The City Council is also recommended to adopt the feasibility report for the 2010 Street Reconstruction Project 10-01 (b) - Red Cedar Point Neighborhood and Call the Public Hearing for January 11,2010. City Council approval requires a simple majority vote of the City Council present." BACKGROUND City Council authorized the preparation of the 2010 Street Reconstruction Project at the September 14, 2009 City Council meeting. The Capital Improvement Program had planned for reconstructing the Erie Avenue neighborhood (Chanhassen Estates, south of Lake Drive East) and the Red Cedar Point neighborhood next year. The streets proposed for reconstruction were chosen using the City's Pavement Management Program and were identified due to utility problems in the area. I Erie Avenue area, Project 10-01 (a) Staff proposes to split City Project 10-01 into two parts: 10-01 (a) - Erie Avenue area, and City Project 10-01 (b) - Red Cedar Point area. The streets in the Erie A venue neighborhood are 38 years old and cannot be maintained properly with minor maintenance or even a bituminous overlay. The streets are in poor condition with an average pavement condition index of 28; a road under 45 typically indicates distress that would require a full depth reconstruction. '..m~'" -< ,..... The average pavement condition index of these streets is currently 52, which is higher than most of the other streets, however, it is anticipated these streets will degrade more quickly in the coming years. These streets should be included when the Erie A venue area is reconstructed so a gap of old street section is not left. The watermain in this area is cast iron pipe and has nine documented breaks. The sanitary sewer has been televised and shows many areas of groundwater leaking into the pipe and settled pipes that do not flow well anymore. The storm sewer system should be upgraded and draintile installed. It is proposed to upgrade these streets to the City's standard pavement section with concrete curb and gutter. The watermain should be replaced, sanitary sewer system spot repaired, and storm sewer system upgraded and draintile installed. A neighborhood open house for this project area was held on November 11,2009. Over 22 property owners representing 17 properties attended the open house. The following summarizes the residents' questions/issues: . Will we be able to access our property? . Will this project affect mail delivery to our home? . How will our hauler pick up our garbage? . Weare glad that the streets will not be widened. . Is now the time to reconstruct the streets based on the current economic situation? . Will my sewer and water service be replaced? . I would like to widen my driveway. Who should I contact and when? . We have a new concrete driveway and would like our own contractor to replace any portion that is disturbed by this project. All of the residents' questions were answered at the meeting or with a follow-up phone call. Staffs email correspondences with residents regarding this project are attached. Public hearing notices will be mailed to property owners by January 15, 2010 if this item is approved. CITY PROJECT 10-01 (b): RED CEDAR POINT AREA It is proposed that 0.85 miles of streets in this area be reconstructed. Most of the utilities and streets in the Red Cedar Point neighborhood are 38 years old. The streets are very narrow in most areas and are a rural section. Most of the streets are in poor condition with an average pavement condition index of 48. The streets have been patched several times because of watermain breaks and other utility problems. These numerous street patches are thought to have raised the pavement condition. However, the streets in generally are in poor condition. There may be opportunity to acquire some property for stormwater management. A neighborhood open house for this project area was held on November 18,2009. Over 19 property owners representing 13 properties attended the open house. The following summarizes the residents' questions/issues: . Weare glad that the roads will not be widened. . Will the overhead utilities be buried with this project? . Is now the time to reconstruct the streets based on the current economic situation? . Can we get curb and gutter on south cedar drive? . I do not think our streets look so bad that they need to be reconstructed. . Weare glad that curb and gutter will not be installed everywhere. . Can the intersection of South Cedar at Juniper Avenue and Red Cedar Point Road be widened a couple of feet to improve site distance? . Weare concerned that our underground sprinkler and power will be damaged with the sewer and water replacement. All of the residents' questions were answered at the meeting or with a follow-up phone call. Staffs email correspondences with residents regarding this project are attached. Public hearing notices will be mailed to property owners by December 31, 2009 if this item is approved. FUNDING Forty percent (40%) of the street reconstruction cost is proposed to be assessed back to the benefiting property owners; the remaining 60% of the street costs would be a City cost. The City share of the street cost will be paid out of the revolving street assessment fund. The utility costs are proposed to be paid 100% out of the respective utility fund. While proper preventative maintenance extends the life of the street and is cost effective, a street will eventually deteriorate to a point that further maintenance is no longer cost effective. Rehabilitation projects extend the life of the street. In cases with utility or poor sub grade needs to be replaced or where streets have deteriorated to a point where rehabilitation will no longer be practical reconstruction of the street is necessary. The program also detects and eliminates points of entry of ground water and surface water into the City sanitary sewer system. Projects have been identified from the 2006 Inflow and Infiltration Report. The projects were reviewed by Metropolitan Council and approved in lieu of surcharge fees. Justification 1 City staff has identified numerous older sewer lines that are in need of repair. The City ofChanhassen pays the Metropolitan Council for sewage treatment. Those payments are based on the amount of flow generated by the City of Chanhassen. Surface water and ground water that makes its way into the system either through