Approval requires a simple majority vote of the City Council. BACKGROUND The city is requesting funding for a public street connection as well as related infrastructure improvements to provide access to the proposed Downtown Park & Ride facility. The street will also provide access for future development in this area. The Livable Communities Demonstration Account was established by the Livable Communities Act (LCA), Minnesota Statues section 473.25(b). The Demonstration Account provides funds to support development or redevelopment projects that connect development with transit-intensive land uses, connect housing and employment, provide a mix of housing affordability, and/or provide infrastructure to connect communities and attract investment. ANAYLSIS The grant proposal must involve new development, redevelopment, or infill development. Attached is a copy of the grant identifying the specific requests. The public street and infrastructure provides access to the park-and-ride, a connection to two minor collector streets, and jobs and retail centers. Grant application g:\plan\met council\lcda 2009,doc CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DATE: RESOLUTION NO: 2009- MOTION BY: SECONDED BY: A RESOLUTION IDENTIFYING THE NEED FOR LIVABLE COMMUNITIES DEMONSTRATION ACCOUNT FUNDING AND AUTHORIZING AN APPLICATION FOR GRANT FUNDS WHEREAS, the City of Chanhassen, Minnesota is a participant in the Livable Communities Act's Housing Incentives Program for 2009 as determined by the Metropolitan Council, and is therefore eligible to apply for Livable Communities Demonstration Account funds; and WHEREAS, the City has identified a proposed project within the City that meets the Demonstration Account's purposes and criteria and is consistent with and promotes the purposes of the Metropolitan Livable Communities Act and the policies of the Metropolitan Council's adopted metropolitan development guide; and WHEREAS, the City has the institutional, managerial and financial capability to ensure adequate project administration; and WHEREAS, the City certifies that it will comply with all applicable laws and regulations as stated in the grant agreement; and WHEREAS, the City agrees to act as legal sponsor for the project contained in the grant application submitted on August 10, 2009; and WHEREAS, the City acknowledges Livable Communities Demonstration Account grants are intended to fund projects or project components that can serve as models, examples or prototypes for development or redevelopment projects elsewhere in the region, and therefore represents that the proposed project or key components of the proposed project can be replicated in other metropolitan-area communities; and WHEREAS, only a limited amount of grant funding is available through the Metropolitan Council's Livable Communities Demonstration Account during each funding cycle and the Metropolitan Council has determined it is appropriate to allocate those scarce grant funds only to eligible projects that would not occur without the availability of Demonstration Account grant funding. NOW, THEREFORE, BE IT RESOLVED that after appropriate examination and due consideration, the governing body of the City: 1 1. Finds that it is in the best interests of the City's development goals and priorities for the proposed project to occur at this particular site and at this particular time. 2. Finds that the project component(s) for which Livable Communities Demonstration Account funding is sought: (a) will not occur solely through private or other public investment within the reasonably foreseeable future; and (b) will not occur within two years after a grant award unless Livable Communities Demonstration Account funding is made available for this project at this time. 3. Represents that the City has undertaken reasonable and good faith efforts to procure funding for the project component for which Livable Communities Demonstration Account funding is sought but was not able to find or secure from other sources funding that is necessary for project component completion within two years and states that this representation is based on the following reasons and supporting facts: (a) The property owner of the Chanhassen Dinner Theatre currently has existing driveway access for their property. (b) SouthWest Transit may access their proposed park and ride facility through existing driveway access. (c) The City has no dedicated funding source for construction of the proposed roadway. (d) The proposed roadway has potential benefit beyond the two immediate adjacent property owners. 4. (Limit 20 lines) The City is proposing the construction of a public street to provide access to the Chanhassen Dinner Theatre, a new park- and-ride ramp for SouthWest Transit, the Frontier Building, Chanhassen Cinema and the Market Street Station development. Included in the street project for LCDA funding are the acquisition, relocation costs and demolition of the scenery workshop for the Dinner Theatre, acquisition of the road right-of-way, acquisition of the Chanhassen Depot site, demolition of an existing bus shelter, a sidewalk connection to the City's existing sidewalk system, the relocation of sewer, water mains and a storm water conveyance system and undergrounding of the electric lines. This location also represents the core area for future redevelopment and Transit-oriented development (TOD) in the downtown. The property is within the Central Business District, CBD, zone. This district permits commercial, office and residential development. The core area of the TOD is a relatively dense mixed-use development. The Dinner Theatre and Frontier buildings were constructed in the 1950s and are prime candidates for redevelopment. The provision of a public street access to this area allows for a greater intensification of the area uses. The site is adjacent to the Norwood/Y oung America (Twin Cities & Western Railroad) Corridor, which is a possible future commuter rail route to the southwest from Minneapolis. The Chanhassen Dinner Theatre, built in 1957, is a cultural facility providing entertainment/restaurant venues. . (Limit 15 lines) The proposed roadway will provide public access to a new park-and-ride ramp for vehicles, pedestrians and bike riders. Current access to the park-and-ride surface parking lot is limited to Market Boulevard. This has resulted in peak-hour congestion. The proposed public street will connect to the existing access providing an alternative route to the transit facility as well as a through east-west street. The proposed street will be designed and constructed to City standards with wider lanes and curb and gutter and will incorporate a sidewalk which will connect to the City's existing sidewalk/trail system. The project includes the construction of public roadway and utility improvements to support the proposed construction of a 420 car parking ramp/transit station for SouthWest Transit. The parking ramp is proposed to be constructed along the south side of West 78th Street between Market Boulevard and Great Plains Boulevard, directly behind the Chanhassen Dinner Theater. The public improvements are proposed to be constructed in two phases. Phase 1 will include the demolition of the existing scene shop building for the Dinner Theater and a bus stop enclosure, sanitary sewer relocation, and watermain improvements to prepare for the construction of the parking ramp/transit station. Phase 2 will include street and storm drainage improvements in conjunction with the construction of the transit station. The estimated costs for the proposed improvements are detailed below. These costs include a 10 percent construction cost contingency and a 30 percent allowance for indirect costs. Proposed Improvements Estimated Cost Phase 1 Improvements . The following is a summary of the proposed financing plan for the project. SouthWest Transit is assessed 49% of the street right-of-way and scene shop acquisition, building demolition, street, and storm sewer costs. . City of Chanhassen pays 100% of the costs for depot station site acquisition, the scene shop relocation, and the sanitary sewer and watermain improvements. . All land acquisition costs assume a value of approximately $8.20/square foot. The following is a preliminary schedule for the implementation of the project.
