October 12,2009 FROM: DATE: SUBJECT: Approve Resolution Requesting a Box Culvert Vertical Clearance Variance from MnDOT and Approve Change Order PROPOSED MOTION "The City Council is recommended to approve a resolution requesting a variance from the Minnesota Department of Transportation (MnDOT) for the vertical clearance of a box culvert and approve a change order in the amount of $6,660 for paving the box culvert. City Council approval requires a simple majority vote of the City Council present. " BACKGROUND A box culvert for the pedestrian underpass under Lyman Boulevard, west of Audubon Road, was installed in 2008. The bottom of the box culvert underpass is proposed to be paved so that the surface is not so slippery and can be sanded and salted during wet and icy weather. Lyman Boulevard is subject to State Aid Design Standards, which states that the minimum vertical clearance within the box culvert must be 10'. The MnDOT State Aid Engineer has the authority to grant a variance to allow for a 2" thick paved surface within a 10' high box culvert. The proposed variance will not affect adjacent lands, norwill it affect any person. The variance request was not included at the time of bidding due to time constraints. Staff has reviewed the change order amount and finds it in line with competitively bid prices. Funding for this change is proposed to come from the Park Dedication Fund.