breaks, displaced joints, manhole covers, or private connections to the system increase the amount charged to the City for sewage disposal and increasing the load on the City's lift stations. Also, MCES would place a surcharge on the annual charge if the City was not actively trying to reduce the inflow and infiltration problem. Thank you. 2 Re: 2010 Street Reconstruction Project No. 10-01 Nov.ll,2009 From Nina Cottrell 8044 Cheyenne Ave. Chanhassen, MN 55317 I did have one sewer problem about 2 years ago when the City was flushing the sewer or something. Water erupted from the toilet on the main level of our house and continued until the procedure was halted. That was a big problem for me. Fortunately, it hasn't happened since. Our water system is old and we are lucky to not have any more problems than we have had. Our streets are in a distressed state with patches upon patches that become potholes and craters over the winters. Our street isn't as crumbly as Erie, but it has a lot of patches. Replacement is needed and will only get more expensive with any delay. There will never be a "good" time to add an assessment to our expenses, but to only have to pay 40% of the street improvement costs, and none, zero of the utility cost is probably the best offer we will have. That equates to at least an additional $1,125 per house (ie the estimated total assessment would be $7,355 vs the $6,230). The final interest rate will be determined by City Council at the assessment hearing. The assessment hearing is tentatively scheduled for April, 2010. A notice will be mailed to you before the meeting. The cost to construct a sidewalk is assessed to the property owners; the City does not finance any portion of the sidewalk construction. If a petition is submitted and the majority of the neighborhood supports the construction of a sidewalk and would be willing to pay for its construction, we will forward a recommendation to Council to add the sidewalk to the project. 1 To calculate the estimated assessments, 40% of the estimated street reconstructed cost was divided among the properties within the project area (the city pays the remaining 60% of the street reconstruction cost). All properties within the project area would pay the same assessment amount. Please contact me if you have any further questions. If a petition is submitted and the majority of the neighborhood supports the construction of a sidewalk and would be willing to pay for its construction, we will forward a recommendation to Council to add the sidewalk to the project. My name is John Cherico and I reside at 8054 Erie Spur in Chanhassen. I recently received a note attached to my door from Mr. Wayne Lytle, who is rallying the neighborhood to oppose this project. I have lived at this address for only 3 years. However, I understand this project was proposed once before but was postponed because a few people objected. Now we are faced with this undertaking once again, only this time the price tag is greater due to the passing of time prompted by the self-serving opposition of a few. I recognize that these are hard financial times for many. Nevertheless, another postponement would allow the road condition to worsen, while the cost continues to increase. Therefore, without knowing all the particulars I would be in favor of this project. Personally I am ashamed of the way the road looks, and the safety hazard it creates. The watermain in the project area is made of ductile iron which is prone to breaks. We have record of 13 watermain breaks in the project area. The sanitary sewer will be repaired or replaced according to the data shown on the televising tapes. We appreciate if property owners notify us individual's underground utilities, such as irrigation lines and invisible pet fences. Private utilities such as gas, electric, cable and telephone were contacted to mark the location of their utilities so that the locations could be surveyed. The 6% interest rate was estimated based upon the interest rate at which the City can borrow. If the project proceeds the final interest rate will be established at the assessment hearing. So, a minimum amount of curb and gutter will be installed to assist with drainage. You will be assessing 40% of the street improvement cost to the benefiting property owners. However, I have learned that the project on our private properties would be limited to digging trenches required for the new sewer and water. Therefore, the 40% should be limited to the cost of digging those trenches and should be considerably lower than the current estimated assessment. It would be different if you would decide to reconstruct the road as mentioned in your November 10 letter, but I believe that is not currently planned. _ Even if the road would be reconstructed, that sti11leaves a black top are in front of my garage and in between house numbers 3603 and 3605 which as a result of the reconstruction of the road would have a surface that would be lower than the road itself. All in all, I would object against the project unless the cost mentioned in your letter would include reconstructing the entire black top area and the interest rate would be brought in line with current interest rates. We would be concerned if adding curbs were part of the street improvement. This neighborhood is very much like a lake cabin neighborhood. There is frequent entertaining of guests invited to the lake. We therefore rely on excess street parking often. Curbs would prevent easy street parking. The curbs would also interfere with being able to trailer boats and other recreation vehicles. We often need to turn around and maneuver cars with trailers. The space limitations are challenging enough without having curbs on the streets. Storm Sewer. As you know, Lake Minnewashta is rated very high in water quality. We are concerned that storm sewer not drain directly into the lake. Currently the water can filter through the grassy areas instead of being directed into the lake. We do not want this project to lead to an expensive lake clean up project that some of the other area lakes are facing. 1 The timing of the project is also a concern. Summer is obviously the peak season for the street use for this neighborhood. There are several large gathering open houses (graduation !family unions! anniversaries) scheduled already in this neighborhood for summer 2010.
