condition index of 48. In 2000, some street sections were overlaid by City crews due to
complaints from residents which have increased the pavement condition index. The streets have
been patched several times because of watermain breaks and other utility problems. These
numerous street patches are also thought to have also raised the pavement condition
Staff obtained soil borings for this area which showed poor subgrade material and little or no
aggregate base. In some areas it was found the bituminous pavement was 11" thick with no
aggregate base. The new pavement section is proposed to be 3.5" of bituminous pavement over
10" of Class 5 aggregate base. A sand subgrade section and /or a geotextile fabric will be used in
areas with poor soils.
Curb and gutter is proposed to be added to help drainage. No new storm sewer treatment
facilities and storm sewers are planned due to lack of available land. Most of the curb and gutter
to be added will be surmountable due to the narrow roadway width. Raised -back curb and gutter
(B618) is proposed on the west end of Red Cedar Point Road at the entrance to the
neighborhood.
Sidewalk and street lighting are not proposed with the project improvements.
Sanitary Sewer
The sanitary sewer system in the project area consists of 8 -inch and 10 - inch PVC and cast iron
pipe (CIP) installed in 1971. Televising tapes have found the structural condition of pipe varies
between fair and poor with several notable deficiencies. These deficiencies consist of root
intrusions and mineral deposits at joints and service laterals. The manholes within the project
area were observed to be leaking and had mineral deposits present. The sewer system, however,
seems to drain adequately with no significant bellies or dips in the system identified.
The poor conditions of the manholes have warranted a process of internally sealing the
manholes. This is proposed to be completed by epoxy coating the interior of the manholes.
Castings within the project area will be replaced.
Watermain
The existing water distribution mains in the project area were installed in 1971 and consist of
both 6 -inch and 8 -inch cast iron pipe (CIP). There have been numerous documented breaks in
the system including a watermain break that occurred last week on Juniper.
The proposed watermain improvements consist of replacing the existing 6 -inch and 8 -inch cast
iron watermain with new 8 -inch HDPE pressure main. This will improve delivery of potable
water and fire flow volume at reasonable pressure and head loss. The watermain pipe is
proposed to be installed this fall using directional boring techniques to minimize restoration costs
this fall, reduce water interruptions during construction, and less inconvenience during
construction due to the narrow streets.
Storm Sewer
The limited public land available and narrow right -of -way in this area limits the options for
stormwater improvements.

The existing 12 -inch metal pipe under Red Cedar Point Road will be replaced with a new, 12-
inch concrete pipe. The elevations of the existing pipe will be matched to minimize impacts to
the existing wetland located in the low area south of the culvert.
Private Utilities
Existing private utilities consisting of gas, electric, telephone, and cable are located within the
street boulevards. The gas company has already relocated some services. The utility services for
the facilities will be impacted during construction. Coordination with the private utility
companies will be made to maintain service to the property owners.
The majority of electric power, telephone and TV cable are overhead. The cost for the
underground conversion would be the responsibility of the residents. Staff obtained cost
estimates to bury the overhead utilities and presented the information to the neighborhood. The
residents felt the cost was too high, therefore underground conversion is not proposed with this
project.
PROJECT SUMMARY: ASSESSABLE COSTS
Improvements within the project include reconstruction of the street, the replacement of sanitary
sewer and watermain, and storm sewer improvements. Forty percent (40 %) of the street
improvement costs are proposed to be assessed against the benefitting properties.
PROJECT COSTS AND ASSESSMENTS
Per the city assessment practice, forty percent (40 %) of the street costs are proposed to be
assessed to the benefiting property owners; the City will be responsible for the remaining 60 %.
One hundred percent (100 %) of the utility costs will be paid for by the respective enterprise
funds.

