Grant application g:\plan\met council\lcda 2009,doc CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DATE: RESOLUTION NO: 2009- MOTION BY: SECONDED BY: A RESOLUTION IDENTIFYING THE NEED FOR LIVABLE COMMUNITIES DEMONSTRATION ACCOUNT FUNDING AND AUTHORIZING AN APPLICATION FOR GRANT FUNDS WHEREAS, the City of Chanhassen, Minnesota is a participant in the Livable Communities Act's Housing Incentives Program for 2009 as determined by the Metropolitan Council, and is therefore eligible to apply for Livable Communities Demonstration Account funds; and WHEREAS, the City has identified a proposed project within the City that meets the Demonstration Account's purposes and criteria and is consistent with and promotes the purposes of the Metropolitan Livable Communities Act and the policies of the Metropolitan Council's adopted metropolitan development guide; and WHEREAS, the City has the institutional, managerial and financial capability to ensure adequate project administration; and WHEREAS, the City certifies that it will comply with all applicable laws and regulations as stated in the grant agreement; and WHEREAS, the City agrees to act as legal sponsor for the project contained in the grant application submitted on August 10, 2009; and WHEREAS, the City acknowledges Livable Communities Demonstration Account grants are intended to fund projects or project components that can serve as models, examples or prototypes for development or redevelopment projects elsewhere in the region, and therefore represents that the proposed project or key components of the proposed project can be replicated in other metropolitan-area communities; and WHEREAS, only a limited amount of grant funding is available through the Metropolitan Council's Livable Communities Demonstration Account during each funding cycle and the Metropolitan Council has determined it is appropriate to allocate those scarce grant funds only to eligible projects that would not occur without the availability of Demonstration Account grant funding. NOW, THEREFORE, BE IT RESOLVED that after appropriate examination and due consideration, the governing body of the City: 1 1. Finds that it is in the best interests of the City's development goals and priorities for the proposed project to occur at this particular site and at this particular time. 2. Finds that the project component(s) for which Livable Communities Demonstration Account funding is sought: (a) will not occur solely through private or other public investment within the reasonably foreseeable future; and (b) will not occur within two years after a grant award unless Livable Communities Demonstration Account funding is made available for this project at this time. 3. Represents that the City has undertaken reasonable and good faith efforts to procure funding for the project component for which Livable Communities Demonstration Account funding is sought but was not able to find or secure from other sources funding that is necessary for project component completion within two years and states that this representation is based on the following reasons and supporting facts: (a) The property owner of the Chanhassen Dinner Theatre currently has existing driveway access for their property. (b) SouthWest Transit may access their proposed park and ride facility through existing driveway access. (c) The City has no dedicated funding source for construction of the proposed roadway. (d) The proposed roadway has potential benefit beyond the two immediate adjacent property owners. 4. Authorizes its Community Development Director to submit on behalf of the City an application for Metropolitan Council Livable Communities Demonstration Account grant funds for the project component(s) identified in the application, and to execute such agreements as may be necessary to implement the project on behalf of the City. Passed and adopted by the Chanhassen City Council this 10th day of August, 2009. ATTEST: Todd Gerhardt, City Manager Thomas A. Applications that do not include development components that will be completed within the 24 month grant term, in addition to the items(s) proposed to be funded with an LeDA grant, are ineligible. What are you proposing to fund with an LCDA grant? (e.g. street, land acquisition, public-use structured parking, stormwater activities, etc.). If you are requesting more than one item, list them all briefly (add detail in Sec. I.B, page 2). Total funding requested: $1,367,731 Describe the Project. The Project includes the activities you propose to fund with an LCDA grant and the development components supported by the grant, that will be completed within the 24-month grant term (grant term begins at January 2010 grant award date). You will be asked to include more detail on the development components of the Project in Sections I.E. through 1.1. Include data and information aboutfuture project phases (if applicable) beyond the 24-month 2rant term in Section I.C. (Limit 20 lines) The City is proposing the construction of a public street to provide access to the Chanhassen Dinner Theatre, a new park- and-ride ramp for SouthWest Transit, the Frontier Building, Chanhassen Cinema and the