SUBJ: Approve Change Order No. 1 for Lake Lucy Road - Project No. 92 -12
The City Council officially ordered the Lake Lucy Road Improvement Project back in June, 1994.
The project consisted of the construction of Lake Lucy Road from Trunk Highway 41 to 1,500
feet east to an urban roadway section with bituminous surfacing, concrete curb and gutter, storm
sewer, sanitary sewer and watermain. The construction contract for this improvement project
was awarded in October, 1994 to Northdale Contracting in the amount of $530,154.17. The
actual construction of the project began in the late spring of 1995 and was substantially completed
by that fall. The only work that remained (except for minor punchlist work) was the paving of the
final bituminous wearing course which was placed in 1996. The assessment roll for this
improvement project was formally adopted by the City Council on October 9, 1995.
Based on the above project history synopsis, one might wonder why the project contract has not
yet been finaled out. The answer lies due in part to a number of circumstances such as a change
in key project staff personnel with the engineering consulting firm at the end of the project, a
project subcontractor who went out of business prior to completing his punchlist work, and
general delay time between the general contractor and the engineering consultant in coordinating
completing final contract documents. In the past two months, there has been a significant effort
put forth between the consultant engineer and the general contractor to complete the necessary
contract documents and paperwork. This effort has resulted in the one, only and final contract
change order which is attached to this report.
The consultant engineer has provided a very brief explanation of each specific change order item.
A large portion ($15,610 or 28 %) of the overall change order amount resulted from increasing the
length for the right turn lane, acceleration lane, and bypass lane constructed along Trunk Highway
41 at the Lake Lucy Road Intersection. These were MnDOT plan review requirements (which

became known after the contract bid) and were a requirements of the MnDOT access permit
connection to Trunk Highway 41. Another major increase ($13,187 or 24 %) was the result of
soil correction work. Other changes include quantity underestimates and /or typos in the plans or
bid form proposal ($8,026 or 14.5%), watermain changes to facilitate new Well No. 7 ($5,836 or.
10.5 %) which was not known about in 1995, an extra set of utility services to Outlot C, Brenden
Pond ($3,922 or 7 %) (cost was assessed) and extra quantity work such as sodding, retaining
walls, etc. to accommodate adjacent property owners.
In total, the change order amounts to $55,264.54. Since the project was substantially completed
by the fall of 1995 when the assessment hearing was held, these extra work items and
corresponding cost increase in contract amount was known about and taken into account on the
assessment roll. In addition, the revised contract amount, with this approved change order and
corresponding overall project cost, will still be approximately 5% below the original bonding
amount for the project. What this means is that even though change order is occurring well after
the fact, the numbers were taken into account with the assessment roll and no additional bond
funding is required.
With the approval of this change order and the contractor completing a few remaining punch list
items, the contract documents can be finaled. It is therefore recommended that the City Council
approve Change Order No. 1 in the $55,264.54 for the Lake Lucy Road Improvement Project
No. 92 -12 yielding a revised contract amount of $585,418.71.
