City Council approval requires a simple majority vote of the City Council present." DISCUSSION The project includes the mill and overlay of the Medical Arts and Colonial Square Parking lots. Miscellaneous storm sewer work is also proposed. Bids were received and opened on Friday, July 30, 2010, and are currently being tabulated. Seven bids were received. The project appears to be under budget at this time. The final assessment amount is not known at this time, however, it is recommended to call the assessment hearing in order to keep the project on schedule. FUNDING lb Medical Arts Parking Lot City Project 10 -05 Special assessments to the benefitting properties are proposed to pay for the costs associated with this project. Per state statute, the City Council must call the assessment hearing and publish the hearing date at least two weeks prior to the assessment hearing. Staff intends to publish the notice in the August 26, 2010 edition of the Chanhassen Villager. This schedule provides just over two weeks time between the publication date and the assessment hearing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CHANHASSEN, MINNESOTA: 1. A hearing shall be held on the 13 day of September, 2010 in the Council Chambers at City Hall at 7:00 p.m. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The city clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and shall state in the notice the total cost of the improvement. The clerk shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearing. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City of Chanhassen, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. The property owner may at any time thereafter, pay to the City of Chanhassen the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. Passed and adopted by the Chanhassen City Council this 9 th day of August, 2010. The property owners are responsible for plowing the lot in he winter, but the City is responsible for maintenance of the parking lot. The lot is 20 years old and needs to be improved. The bituminous ;av has many potholes and allegatored pavement distress. The improvements are proposed to be assessed back to the benefiting property Justification I I The parking lot has reached the end of its service life and should be improved.
