dean R. Johnson d/b/a Dean R. Johnson Construction, Inc. - Oak Hill Townhomes, Chanhassen, MN Dear Elliott: As a follow-up to our telephone conversation of November 5, 1997, I write to acknowledge the Oak Hill Homeowners' Association's ("Association") understanding that the criminal prosecution of Dean R. Johnson, d/b/a Dean R Johnson Construction, Inc. will be put on hold for an indefinite period of time. As I told you in our conversation, it is the Association's intention to proceed with its civil lawsuit against Dean Johnson and other named defendants. Based on a recent meeting with counsel for all parties, the Association's experts and Mr. Johnson, it is apparent that it would not be in the Association's best interest to enter into an agreement regarding a schedule of repairs. Since the repairs that Johnson would agree to at this time are so minimal, it would not be productive to retain a neutral and enter into such an agreement at this time. It is my understanding that you will contact the judge and Johnson's counsel regarding the City's request for an indefinite extension as well as the Association's intention concerning its civil action. If you should need anything further from the Association, please feel free to call me. Thank you for your assistance with this matter. Sincerely. I initially had a negative attitude about selling the land for use as a city park. After spending time roving the area, enjoying the maple, oak & butternut woods and the ponding areas, I conceded the land has great potential for use as a housing development. In May 1997 I was contacted by Michael Moore representing the "Trust For Public Land" who was retained by the City of Chanhassen to negotiate the purchase of the proposed park land. I spent the summer of 1997 in the promotion ?f the Park Referendum and in negotiation. Approximately a month ago I was advised that the City of Chanhassen was going to pursue the negotiations instead of using the "Trust For Public Land". There should also be a signature line for the operator who performed the remedial action. This is just some suggestive information you might want to include in this form. Also, Jerry, we talked about putting together a "what to do when you have rusty water" fact sheet to give to new homeowners and/or to put in the newsletter, etc. Could you develop a draft of this fact sheet when you get an opportunity and we can sit down and talk about it and how to proceed. Dawson, City Managerc&> Bac~aroUDd: On November 3, 1997, the Excelsior City Council considered residents' comments as well as a traffic engineer's study of that part of Excelsior east of Mill Street and south of Highway 7. Residents had approached the City Council in August about their concerns '\'Vith traffic speeds, traffic volumes, and what they perceived to be an unreasonable amount of cut-through traffic in their neighborhood. Data in the study showed that a majority of the traffic was generated by neighborhood residents. but that there was a significant amount of "outside" traffic traveling through the neighborhood (particularly to and from the south). City Council Action: The City Council has decided to conduct one, and probably two experiments on traffic for this area of Excelsior. . From November 17 through December 19, a barricade ""ill be placed on lbird Avenue immediately east of Division Street. This barricade would block through-traffic between Mill Street and Christmas Lake Road/Highway 7. Third Avenue traffic east of Division Street would have access only through Christmas Lake Road. All traffic west of Division Street would end up on Mill Street. · It is also likely that the eastbound Highway 7 !Division Street access point would be temporarily closed for one month shortly into the new year. The City Council will consider comments that the City receives during and about experiences with the roadblocks as it decides what~ if any, long-tem1 actions should be taken for traffic management in this area of Excelsior. Implementation: The City is contracting with Warning Lites, Inc., to provide and maintain traffic warning signs and barricades. Warning Lites plans to place the barricades across Third Avenue before the morning rush-hour traffic on Monday, November 17. Signs advising motorists oftbe planned roadblock should be in place by Friday, November 7. r\otification List: Excelsior City Council Les Plath, Excelsior Public Works Gary Ringate, Excelsior Fire Chief Rick Young, SLMPSD Police Chief Jim Schmidt, Minnetonka Schools Transportation Jim Grube, Hennepin County Public Works Jim Hurm, Shorewood City Administrator Larry Brown, Shore\vood Public Works Dir.
