As can be seen the July flows for the city were significantly higher than normal. It is requested that the city conduct a review of it's sanitary sewer system for possible sources of infiltration and inflow (I/1) that occurred during this period and determine the appropriate action the city will take to reduce and/or eliminate the I/1 sources. A copy of your analysis should be submitted to my attention. Biking tracks have been a topic of conversation among our Park and Recreation Commission members in the past. This Commission is a seven member group of local residents who advise the City Council on issues pertaining to parks and recreation. I will submit your inquiry to them on September 23, 1997. Upon printing the Commission's agenda for that evening, I will mail you a copy. I encourage you to attend this meeting to discuss your idea with the Commission. Approximately one year ago, a small group of high school students approached the Commission on a similar issue, an aggressive skate park. Today, plans are being made to construct such a facility at City Center Park. Again, thank you for your letter of inquiry. If you are able, please attend the Park and Recreation Commission meeting on the 23` of September. The meeting starts at 7:30 p.m. and is held at Chanhassen City Hall in the Council Chambers. Chamber member sponsorships have helped ensure the vitality of youth sports, which play an important role in the health of our community. However, with the city's rapid growth over the past ten years, keeping these activities organized has become increasingly complex. The Chanhassen Athletic Association (CAA) has reached a crossroads. To set a new course, we are in need of one special individual to act as a "change agent" over the next three months. The attached news release written by A.J. Dordel, the CAA President, explains the need for this three month "reorganization" initiative. The key to this process is a qualified facilitator. The city has solicited proposals from consultants who work in the field of facilitation. however, the proposals received are from persons unfamiliar with our community and are very expensive. Thus, our request for one chamber member to step forward volunteering to facilitate this process either personally or through appointment of a qualified employee. The future of youth sporting activities in Chanhassen depends on our ability as community leaders to respond to the growing demand for youth programming. Please call me today if you can help or know someone who can. It is my desire to identify a facilitator and conduct an introductory meeting with that person and the current CAA board members by the end of September. Thomason 141 Choctaw Circle Chanhassen, MN 55317 Dear Mr. Thomason: A copy of your letter of September 3, 1997 as well as this response has been forwarded to the Mayor and City Council. The city's late fees and certification costs have very little to do with the cost of borrowing money to make up for late payments. The cost of certification is a very real cost for the city. Specifically, sending notices, removing properties from the main computer system, advertisement, hearings, and finally, certification to the county are all highly labor intensive. Following certification, the city incurs additional costs for auditing, receipting, and accounting for that secondary set of accounts. As a consumer, I can fully understand and would agree with your comments that the amounts charged by the city are significant. However, I would disagree that costs are absorbent for more than the costs incurred by the city in handling delinquencies. Despite the fact that the charges are high to offset our costs, we typically have upwards of 200 accounts that are delinquent each year. Ironically, 75% of the names on that list continue year after year. Finally, 1 believe our finance department tries to work with our customers. We have had several cases where the property owner has notified us of their inability to make a particular payment and his /her desire to start making payments of S20 or S30 a month until the bill is paid. We have honored those request, however, in this instance, so many months have gone by with no payment and the balance has reached such a proportion that we are forced to follow state statute as it deals with procedures for repayment of extended utility delinquencies. In addition the city appears to instruct its employees. Pam Snell and Danielle Washburn with whom I spoke about my delicate situation yesterday, to be firm in demanding to pay up before November 1 of this calendar year or else the past due balance and vet another 20 percent administrative surcharge will be added to my 1998 property tares. This practice absolutely violates any form amorally fair behavior the city and its council has in harboring the well-being of its residents. I am appalled about the careless- ness and ruthlessness the city and its council displays in this matter and 1 am particularly upset about the excessive late charges that are applied to the quarterly bill. I do not understand how the city can justify these outrageously high late charge fees that vary from 20 to 32.4 per cent, when the city. its staff and workers do not incur any additional operational or administrative costs in connection to water and sewer services rendered which are annually budgeted and paid for by me and other tax pavers. The only explanation for this is greed instilled by the city's governing body and its absolute disregard for the well -being of its residents. Given the site's steep slopes and impacts to wetlands, it is extremely important that all disturbed areas be revegetated and the stormwater ponds be repaired as soon as possible. According to the site plan agreement with the City (#96 -8), Page 2, Paragraph 4, all landscaping has to be installed by July 30, 1997. After the intense thunder stomi we experienced today, I would also suggest a reinspection of the erosion control silt fence on the project. I understand the buildings are nearly completed and that you will be requesting a Certificate of Occupancy. Please be advised the site restoration must be completed and ponds repaired prior to issuance of a Certificate of Occupancy. Please contact me with your schedule for site restoration. The rains have washed large amounts of mud and silt down to the City's storm sewer and eventually plugged the storm sewer, thus flooding the City's street. Erosion control measures in place have been obliterated over time and erosion control measures need to be re- established and the site re- graded and seeded and mulched to control erosion from washing into West 78 Street. Please have this work done as soon as possible and no later than September 26, 1997 or the City will hire a contractor to perform the necessary work and use your letter of credit accordingly.