The assessments were calculated as follows:

$274,397.63 ± 70.18 assessment units = $3,909.91 /assessment unit
Single - family lots within the project area are each one assessment unit, for a total assessment of
$3,909.91. The estimated unit assessment identified in the feasibility report was $5,037.33 for
single - family lots. The final single - family unit assessment amount is $1,127.42 lower than the
engineer's estimate.
The Red Cedar Cove Townhomes consist of 18 units. The total assessment for the townhomes is
3.18 assessment units, or $12,433.51. The 3.18 assessment units equals the townhome frontage
to public right of way divided by the average frontage of a single - family home. The assessment
for each townhome is calculated as follows:
$12,433.51 ± 18 townhomes - $690.75 /townhome
Staff held an open house on September 29, 2010 to discuss the final project design and
assessment amounts with the residents. Representatives from six properties attended. The main
concern staff heard at this meeting was how the assessments were calculated between the single -
family homes and the townhomes.
Proposed terms of the assessments are 10 years at 5.25% interest. Since the street work will not
be completed until July of next year, interest and principle is proposed to start January 1, 2012.
This means the property owners can pay off the assessment in full without interest until
December 31, 2012.
BID OPENING /AWARD OF CONTRACT
Bids were received, opened and read out loud on Friday, September 3, 2010 at 10:00 a.m. Five
bids were received. The bids have been tabulated and are summarized below. The lowest
responsible bidder is GM Contracting, Inc. at $1,013,499.38.

GM Contracting, Inc. has worked on a number of projects in the City. Their work, ability to
manage a project like this, and customer service delivery has been acceptable.

ASSESSMENT HEARING PROCEDURE
Staff will provide a brief explanation of the work along with the proposed assessment amount.
Any issues that the City Council wishes to discuss regarding the project financing is appropriate
during the public hearing portion of the project. Public testimony should be received for the
project. The property owners should be reminded that if they wish, they must file a written
objection with the City either prior to or during the actual project hearings. Objections after the
public hearing are invalid.
The assessment objection is a request by the property owner for the council to review the
assessment amount. Staff may have an immediate response to individual comments, or in some
circumstances, the objection should be received and referred to staff for investigation. The
remaining assessment roll should be adopted. If the City Council feels the objections cannot be
addressed immediately, a report will be presented to council regarding all objections on that
particular project at the next City Council meeting. Council should adopt the remaining
assessment roll at that time in order for the process to stay on schedule. If there are no objections
filed, or if Council feels confident staff's investigation will not result in any changes being made
to the assessment roll, a motion by the City Council adopting the assessment roll as prepared is
needed for the project.

ASSESSMENT OBJECTIONS
Objections may be filed up to and at the public hearing. At the time of this submittal, no written
objections have been received. If any written objections are received in the interim prior to the
council meeting, they will be provided to the council at the public hearing. Staff comments and
recommendations will also be provided at the public hearing. The City Council may choose to
adopt staff's recommendation or revise the assessment roll. If additional objections are filed
either prior to or at the hearing, they should be received and if necessary referred to staff for
investigation and resolution.

WHEREAS, pursuant to proper notice duly given as required by law, the Council has met
and heard and passed upon all objections to the proposed assessment for the improvement of:

NOW THEREFORE, BE IT RESOLVED by the City Council of Chanhassen, Minnesota:
1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, if
hereby accepted and shall constitute the special assessment against the lands named therein,
and each tract of land therein included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over a period of
ten (10) years, the first of the installments to be payable on or before the first Monday in
January, 2012, and shall bear interest at the rate of 5.25 percent (5.25 %) per annum from
January 1, 2012. This assessment will show up on the first property tax statement for 2012.
To the first installment shall be added interest on the entire assessment from January 1,
2012 until December 31, 2012. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the county auditor, pay the whole of the assessment on such property, with
interest accrued to the date of payment, to the city treasurer No interest shall be charged if
the entire assessment is paid before January 1, 2012. The property owner, at any time
thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid,
with interest accrued to December 31 of the year in which such payment is made. Such
payment must be made before November 15 or interest will be charged through December
31 of the next succeeding year. If the property owner decides not to prepay the assessment
before the date given above, the rate of interest that will apply is 5.25 percent (5.25 %) per
year. The right to partially prepay the assessment is not available.
4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the County. Such assessments shall be
collected and paid over in the same manner as other municipal taxes.

Justification I -
The City uses a Pavement Management System to monitor the condition of the City streets. While proper preventative maintenance extends the
life of the street and is cost effective, a street will eventually deteriorate to a point that further maintenance is no longer cost effective.
I Rehabilitation projects extend the life of the street. In cases with utility or poor sub grade needs to be replaced or where streets have deteriorated
to a point where rehabilitation will no longer be practical reconstruction of the street is necessary. A feasibility study is written to consider the
merits of the project and scope of work. -