Market Street Station development. Included in the street project for LCDA funding are the acquisition, relocation costs and demolition of the scenery workshop for the Dinner Theatre, acquisition of the road right-of-way, acquisition of the Chanhassen Depot site, demolition of an existing bus shelter, a sidewalk connection to the City's existing sidewalk system, the relocation of sewer, water mains and a storm water conveyance system and undergrounding of the electric lines. This location also represents the core area for future redevelopment and Transit-oriented development (TOD) in the downtown. The property is within the Central Business District, CBD, zone. This district permits commercial, office and residential development. The core area of the TOD is a relatively dense mixed-use development. The Dinner Theatre and Frontier buildings were constructed in the 1950s and are prime candidates for redevelopment. The provision of a public street access to this area allows for a greater intensification of the area uses. The site is adjacent to the Norwood/Y oung America (Twin Cities & Western Railroad) Corridor, which is a possible future commuter rail route to the southwest from Minneapolis. The construction of this roadway not only improves access for the park-and-ride ramp and existing commercial development, but facilitates the future redevelopment of the area. 1 ="" i~ ~ .s -8 .~ .;; ~ 0.... ~= . = ..,.Cl <I).... <J:l .... ::> ~ <I) '" :01.= ..... <I) 0Jl= ;.::::C'" ~ ~ 00 S td <I) f:-':;:: ~ I ~ <I) -8'& ;5 .~ -d~ := lot o ~ Q.- .... ~ '" 2= ~o e : .9~ 00 oB~ := ~ :.;;a '" ta:'::: Q.li: '"C~ <I) ... The City has been meeting regularly with these partners to develop an acceptable design for the roadway that will fulfill the requirements of all parties. The City has also been negotiating with the property owners to determine a way to fund the project. The City will be holding public hearings to review the project, which will be advertised to and open to the public for comment. n.A.7-E I City's role: How have elected officials, city council initiatives or actions supported the project? (Limit 10 lines) The City has been the facilitator for the inclusion of a public street within the development area to improve access and alleviate traffic congestions and concerns. City Council has had several work sessions to discuss the development ofthe park-and-ride ramp as well as the potential redevelopment of the downtown. The City will hold hearings to review the project, approve the plans and specifications and award the street project. Additionally, the site must be processed as part of a site plan review. The City will also will hold a public hearing to establish the TIP district. II.B. How LCDA Funding will be a Catalyst Describe how LCDA funding will be a catalyst to implement the project. (Limit 20 lines) The City does not have available funding sources for the payment of the project costs as shown in Section III. The property owner currently receives sufficient rents so that the redevelopment of the site is not a priority. Without a means to reduce the total cost of the project, the property owners may not agree to the public street. The City has invested a significant amount of money in the downtown area over the past 20 years to create an attractive, pedestrian-friendly, mixed-use environment. The proposed public street access will provide additional incentive to redevelop the downtown area through the creation of a continuous east-west street from Market Boulevard to Great Plains Boulevard as well as the provision of public utilities. Without the public infrastructure (streets, sewer and water), financial institutions will not provide fmancing for private development/redevelopment of the area. 14 Section III. Readiness. (Limit 15 lines) The City does not have a dedicated funding source for the construction of a new local street. The City does budget pavement maintenance funds for the long-term maintenance of the existing street system. The City projects a deficit in these funds in the future, so these funds will not be available for new road construction. The City's primary means of funding development improvements is TIF. However, due to the lack of additional private development within the near term, insufficient increment would be generated for the project. However, the City will be establishing a tax increment district for a period of 10 years to potentially reduce the special assessments on the project. Due to market conditions and reduction in property valuation, local property taxes will be decreasing, resulting in a reduction in City services. Sewer, stormwater and water utility fees. The City replenishes it utility capital funds through development fees on new subdivisions. Due to development, economic and market conditions, new development has virtually stopped in the city. There are insufficient funds currently available for utility extensions. Assessments are the only alternate funding sources available. However, should the assessment get too large, the property owners may object, stopping the project. III.B-2 Cost Estimates: How have costs been determined? Mark (X) as many as appropriate.
