The City Council adopts the assessment roll for City Project 10 -01 a, Eric Avenue Street and Utility Reconstruction." City Council approval requires a super majority vote of the City Council present. POLICY DECISION /ACTION TO BE CONSIDERED Prior to the completion of the assessment hearing, any property owner wishing to object to their assessment must file a signed written objection or they waive their right to appeal. The Council may accept or modify the assessment amount as presented. PROJECT SUMMARY Streets It is proposed that 0.73 miles of streets in this area be reconstructed. The streets in the Erie Avenue neighborhood are 38 years old and cannot be maintained properly with minor maintenance or even a bituminous overlay. The streets are in poor condition with an average pavement condition index of 28; a road under 45 typically indicates distress that would require a full depth reconstruction. Dakota Lane and Erie Circle were overlaid by City crews with a thin layer of bituminous pavement in 2001 due to severe washouts and distressed Chanhassen is a Community for Life - Providing for Today and Planning for Tomorrow Erie Avenue Improvement Project Assessment Hearing May 10, 2010 Page 2 2001 due to severe washouts and distressed pavement areas. The average pavement condition index of these streets is currently 52, which is higher than most of the other streets, however, it is anticipated these streets will degrade more quickly in the coming years. These streets should be included when the Erie Avenue area is reconstructed so a gap of old street section is not left. Soil borings were obtained for this project area. All borings showed less than 12 inches of aggregate base, which is the minimum amount recommended by the soils engineer. A bituminous overlay would not correct the poor subgrade that exists in the project area. Sidewalks and street lights are not proposed to be included. Sanitary Sewer The sanitary sewer in the project area is 8 -inch vitrified clay pipe and was installed in 1971. The sanitary sewer has been televised and shows many areas of groundwater leaking into the pipe and settled pipes that do not flow well anymore. Some of the sanitary sewer services show root intrusion into the pipe. Due to the condition of the pipe, all of the sanitary sewer laterals and services within the right -of -way are proposed to be replaced. Watermain The watermain in this area is eight inches in diameter cast iron pipe and has nine documented breaks. Due to the condition and material, all of the watermain and water service pipes in the right -of -way are proposed to be replaced. Storm Sewer Storm sewer is currently at the intersection of Dakota Lane and Cheyenne Avenue and discharges to a drainage swale and then a wetland to the south. The swale is eroding; therefore additional storm sewer is proposed to be installed to capture the runoff and discharge to a stormwater pond. The proposed storm sewer in Erie Circle will capture runoff from the remainder of the streets. The existing bituminous -lined Swale from the cul -de -sac to Rice Marsh Lake Park will be replaced with a filtration area. ASSESSMENT HEARING PROCEDURE Staff will provide a brief explanation of the work along with the proposed assessment amount. Any issues that the City Council wishes to discuss regarding the project financing is appropriate during the public hearing portion of the project. Public testimony should be received for the project. The property owners should be reminded that if they wish, they must file a written objection with the city either prior to or during the actual project hearings. Objections after the public hearing are invalid. The assessment objection is a request by the property owner for the council to review the assessment amount. Staff may have an immediate response to individual comments, or in some circumstances, the objection should be received and referred to staff for investigation. The remaining assessment roll should be adopted. If the City Council feels the objections cannot be addressed immediately, a report will be presented to council regarding all objections on that Erie Avenue Improvement Project Assessment Hearing May 10, 2010 Page 3 particular project at the next City Council meeting. Council should adopt the remaining assessment roll at that time in order for the process to stay on schedule. If there are no objections filed, or if council feels confident staff's investigation will not result in any changes being made to the assessment roll, a motion by the City Council adopting the assessment roll as prepared is needed for the project. ASSESSMENT OBJECTIONS Objections may be filed up to and at the public hearing. At the time of this submittal, no written objections have been received. If any written objections are received in the interim prior to the council meeting, they will be provided to the council at the public hearing. Staff comments and recommendations will also be provided at the public hearing. The City Council may choose to adopt staff's recommendation or revise the assessment roll. If additional objections are filed either prior to or at the hearing, they should be received and if necessary referred to staff for investigation and resolution. PROJECT SUMMARY: ASSESSABLE COSTS Improvements within the project include reconstruction of the street, the replacement of sanitary sewer and watermain, and storm sewer improvements. Forty percent (40 %) of the street improvement costs are proposed to be assessed against the benefitting properties. PROJECT COSTS AND ASSESSMENTS Per the city assessment practice, forty percent (40 %) of the street costs are proposed to be assessed to the benefiting property owners; the City will be responsible for the remaining 60 %. One hundred percent (100 %) of the utility costs will be paid for by the respective enterprise funds. The final unit assessment amount is $528.11 lower than the engineer's estimate. Staff held an open house on April 29, 2010 to discuss the final project design and assessment amounts with the residents. Six people representing four properties attended. All were generally satisfied with the proposed project and assessments. BID OPENING /AWARD OF CONTRACT Bids were received and opened and readout loud on Friday, April 9, 2010 at 2:00 p.m. Fourteen bids were received. The lowest bidder is Kuechle Undergound, Inc. at $1,514.284.63 for the base bid and bid alternate #1 (for water service replacement). The bids have been tabulated and are summarized below. Kuechle Underground, Inc. has successfully completed many street reconstruction projects similar to the Erie reconstruction project. Their work, ability to manage a project like this, and customer service delivery has been acceptable. FUNDING SUMMARY Funding for this project was budgted in the 2010 CIP.
