16, Auditor's Subdivision No. 2 - Vacation File No. 97 -1
The City has received a vacation application from Mr. Ted deLancey's attorney, Mr. David
Hubert, requesting the City release the existing sanitary sewer easement over Lot 13 and part of
Lot 16, Auditor's Subdivision No. 2. This request is in conjunction with the platting of Mr.
deLancey's property into The Frontier Addition. Currently, the parcel is subject to a sanitary
sewer easement over the entire parcel (blanket easement). The applicant is requesting that this
blanket easement be extinguished and replaced with a new utility easement 20 feet wide centered
upon the existing sanitary sewer on the property. Staff has reviewed the vacation application
request and finds that the public interest will be protected upon the recording of the final plat
(Frontier Addition).
It is therefore recommended that the City Council adopt a resolution vacating the existing sanitary
sewer easement located over Lot 13 and part of Lot 16, Auditor's Subdivision No. 2 contingent
upon it being rededicated on the new plat of "The Frontier ".

Dear Mr. Hempel:
Pursuant to our previous communications in regard to the above referenced matter, I am
enclosing herewith the following items:
1. Application for Release of Sewer Easement executed by myself as attorney for and on
behalf of Mr. Ted H. deLancey, the owner of the property over which the sewer line is
presently located.
2. Our check payable to the City of Chanhassen in the amount of $150.00 in payment of
the application fee.
3. Copies of pages from the Abstract of Title to the deLancey property evidencing the
ownership of Mr. deLancey in the subject property.
4. Copy of a Carver County half - section plat for the south half of Section 12- 116 -23
indicating the approximate present location of the easement.
5. Survey of the deLancey property that is being used for the registration of title action.
6. 15 copies of an easement description sketch as prepared by Westwood Professional
Services, Inc. On this sketch the easement is shown as it is located in reference to the
proposed Frontier plat and also with the legal description specifically set forth and
calling for a 20 -foot wide easement.

Pursuant to our discussion, it is my understanding that in regard to sending out notices
of the hearing on this request, you will be able to use the list of the property owners and
addresses that were involved for the preliminary hearing on the preliminary plat. This would
be a great help in that it would be quite a job to obtain a new list and probably should really not
be necessary in that, as you know, the easement itself is not going to be abandoned, but simply
releasing the present description and agreement to be replaced by the dedication on the plat of
the Frontier.
Hopefully, everything is in order for you to proceed with this request. If anything

NOTICE: You are invited to attend a public hearing about a proposal in your area. The
applicant, Ted deLancey, is requesting vacation of an existing sanitary sewer easement
located over Lot 13 and part of Lot 16, Auditor's Subdivision No. 2 which will be rededicated
on the new plat of "The Frontier."
What Happens at the Meeting: The purpose of this public hearing is to inform you about the
developer's request and to obtain input from the neighborhood about this project. During the
meeting, the Commission Chair will lead the public hearing through the following steps:
1. Staff will give an overview of the proposed project.
2. The Developer will present plans on the project.
3. Comments are received from the public.
4. Public hearing is closed and the Commission discusses project. The commission will then
make a recommendation to the City Council.
Questions and Comments: If you want to see the plans before the meeting, please stop by City
Hall during office hours, 8:00 a.m. to 4:30 p.m., Monday through Friday. If you wish to talk to
someone about this project, please contact David Hempel at 937 -1900 ext. 123. If you choose to
submit written comments, it is helpful to have one copy to the department in advance of the meeting.
Staff will provide copies to the Commission.
