The City Council has requested that staff distribute Council packets on the Wednesday preceding a Council meeting
as opposed to Thursday's as has been done in the past. In an effort to accommodate this request, invoices must be
submitted to Finance on the preceding Friday with proper approval, account coding and descriptive explanation of
purchase in order to be paid for that Council meeting. For example, for the 01/27/97 Council meeting, invoices must
be submitted to Finance by tomorrow, 01/17/97. Just a reminder, invoices without proper approval. account coding
and explanation will be returned. Good explanations of purchases answer two questions (What is it? AND What or
Who is it For ?) Thank you for your cooperation?

Dear Roger:
I am looking forward the rmeetm2 with the Chanhassen Cite Council on Monday. January 6 to
discuss the Postal Service Carrier Annex issue. I understand that Tom Scott may attend this
meeting in your absence. If so, please pass my letter along to Tom for his review prior to the
meeting.
The purpose of my letter is to clearly outline my concerns, and to urge you to constantly reiterate
the seriousness of these concerns to the Postal Setviee. A.s you know, the Postal Service has clone
nothing to gain the trust of the neighbors, and we expect you to make sure they complete any
cormnitrnents they make to us.
My concerns are:
1. The sound consultant will be allowed by the Postal Service to study only the conservation
casement area. I believe the sound study needs to include the loading clock area as well, so
that reeotntnendations can also be made to reduce noise from the loading docks.
2. The Postal Service intends to construct the berm as far south as possible. This would result in
the destruction of many existing trees, which can not feasibly be replaced in kind, as the
Postal Service claims. The been should be located as far north as possible, tivhilc still
providing adequate height to block our view of the building from our main floors. This needs
to be accomplished even if it results in the Postal Senice altering their current parking lot
plan.
I believe the Postal Service has no plans to repair or replace the bike trail they have covered
with the existing stock pile of dirt. I believe the Postal Service is expecting the City of
Chanhassen to take care of repairing and rerouting the trail. This issue needs to be addressed
as soon as possible, so we can get a firm commitment from the Postal Service. Please do not
overlook this issue until it is too late. The location of the trail needs to be determined, and it
should not cause the removal of any existing trees.
4. Critical to obtaining an appropriate height been are detailed elevations for all homes
bordering the Annex property. Elevations need to be supplied to the sound consultant and
architects, and a layman's explanation provided to the neighbors. so that vve are all confident
the berm will be tall enough.

5. The Postal Service needs to commit to a time table for responding in full to our concerns,
and for outlining what they are going to do to satisfy our concerns. There is no reason this
can not all be accomplished by the end of January. They have stalled loll- enou -h.
6. Regular communication to the neighbors needs to be provided for. I recommend that the
Postal Service Annex be inserted as a standing old business agenda item on all Chanhassen
City Council meetings from now until the facility is completed, and the neighbors concerns
are satisfied. This would serve as an excellent forum for all interested parties. Please pass
this recommendation along to the Council.
7. Continue to leave open the possibility of litigation. As I mentioned, no one trusts the Postal
Service. I am still not convinced they are planning to provide us with an adequate berm or
landscaping. I Null believe it only when I see it. The fact that the Postal Service has placed
this situation in the hands of their attornevs suggests to me that they intend only to live up to
the letter of the law. «'e all know they can do whatever they please and get away Nzith it, if
that is «Ghat they choose to do.

Thank you for stopping by the office yesterday to establish a 1997 rental agreement for the
Bandimere Farm property. As agreed, you can act as the named leasee on the 24 acres of
agricultural land in return for a cash payment of $1,200. You will maintain control of the
property under this lease until Sunday, August 31, 1997. If the City of Chanhassen wishes
to tenninate your lease prior to August 31, the following escape clause will apply.
If the City of Chanhassen wishes to commence construction of Bandimere
Community Park prior to August 31, 1997, it shall meet the following two
conditions:
1. Release leasee from cash payment obligation.
2. Reimburse leasee $250 in "input" costs.

Company, znc. , in which Mr. Luebben states that in his or7„nion
t1ne value of yo property will decrease an estimated 11$ if this
house :'s moved onto your neig::boring property. This is certainly
a significant decrease in the value o_` your property-
Y ou have also provided me wit: a copy of the Chanhassen City
Ordinances regulating moving used buildings into the city.
Specifically, Section ":7 -3i provides in relevant part that "All
used buildings moved into or iti:in ;.he city Shall comply with
the following * x * (4) The building .ail.l not materially
depreciate surrounding property values. Section 17 -44 provides
that the C ty may approve the permit only if the standards of
Section 17 -31 are met or if additional conditions are required.
Assuming that IUir. Luebben_ is correct in stating that your
property ,Jill decrease in value by 11% it this proposal
continues, the City should not approve this croposa'. To the
extent that you are damaged as a result of the City viclating its

