Chanhassen Transit Station, Planning Case File No. 09-18: Vacation
Drainage and Utility Easements
PROPOSED MOTION
"The City Council is recommended to vacate a portion of the drainage and
utility easement per Document Number 30100 and to vacate the drainage and
utility easement per Document Number 30101, as shown on the survey
prepared by Egan, Field & Nowak. Approval is contingent upon filing the
Chanhassen Station final plat and execution of a temporary construction
easement.
City Council approval requires a super majority vote of the City Council
present.
BACKGROUND
Existing public watermain currently extends west from Great Plains Boulevard and
lies south of the Chanhassen Dinner Theater. Public sanitary sewer extends from the
west and currently terminates on the east side of the Chanhassen Dinner Theater
scene shop. Two utility easements were granted in 1976 and encompass the existing
sanitary sewer and watermain. One easement (shown in red) is proposed to be
vacated in its entirety. A portion of the other easement (shown in yellow) is proposed
to be vacated.

within an easement that will be dedicated once the final utility design is complete; a temporary
construction easement will encompass the relocated utilities in the interim.

WHEREAS, the City Council is recommended to vacate a portion of the drainage and
utility easements per Document Number 30100 and to vacate the drainage and utility easement
per Document Number 30101, as shown on the survey prepared by Egan, Field & Nowak.
WHEREAS, approval is contingent upon filing the Chanhassen Station final plat and
execution of a temporary construction easement and
WHEREAS, the existing drainage and utility easements were dedicated and granted to the
City in 1976 per Document Numbers 30100 and 30101; and
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
approves vacating a portion of the drainage and utility easement per Document Number 30100
and to vacate the drainage and utility easement per Document Number 30101, as shown on the
survey prepared by Egan, Field & Nowak as defined on the attached vacation description.
