SUBJ: Approve the Granting of an Easement in Favor of Williams Brothers Pipeline over
a Portion of Outlot A, Lake Susan Hills West 9` Addition - Project No. 93 -29
The attached letter from Carver County Assistant Engineer, Bill Weckman, does a good job of
outlining the background regarding this matter. Basically, the 30' x 166' easement lies within
Outlot A of Lake Susan Hills West 9 Addition. Outlot A has been previously dedicated to the
City as open space passive park area. I have spoken with Park Director, Todd Hoffman,
regarding this matter and the Park Department does not have a problem in granting this easement.
Since this easement and the associated revised access to the Williams Brothers Pipeline is
estimated to save the County Road 17 (Powers Boulevard) project approximately $100,000 in not
having to extend casing pipe, staff believes this is a reasonable alternative for the pipeline
company.
It is therefore recommended the City Council approve the easement as described in Attachment
No. 2 in favor of Williams Brothers Pipeline over, under and across the west 30 feet of Outlot A,
Lake Susan Hills West 9` Addition as described, said easement totaling 0.11 acres.

As you know, as part of the Powers Blvd construction, there was some work completed over the
Williams Pipe Line easement. Originally there was a proposal to install a new casing for the pipeline
under the roadway. That would have resulted in a project costing over $100,000. Once the existing
casing ends were located, it was determined that if the enslope were steepened on the roadway,
the toe of the slope would not go outside the casing. The enslope on the old roadway was 4 foot
horizontal to 1 foot vertical, the new enslope has a slope of 1.4 foot horizontal to 1 foot vertical. As
a result of this change in slope, Williams Pipe Line is claiming their access to their easement has
been worsened and wants better access to their easement for maintenance and emergency use.
It was agreed that if an access could be graded down to their easement, and an access easement
were approved, that would be acceptable to Williams Pipe Line to resolve this issue.
The access has been graded down the slope. The as built survey indicates that the access does
extend beyond the permanent roadway easement into outlot A which is City parkland.
have had the access surveyed and prepared a description of the access area. Attached is a
sample access easement that the County has used on other projects.
Could you review the attached information with other City staff? Please let me know if the City
would agree to approving this access easement. The only other way that I know of to resolve this
issue is to extend the casing as originally proposed. The approval of this easement would resolve
this matter at a substantially lower cost to the City and County.
Williams Pipe Line would like this issue resolved very soon.

EASEMENT
THIS AGREEMENT made , 1997, by and between the City of Chanhassen,
690 Coulter Dr., Chanhassen, Minnesota 55317, a Minnesota Municipal Corporation, (hereinafter
referred to as "GRANTOR "), and Williams Pipeline Company, PO Box 3448, Tulsa, Oklahoma
74101 (hereinafter referred to as "GRANTEE ").
1. GRANTOR, in consideration of the sum of One Dollar ($1.00) and other good and valuable
consideration to GRANTOR from GRANTEE, receipt of which is acknowledged, grants to
GRANTEE, its successors and assigns, forever, a perpetual easement at all times to use
as access to their pipeline easement, under and upon the following described property
( "property ") in the City of Chanhassen, County of Carver, State of Minnesota:
The easement is described as follows:
A utility easement over, under and across the west 30.00 feet of Outlot A, Lake Susan Hills West
9th Addition, lying south of the following described line:
Commencing at the southwest corner of said Outlot A, thence on an assumed bearing of
North 3 degrees 27 minutes 10 seconds West along the west line of said Outlot A, a
distance of 149.28 feet; thence northerly along a tangential curve 50.72 feet, said tangential
curve having a radius of 1070.92 feet to the beginning of the line to be described; thence
easterly on a radial line to said tangential curve a distance of 30.00 feet and said line there
terminating.
Said easement contains 0.11 acres.
