PROPOSED MOTION
"The City Council is recommended to vacate the drainage and utility easements
on Lots 4 and 5, Block 2, The Arbors as shown on the survey prepared by Otto
Associates dated September 1, 2009.
City Council approval requires a simple/super majority vote of the City
Council present.
BACKGROUND
On behalf of JECWF Trust,
Steve and Jodi Wolfhave
requested that the side yard
drainage and utility
easements on Lots 4 and 5,
Block 2, The Arbors be
vacated. The easement
vacation areas are shown in
grey.

The lot lines on Lots 4 and 5,
Block 2 and Outlot B were
adjusted by an administrative subdivision on May 28, 2008. There are no public or
private utilities within the easements that are proposed to be vacated.
New perimeter drainage and utility easements will be dedicated, as shown above.
The side yard drainage and utility easement on Outlot B (shown in yellow) is proposed
to be vacated as well, however it was not included in the notice for this hearing. Staff
anticipates that this easement vacation will be on the November 6, 2009 City Council
meeting.