Summary of request
Based on my appraiser's findings, I request that the house moving
applicant's plans be screened for any devaluation influences by,
one or more, certified appraisers. Only this can best satisfy part
D) of the code designed to protect residents from devaluation.
The applicant's plans should be screened before any house moving
occurs or plans finalized.
The applicant should pay for these necessary and fair appraisals
according to the contract he signed with the city which states
applicant shall pay for all expenses city incurs with permit
approval process.
Other minor items list on next page need to be re- considered.
The moving deal needs the following items looked at:
1. The basis for the assessments have been proven false, way low.
For example 6728, Tommy's most immediate neighbor,
recently sold for 238K when it was assessed at only 139K.
That's 70% ' above the assessment the council used to
determine Tommy's house value. What if other houses are this
high or higher? This is why the 130K average assessment is
not appropriate for this street. None of the houses on our street
would likely sell for that little.
2. Tommy's house may not assess at 130K due to winter deterioration. His oak floors are currently covered with snow
as the roof has caved in and they are now going through the
freeze thaw cycle. The plaster cannot be doing well either,
exposed to the weather. We need safeguards here.
3. The conditions need to be rewritten with clearly stated goals
for "the curb appeal of the house ". So that it looks good from
the outside. This is what counts to the neighbors but there is
nothing in the conditions of the moving permit about this.
4. The completion deadline will most likely not be met at this
point. We are 2 months into this mess and there is still not even
silt fence up around the lot! I have called 3 times about is
� an sti nothing.
5. And no wonder the completion deadline is not being met, l � 1
because there is no real penalties mentioned for not meeting
them. We need a performance bond in case he does not finish.
And stiffer penalties for non - compliance here. X11 � epO
6. I talked to the assessor who was recently out looking for
Tommy's house and she didn't even know anything about the
condition stating that the house would have to assess for 130K.
7. All this indicates that we should attach a professional appraiser
this matter right away to assure that neighbors are protected.

operation. The applicant shall escrow 5500 with the City to guarantee reimbursement of
monitoring or inspection fees. A 52,000 surety bond shall also be provided to the City by
the applicant and/or contractor to guarantee any street repairs resulting from the moving
Operation.

4. The applicant shall conform with local street weight restrictions. A weight distribution
diagram shall be supplied to the City Engineer for review and approval or the City may
also weigh the apparatus to ensure weight restrictions arc being maintained.

SUBJ: Meeting schedule for the Environmental Commission
The Environmental Commission voted to change the meeting schedule in 1997 to two meetings
each month, instead of one, for as long as the need exists. The members felt that not enough was
accomplished at the one monthly meeting. Two meetings would help give them the time and
attention needed for agenda items. In addition, event planning for Arbor Day, Earth Day, and
Park Pride Day has begun by the Commission and the extra meeting dates are needed for these
items specifically. Please let me know if there is a problem you can foresee with the
Commission's schedule change. Otherwise, their next meeting with the new schedule will be

SUBJ: House Fire
At approximately 0730 hrs this morning, a house fire was reported at a new home under
construction on Fawn Hill Drive in Chanhassen. Upon arrival, the Chanhassen Fire
Department found the house fully engulfed in flames. Mutual aid was requested from the
Eden Prairie and Excelsior Fire Departments. The house is a total loss. The Chanhassen Fire
Marshal and the State Fire Marshal are investigating the cause of this fire. The house was
unoccupied and there were no injuries of fire fighters during this event.

Attached is "A Resolution Establishing Municipal Sewer and Water Rates" for 1997. These rates are in
accordance with the projected revenues for the proposed 1997 budget. I have also attached a copy of the
Deloitte & Touche 1995 Management Recommendation referencing the City's utility rates.

