2010 Goals
1. Complete the Planned Unit Development (PUD) rezoning.
Each of these sites has specific ordinances that govern it; however, there are instances when the PUD is
silent on certain requirements such as parking, sign design standards, etc. In such instances, the City
Code must be referenced to govern these sites. Staff found a number of PUDs that do not reference the
City Code. Also, as part of the expansion of downtown and to allow sites to develop to their full
potential, PUDs within the downtown area were amended to allow for more intensive uses. Some of the
downtown PUDs referenced the General Business District (BG) as an underlying district. These PUDs
were amended to reference the Central Business District (CBD). The CBD zoning will address the
issues raised by the retail market study as it allows more intense development/redevelopment.

2. Review Uses in the Commercial Zoning District.
The Planning Commission reviewed potential changes to Chapter 20 pertaining to permitted uses within
Commercial Zoning Districts: Central Business District (CBD), Neighborhood Business (BN), Highway
and Business Services (BH), and Fringe Business (BF). In 2008, staff began reviewing the uses in each
commercial district. In 2009 the Community Commercial (CC) District was adopted to permit "Big
Box" users.
Additionally, there are two directions to permit uses within the district regulations:
1. List a broad use, as specified in the Standard Industrial Classification (SIC) Manual, i.e. Specialty
Retail, which allows for flexibility.
2. List individual uses under that classification, i.e. shoe store, stationary store, etc.
Staff conferred with the City Attorney regarding this issue. It is the City Attorney's opinion that the list
of permitted, accessory, conditional, and interim uses should be as specific as possible.
The Planning Commission in their review of the Central Business District has recommended that the
specific uses be referenced. As part of the public hearing process, the Chanhassen Business Council was
asked to comment on the proposed amendment. Their primary concern is that the ordinance should
"provide an atmosphere which encourages business growth and innovative concepts ". They recommend
that we use more general terms, rather than being specific and that we combine all similar uses. It was
also suggested that we may want to rely on amending the definition to help expand potential uses, e.g.,
change "retail sales" to "retail" and expand to include renting items for use. Overall, their
recommendation is to maintain the greatest flexibility and inclusiveness, relative to uses, in the district
regulations.
Prior to continuing with their,, review, the Planning Commission would like direction on this issue.
3. Evaluate staff report format.
In an effort to make the motion process easier, the Commission looked at revising the staff report
format. Based on discussion with staff, a simplified motion was provided for the Planning
Commissioners. However, because of the importance of providing complete review and the ability to
understand decisions and conditions of approval, the body of the report would remain.
4. City Council replacement policy for Planning Commission vacancies.
The Planning Commission recently had a vacancy created due to resignation of a member. The
Commission would like to know whether City Council desires to replace these members soon or
whether they would like to wait until the spring when terms end and the City advertises for applicants
for the Planning Commission.