A RESOLUTION ESTABLISHING MUNICIPAL SEWER AND WATER RATES
WHEREAS, this municipality maintains a public sanitary sewer system and public water
system; and
WHEREAS, Chanhassen City Code Chapter 19 provides that the City Council may from
time to time establish revised rate schedules for usage of the public sanitary sewer system and the
public water system.
NOW, THEREFORE, BE IT RESOLVED, by the Chanhassen City Council:
The following water use rates are hereby established:
A. Connected Structures
The following charges are imposed on each structure connected to the
municipal water system:
(1) A minimum charge of 55-.7-5 $6.35 per dwelling unit or per billing
statement generated for quarterly water usage not exceeding 5,000
gallons.
(2) A charge of & $1.30 per 1,000 gallons, or fraction thereof, for all
quarterly water usage up to 25,000 gallons; and
(3) A charge of &4-.-3-5 $1.50 per 1,000 gallons, or fraction thereof, for all
quarterly water usage in excess of 25,000 gallons.
(4) A charge of $8.00 per year for each connection to the municipal
water system to support mandated water quality testing services.
B. Unconnected Structures
A quarterly charge of $10.00 is hereby imposed on each single family
attached dwelling, each single family detached dwelling, each commercial
structure and each industrial structure which is not connected to the
municipal water system when municipal water service is available.
2. The following sewer usage rates are hereby established:
A. Structures Connected to Both Sewer and Water
A quarterly charge, based on winter quarter municipal water usage,
is hereby imposed on each single family dwelling, each commercial
structure and each industrial structure, which is connected to both the
municipal water system and the municipal sewer system as follows:
(1) A separate billing statement shall be generated for each water meter,
and
(2) A charge of $2.60 per 1,000 gallons or fraction thereof for all
quarterly water usage provided however, that the minimum quarterly
charge shall be $13.00.
Alternate System of Billing Computation
If water consumption during the winter billing quarter does not
accurately approximate actual sewer usage throughout the entire
billing year, the quarterly sewer charge shall be based upon water
consumption during such other billing quarter as most accurately
reflects actual sewer usage during the entire billing year. If water
consumption during any particular billing quarter does not accurately
approximate actual sewer usage, the quarterly sewer charge shall be
based upon average quarterly water consumption during the entire
billing year, or such other method as in the opinion of the City
Engineer which most closely approximates actual sewer usage.
B. Structures Connected to Sewer But Not to Water
(1) Regular Residential Rate
A quarterly charge is hereby imposed on each single family attached
dwelling and each single family detached dwelling which is
connected to the municipal sewer system but not to the municipal
water system as follows:
$52.00 per dwelling unit.
(a) Senior Citizen Discount. Provided, however, that the
quarterly charge shall be $26.00 per quarter if said dwelling
unit is occupied by no more than two persons:
i) at least one of whom is at least 65 years of age, and
ii) at least one of whom is the owner of
said dwelling unit.
(b) Alternate System of Billing Computation.
The quarterly sewer charge shall be based upon actual private
source water consumption and upon the rates set forth in
Section A, above, if a water metering system acceptable to
the City has been installed, through which accurate water
consumption records can be established.
(2) Non - Residential Rates
A quarterly charge is hereby imposed on each commercial
structure and each industrial structure, which is connected to
the municipal sewer system but not to the municipal water
system, at rates set forth in Section A, above, and on the
basis of deemed sewer usage as estimated by the City
Engineer on a case -by -case basis approximating as closely as
possible actual sewer usage of similar land used actually
connected to the municipal sewer and water systems.
C. Structures Not Connected to Sewer
(1) A quarterly charge is hereby imposed on each single family
attached dwelling and each single family detached dwelling,
which is not connected to the municipal sewer system though
connection is required by City ordinance as follows:
$104.00 per dwelling unit, provided, however, that
the quarterly charge shall be $52.00 per dwelling unit
if said dwelling unit is occupied by no more than two
persons, at least one of whom is at least 65 years of
age, and at least one of whom is the owner of said
dwelling unit.
(2) A quarterly charge is hereby imposed on each commercial
structure and each industrial structure, which is not
connected to the municipal sewer system though connection
is required by City ordinances, at the rates set forth in Section
A, above, on the basis of deemed sewer usage as estimated
by the City Engineer on a case -by -case basis approximating
as closely as possible two times actual sewer usage of similar
land uses actually connected to the municipal sewer and
water systems.
D. Effective Date
BE IT FURTHER RESOLVED, that these rates shall be effective in
entirety commencing with billings after January 1, 1993.

Utility Fees. DELOITTE & TOUCHE 1995 MANAGEMENT RECOMENDATION
Observation:
The Metropolitan Council Environmental Service (Met Council) provides sewer and water to the City. I
Generally, the Met Council increases the rates for sewer and water services on a yearly basis. However,
the City has not changed its billing rates for utilities since early 1993. The City recognized operating
income of $71,000 in the Enterprise funds during fiscal 1995.
Recommendation:
The City should review the sewer and water charges and consider adjusting them on a yearly basis so that
they can pass - through the increased cost to their customers. The following graphs were included to
provide additional information on how the City compares to the rates that other cities charge for sewer
and water services.

Management Response:
Management defends the City's higher- than - average sewer charges in recognition of the higher sewer
rates paid to Metropolitan Council Environmental Services (MCES) to treat clean water due to the higher
clay content in Chanhassen soil. Water rates are lower than average when compared to comparable cities,
and management would propose an increase in water rates as a part of the 1997 budgetary process.
Duties of the Volunteer Fire Fighting Department:
Observation:
The City currently uses volunteers for first responder and fire fighting services. Using volunteers is the
most cost effective means to provide these services. As a result, most of the administrative duties such as
purchasing, maintaining fixed assets, keeping records of the pension plan, and ensuring that the fire-
fighters have met the proper education requirements are also the responsibility of the volunteers. These
duties are beyond the reasonable expectations of volunteers where responsibilities are not typically
consistently performed.
Recommendation:
Due to the growth in the size of the City and the related reporting and operational demands placed on the
fire department, we recommend that an administrator with the appropriate background to perform these
duties be added to assist the volunteers.
Management Response:
Management would propose that this recommendation be submitted to the Public Safety Commission, and
they be requested to prepare a study of suggestions back to City Council that would address this issue.
